This regulation establishes the Asatiwisipe Aki Traditional Use Planning Area and sets land-use zones with prohibitions on logging, mining, and energy development in several areas, with limited exceptions for approved or road-related activities.

E3 Regulation 77/2011 Registered June 16, 2011 bilingual version (HTML) Table of Contents Section 1 Planning area established 2 Land use areas 3 Protected Area prohibitions 4 Protected Islands Area prohibitions 5 Community Resource Area prohibitions 6 Winter Road Access Corridor Area prohibitions 7 All Season Road Access Corridor Area prohibitions 8 Little George Island Ecological Reserve prohibitions 9 Definitions PART 1 DESIGNATION OF TRADITIONAL USE PLANNING AREA Planning area established 1(1) The Asatiwisipe Aki Traditional Use Planning Area is hereby established. 1(2) Subject to subsections (3) and (4), the planning area consists of all lands within the boundary line shown on Plan Number 20466 filed in the Winnipeg office of the Director of Surveys appointed under The Surveys Act . 1(3) Any private land and any land within the boundaries of a reserve as that term is defined under the Indian Act (Canada) is not included in the planning area. 1(4) The planning area does not include the bed of Lake Winnipeg or any land below the ordinary high-water mark on the shore or the islands in Lake Winnipeg. PART 2 IMPLEMENTATION OF MANAGEMENT PLAN Land use areas 2(1) The planning area is divided into the following land use areas: (a) the Protected Area; (b) the Protected Islands Area; (c) the Community Resource Area; (d) the Winter Road Access Corridor Area; (e) the All Season Road Access Corridor Area; (f) Little George Island Ecological Reserve. 2(2) The boundaries of each land use area are set out on Director of Surveys Plan Number 20466. Protected Area prohibitions 3 No person shall engage in logging, mining or the development of oil, petroleum, natural gas or hydro-electric power in the Protected Area. Protected Islands Area prohibitions 4 No person shall engage in logging, mining or the development of oil, petroleum, natural gas or hydro-electric power in the Protected Islands Area. Community Resource Area prohibitions 5(1) Subject to subsection (2), no person shall engage in logging, mining or the development of oil, petroleum, natural gas or hydro-electric power in the Community Resource Area. 5(2) A person may engage in an activity prohibited under subsection (1) in the Community Resource Area if (a) the activity has been approved in the manner contemplated in the agreement; and (b) the activity is for one of the following purposes: (i) gravel extraction, (ii) air-strip development, (iii) community logging, (iv) community sawmill development, (v) activities related to the development and maintenance of (A) the existing road to Poplar River First Nation or any future road to Poplar River First Nation, or (B) the existing electricity transmission line to Poplar River First Nation. Winter Road Access Corridor Area prohibitions 6(1) Subject to subsection (2), no person shall engage in logging, mining or the development of oil, petroleum, natural gas or hydro-electric power in the Winter Road Access Corridor Area. 6(2) A person may engage in an activity prohibited under subsection (1) in the Winter Road Access Corridor Area if the activity is related to the development, maintenance or rerouting of a winter road. All Season Road Access Corridor Area prohibitions 7(1) Subject to subsection (2), no person shall engage in logging, mining or the development of oil, petroleum, natural gas or hydro-electric power in the All Season Road Access Corridor Area. 7(2) A person may engage in an activity prohibited under subsection (1) in the All Season Road Access Corridor Area if the activity is related to the development, maintenance or rerouting of an all-season road. Little George Island Ecological Reserve prohibitions 8 No person shall engage in any conduct on Little George Island Ecological Reserve that would constitute an offence under The Ecological Reserves Act . Definitions 9 The following definitions apply in this regulation. "agreement" means the Poplar River Traditional Territory Land Relationship Agreement between Poplar River First Nation and the Government of Manitoba signed on October 29, 2008. (« accord ») "planning area" means the Asatiwisipe Aki Traditional Use Planning Area established under subsection 1(1). (« zone de planification »)
