Practice of Paramedicine Regulation

"Act" means The Regulated Health Professions Act . («  Loi  ») "college" means the College of Paramedics of Manitoba. (« Ordre ») "competent" , in relation to the performance of a reserved act, means that a member has the requisite skill, knowledge and judgment to perform that act. (« compétent ») "council" means the council of the college. (« conseil ») "former Act" means The Emergency Medical Response and Stretcher Transportation Act . (« loi antérieure ») "member" means a member of the college. (« membre ») "Schedule" means the Schedule to this regulation. (« annexe ») 1(2) A reference to a reserved act in this regulation is a reference to the reserved act listed in section 4 of the Act. M.R. 103/2020 Designation 2 Paramedicine is designated as a regulated health profession for the purpose of the Act. College 3 The College of Paramedics of Manitoba is established under clause 8(b) of the Act for the regulated health profession of paramedicine. Scope of practice 4 The scope of practice of paramedicine is the application of knowledge, skill and judgment for (a) the assessment, management and treatment (i) of an individual's injury or illness that arises from a health emergency, or (ii) of an individual for the purpose of providing health care to that individual, which may include making referrals to other health or social programs or services; and (b) the provision of health education and health promotion programs to an individual. The application of that knowledge, skill and judgment takes place in a variety of practice settings, such as in an individual's residence or in the community, in a vehicle while transporting an individual, or in a health care facility, such as a hospital, or other clinical practice setting. Practice of paramedicine 5 Subject to the Act and the regulations and any conditions imposed on the member's registration or certificate of practice, a member may engage in the practice of paramedicine. But in doing so, the member may not act beyond the scope of practice of paramedicine. M.R. 103/2020 Reserved acts 6(1) In the course of engaging in the practice of paramedicine, a member is authorized, subject to the regulations made by the council and any conditions imposed on the member's registration or certificate of practice, to perform the applicable reserved acts set out in the Schedule. 6(2) Despite subsection (1), a member may only perform a reserved act that the member is competent to perform and that is safe and appropriate for the procedure being performed. M.R. 103/2020 TRANSITION Registrar 7 On the day this regulation comes into force, the registrar appointed by the transitional council under subsection 163(3) of the Act is deemed to be appointed the registrar under section 23 of that Act. M.R. 103/2020 Committee members 8 On the day this regulation comes into force, each member of a committee appointed by the transitional council is deemed to be appointed a member of the successor committee under the Act for a term that is equal to the unexpired portion of the member's term. M.R. 103/2020 By-laws, etc. 9 The by-laws, standards of practice and code of ethics made by the transitional council that are in force on the day this regulation comes into force are deemed to be the college's by-laws, standards of practice and code of ethics made under the Act until they are amended or repealed under that Act . M.R. 103/2020 Officers 10 On the day this regulation comes into force, an officer of the college appointed by the transitional council is deemed to be an officer of the college appointed under section 19 of the Act until the officer's term expires or the appointment is revoked. M.R. 103/2020 Application for licence not concluded 11 An application for a licence made under the former Act but not concluded before this regulation comes into force must be dealt with as an application for registration under the Act . M.R. 103/2020 Deemed registration, deemed licence expiry 12(1) An individual licensed under the former Act as a "technician — advanced care paramedic", "technician — primary care paramedic" or "technician — emergency medical responder" on the day before this regulation comes into force is deemed to be registered as a member in the appropriate subregister in the full membership class under the Act. 12(2) Despite subsection (1), an individual who held a provisional licence under the former Act immediately before this regulation comes into force is deemed to be registered in the provisional membership class under the Act. 12(3) The licence of any individual who is not subject to subsection (1) is deemed to expire on the day before this regulation comes into force. M.R. 103/2020 Transition to retired membership class 13(1) An individual who is not deemed to be registered under subsection 12(1) may apply to be registered as a member in the appropriate subregister in the retired membership class under the Act. 13(2) The registrar must register an individual who applies under subsection (1) if the individual (a) submits a signed application in the form approved by the registrar; (b) held a licence under the former Act in the six years before the day this regulation comes into force; (c) retired from the practice of paramedicine before the day this regulation comes into force and was a member in good standing at the time of retirement; (d) submits a signed declaration that the individual does not intend, at the time of applying for membership, to engage in the practice of paramedicine in Manitoba at a later date; and (e) pays the fee provided for in the college's by-laws. M.R. 103/2020 Converting deemed registration from ACP to CCP 14(1) An individual who is deemed to be registered in the advanced care paramedic subregister under subsection 12(1) may apply to convert their registration to the critical care paramedic subregister within 60 days after this regulation comes into force. 