(« véhicule transportant des personnes sur civière ») "trailer converter dolly" means a vehicle without motive power having a GVWR of 4,500 kilograms or more that has (a) one or more axles, (b) the lower half of a fifth wheel coupler, and (c) a draw bar assembly, and is designed to be used to convert a semi-trailer to a full trailer; (« diabolo remorqué ») "truck" means a motor vehicle designed or adapted primarily for the transportation of cargo and not passengers; (« camion ») "truck tractor" means a truck designed primarily for towing a semi-trailer connected by means of a fifth-wheel coupler, and not constructed for carrying any load other than part of the weight of the trailer; (« véhicule tracteur ») "valid" , in relation to (a) an inspection certificate issued under this regulation or referred to in section 15, means that it is in effect and has not expired, (b) an inspection decal issued under this regulation or referred to in section 15, means that the inspection certificate in connection with which it was issued (or a replacement certificate issued under section 16) is in effect and has not expired, and (c) in relation to a non-Manitoba inspection certificate or decal referred to in section 14, means that the certificate or decal is valid under the inspection program under which it was issued; (« valide ») M.R. 38/96; 215/97; 43/2006 ; 91/2015 ; 23/2019 ; 115/2025 Classes of vehicles requiring inspection 2 Subject to section 2.1, the following are the classes of vehicles that are prescribed as being required to be inspected under and in accordance with this regulation: (a) trucks — including truck tractors — having a GVWR of 4,500 kg or more; (b) buses; (c) [repealed] M.R. 23/2019 ; (d) ambulances having a GVWR of 4,500 kg or more; (e) stretcher transportation vehicles having a GVWR of 4,500 kg or more; (f) trailers —including semi-trailers — having a GVWR of 4,500 kg or more; (g) trailer converter dollies having a GVWR of 4,500 kg or more. M.R. 38/96; 215/97; 91/2015 ; 23/2019 Excluded vehicles 2.1 This regulation does not apply to (a) a trailer owned by a farmer and used exclusively in farming operations; (b) a truck that is registered in the farm trucks registration category under the Vehicle Registration Regulation , Manitoba Regulation 57/2006, and is not a truck tractor; (c) a truck tractor that is registered in the farm trucks registration category under the Vehicle Registration Regulation , Manitoba Regulation 57/2006, and has a GVWR that is less than 21,952 kg; (d) a motor vehicle — or trailer — designed or modified for the purpose of mobile living accommodation; (e) a bus that is owned by an individual and used solely for personal transportation; (f) a new vehicle in transit from one facility of the manufacturer to another or from a facility of the manufacturer to the premises of a wholesale distributor or dealer; (g) a vehicle that is registered by registration card that restricts its use to highways in and adjoining a remote community; (h) a motor vehicle that is registered in the antique vehicles registration category under the Vehicle Registration Regulation , Manitoba Regulation 57/2006; or (i) a bus operated in a public transportation system owned by or operated on behalf of the City of Brandon or City of Winnipeg. M.R. 91/2015 ; 189/2015 ; 23/2019 PART 2 INSPECTION OF CLASSIFIED VEHICLES Classified vehicle must be inspected 3(1) A person must not drive a classified vehicle on a highway, or permit one to be driven, unless (a) the classified vehicle has been inspected under this regulation within the applicable time period set out in subsection (2); (b) an inspection certificate and inspection decal evidencing compliance with the standards of safety and repair have been issued in respect of the classified vehicle and are valid at the time it is being driven; and (c) the inspection decal is securely affixed to the classified vehicle for which it is issued, and (i) in the case of a truck tractor or other truck, or of an ambulance or stretcher transportation vehicle, is placed on the lower left-hand corner of the windshield or in a conspicuous position on the left hand side of the cab, (ii) in the case of a semi-trailer or other trailer or of a trailer converter dolly, is placed on the left-hand side as close as practicable to the vehicle's front, and (iii) in the case of a passenger vehicle, is placed (A) on the lower right-hand corner of the windshield, (B) on a fixed side window as close as practicable to the right front of the vehicle, or (C) in a conspicuous position on the right side of the vehicle's body close to the front of the body. 3(2) The time period within which a classified vehicle must be inspected is as follows: (a) if the classified vehicle (i) is a bus used