14(2) The registrar must convert the member's registration to the critical care paramedic full membership class under subsection (1) if the member (a) submits a signed application in the form approved by the registrar; and (b) establishes that the member has successfully completed one of the following training programs: (i) BC Emergency Health Services Critical Care Transport Program, (ii) STARS Induction Training, (iii) Ornge Critical Care Paramedic Program. M.R. 103/2020 Certificate of practice 15(1) For greater certainty, an individual who holds a certificate of practice issued by the transitional council under subsection 163(3) of the Act immediately before the day this regulation comes into force is deemed to hold a certificate of practice issued under The Regulated Health Professions Act , subject to any restrictions or conditions imposed on that certificate of practice. 15(2) An individual who is deemed to be registered under subsection 12(1) but who has not yet been issued a certificate of practice under subsection (1) is deemed to hold a certificate of practice issued under The Regulated Health Professions Act , subject to any restrictions or conditions imposed on the individual's registration or license to practice under the former Act, until 60 days after the day this regulation comes into force. 15(3) An individual who is deemed to hold a certificate of practice under subsection (2) may apply for a certificate of practice within 60 days after the day this regulation comes into force. 15(4) The registrar must issue a certificate of practice under subsection (3) if the individual: (a) submits a signed application in the form approved by the registrar; (b) establishes that they met the requirements for continuing competence under the former Act on the day this regulation came into force; (c) provides evidence of holding professional liability insurance that meets the requirements set out in clause 3.12(1)⁠(a) of the College of Paramedics of Manitoba General Regulation ; and (d) pays the fee provided for in the college's by-laws. The certificate of practice must be issued subject to any conditions imposed on the individual's licence under the former Act. 15(5) An individual deemed to be registered as a primary care paramedic under subsection 12(1) may obtain the notation "(Intermediate Care)" on their certificate of practice under the Act if they apply within 60 days after the day this regulation comes into force and the registrar is satisfied that the individual has completed adequate additional training. M.R. 103/2020 Disciplinary actions 16 Any disciplinary action commenced against a person under the former Act must be concluded under the former Act as if the Act had not come into force. M.R. 103/2020 Delegated authority 17 A member who, on the day before this regulation comes into force, had the delegated authority to perform a reserved act that requires additional training under The Regulated Health Professions Act is deemed to have completed the additional training required under that Act. M.R. 103/2020 Coming into force 18 This regulation comes into force on December 1, 2020, or the day it is registered under The Statutes and Regulations Act , whichever is later. M.R. 103/2020 SCHEDULE [Subsection 6(1)] Reserved Act Description 1 Making a diagnosis that is appropriate to the member's practice of paramedicine and communicating it to an individual or their personal representative in circumstances in which it is reasonably foreseeable that the individual or representative will rely on the diagnosis to make a decision about the individual's health care. 2 Ordering or receiving reports of screening or diagnostic tests. 3 Performing a procedure on tissue (a) below the dermis; (b) below the surface of a mucous membrane; or (c) on or below the surface of a tooth or dental implant, including the scaling of a tooth or dental implant. 4 Inserting or removing an instrument or a device, hand or finger (a) into the external ear canal; (b) beyond the point in the nasal passages where they normally narrow; (c) beyond the pharynx; (d) beyond the opening of the urethra; (e) beyond the labia majora; (f) beyond the anal verge; or (g) into an artificial opening in the body. 5 Administering a substance (a) by injection; (b) by inhalation; (c) by mechanical ventilation; (d) by irrigation; (e) by enteral instillation or parenteral instillation; or (f) by transfusion. 9 Administering a drug or vaccine by any method. 10 Applying or ordering the application of (a) ultrasound for diagnostic or imaging purposes, including any application of ultrasound to a fetus; or (b) electricity for (iii) cardioversion, (iv) defibrillation, or (x) transcutaneous cardiac pacing. 12 Setting or casting a fracture of a bone or a dislocation of a joint. 14 Managing labour or the delivery of a baby.