to transport passengers for compensation, (ii) is a school bus, (iii) is a rental bus, or (iv) is a bus that is operated in a public transportation system owned or operated on behalf of (A) a municipality (other than the City of Brandon or City of Winnipeg), or (B) a community as defined in The Northern Affairs Act , it is the period beginning on the day an inspection certificate and inspection decal for the classified vehicle are issued and ending on the day six months after the last day of the month in which the inspection certificate and inspection decal were issued; (b) in a case not mentioned in clause (a), it is the period beginning on the day an inspection certificate and inspection decal for the classified vehicle are issued and ending on the day 12 months after the last day of the month in which the inspection certificate and inspection decal were issued. 3(3) A person may operate on a highway a classified vehicle, other than a salvageable motor vehicle, that is not in compliance with subsection (1) (a) to deliver it to an inspection station or place for repairs if he or she does so with the written authority of the registrar; (b) to deliver it to an inspection station or place for repairs, or to test it after repairs have been made, if dealers' or repairers' plates are displayed on the vehicle as required by The Drivers and Vehicles Act and the regulations under that Act; (c) to move it from one dealer to another, or between a dealer's dealership premises, if dealers' plates are displayed on the vehicle as required by The Drivers and Vehicles Act and the regulations under that Act; or (d) to demonstrate it for sale if it is a new vehicle and dealers' plates are displayed on it as required by The Drivers and Vehicles Act and the regulations under that Act. 3(4) On the request of the registrar or a peace officer, the operator of a classified vehicle shall (a) within a reasonable time produce for inspection by the registrar or peace officer a valid inspection certificate issued for the classified vehicle; or (b) without delay produce for inspection by the registrar or peace officer the written authority of the registrar referred to in subsection (3). 3(5) When an inspection certificate is issued for a classified vehicle, the vehicle's operator must retain the inspection certificate until the classified vehicle is next inspected for the purpose of this regulation and an inspection certificate is issued in respect of that inspection. M.R. 38/96; 215/97; 156/2001 ; 43/2006 ; 91/2015 ; 189/2015 ; 23/2019 Application to ambulances and stretcher transportation vehicles 3.1 For the purpose of this regulation, (a) an ambulance having a GVWR of 4,500 kg or more (i) is deemed to be a truck having the equivalent GVWR, and (ii) must be inspected to the same standards as such a truck; and (b) a stretcher transportation vehicle having a GVWR of 4,500 kg or more (i) is deemed to be a truck having the equivalent GVWR, and (ii) must be inspected to the same standards as such a truck. M.R. 91/2015 4 [Repealed] M.R. 38/96; 215/97 Inspection certificate and decal 5(1) If on completing the inspection of a classified vehicle the qualified mechanic is satisfied that it complies with the standards of safety and repair, the qualified mechanic must (a) complete and issue an inspection certificate in respect of the classified vehicle; (b) issue, in respect of that inspection certificate, an inspection decal setting forth the date on which the inspection certificate and the inspection decal expire; and (c) affix the inspection decal to the classified vehicle in respect of which it was issued. 5(2) An inspection certificate comes into effect when it is issued and expires (a) six months after the last day of the month in which it was issued if the classified vehicle (i) is a bus used to transport passengers for compensation, (ii) is a school bus, (iii) is a rental bus; or (b) 12 months after the last day of the month in which it was issued if the classified vehicle is not a vehicle mentioned in clause (a). 5(2.1) Despite subsection (2), a valid inspection certificate expires when the motor vehicle in relation to which it was issued is written off under the Written-off, Irreparable and Salvageable Motor Vehicles Regulation. 5(3) An inspection decal expires on the date that the inspection certificate in respect of which it was issued expires. M.R. 38/96; 215/97; 43/2006 ; 91/2015 ; 23/2019 Failure to pass inspection 6 If on completing an inspection of a classified vehicle, the qualified mechanic is of the opinion that it does not comply with the standards of safety and repair, the qualified mechanic must (a) refuse to issue an inspection certificate or inspection decal certifying that the classified vehicle complies with those standards; (b) notify the person who presented the classified vehicle for inspection of its failure to pass the inspection and indicate on the inspection certificate form the items that did not comply with the standards of safety and repair; and (c) give the inspection certificate form to the person presenting the classified vehicle for inspection. M.R. 38/96; 91/2015 Re-inspection 7(1) If a classified vehicle fails to pass an inspection under this regulation and is, within 14 days after failing to pass, again presented for inspection at the inspection station at which the failed inspection took place, a qualified mechanic (a) may re-inspect the classified vehicle with respect to the items that did not comply with the standards of safety and repair; and (b) must, if he or she is satisfied that the classified vehicle now complies with the standards of safety and repair, complete and issue an inspection certificate and an inspection decal in respect of it in the same manner as if the inspection had been passed under section 5. 7(2) The period for re-inspection under subsection (1) does not extend the period of validity of any inspection certificate or inspection decal that was valid when the failed inspection took place. M.R. 38/96; 215/97; 43/2006 ; 91/2015 7.1 and 7.2 [Repealed] M.R. 91/2015 8 [Repealed] M.R. 38/96; 215/97 Charges for inspection certificate forms and decals 8.1 The charges for inspection certificate forms and inspection decals are as specified in the Charges for Licences, Registrations, Permits and Other Services Regulation . M.R. 215/97; 43/2006 PART 3 9 to 13 [Repealed] M.R. 38/96; 215/97 PART 4 GENERAL Non-Manitoba certificates, etc. 14(1) Where (a) a jurisdiction outside of Manitoba operates an inspection program for vehicles that is substantially similar to the inspection program carried out under this regulation; (b) a vehicle has been inspected pursuant to the inspection program carried out in that other jurisdiction and (i) a certificate and a decal or either of them are issued in respect of that vehicle indicating that the vehicle passed the inspection, and (ii) the decal, if issued, is affixed to the vehicle; and (c) the certificate and decal or either of them is valid; that vehicle is deemed to have complied with section 3 of this regulation. 14(2) Where a vehicle is operating in Manitoba pursuant to a certificate and a decal or either of them referred to in subsection (1), this regulation, subject to any necessary modifications, applies in respect of that certificate and decal or either of them in the same manner as if they were an inspection certificate or an inspection decal, as the case may be, that was issued under this regulation. 14(3) If a jurisdiction referred to in clause (1)⁠(a) does not require a vehicle to be inspected for one year from the date of registration of the vehicle in that jurisdiction, the provisions of this regulation do not apply to that vehicle for one year from the date of registration of that vehicle in that jurisdiction. M.R. 215/97; 43/2006 Manitoba vehicle inspected outside Manitoba 15 When (a) a classified vehicle registered in Manitoba is inspected in a jurisdiction outside Manitoba that operates an inspection program for vehicles that is substantially similar to the inspection program carried out under this regulation; and (b) the classified vehicle passes the inspection; the inspection certificate and inspection decal, as the case may be, are deemed to expire on the expiry date specified by subsection 5(2) as though issued under this regulation. M.R. 91/2015 Missing certificates and decals 16(1) A qualified mechanic who is satisfied that an inspection certificate or inspection decal (referred to in this section as the "original inspection certificate" or "original inspection decal") issued in respect of a classified vehicle has been damaged, lost or destroyed may upon request and without an inspection of the classified vehicle issue a replacement inspection certificate and a replacement inspection decal containing the same information as the original inspection certificate and original inspection decal provided that (a) the replacement inspection certificate has a serial number different from the original inspection certificate; (b) the qualified mechanic records the serial number of the original inspection certificate on the replacement inspection certificate; and (c) the replacement inspection certificate contains a statement that it is a replacement. 16(2) A replacement inspection certificate or replacement inspection decal expires on the same day as the original inspection certificate. M.R. 38/96; 91/2015 17 [Repealed] M.R. 91/2015 Repeal 18 The Commercial Vehicles Inspection Regulation , Manitoba Regulation 532/88 is repealed.
