(« en liberté ») M.R. 175/2001 ; 51/2004 ; 1/2006 ; 115/2025 Declaration of exotic wildlife 1.1 An animal listed in Schedule A, B or C is declared to be exotic wildlife. M.R. 175/2001 ; 1/2006 Prohibited exotic wildlife 2 No person shall import into the province, possess, harbour, allow to escape or release to the wild a live animal listed in Schedule A. M.R. 175/2001 Restricted exotic wildlife 3(1) Except as provided in this section, no person shall (a) import into the province; (b) possess or harbour; or (c) allow to escape or release to the wild; a live animal listed in Schedule B. Possession with permit 3(2) A person may possess or harbour a live animal listed in Schedule B if the person is permitted to do so by (a) a permit issued by the minister under this regulation; or (b) a licence issued under The Livestock Industry Diversification Act . Exception for research and zoos 3(3) The minister may issue a permit to import a live animal listed in Schedule B to a public facility established for the purposes of research, public education or zoological display. The permit may be issued subject to any terms and conditions that the minister considers necessary or advisable. Exception for immediate slaughter 3(3.1) The minister may issue a permit authorizing a person to import a live animal listed in Schedule B in order to have the animal slaughtered at a facility licensed under the Meat Inspection Act (Canada). The permit may be issued subject to any terms and conditions that the minister considers necessary or advisable. Permanent identification 3(4) An animal listed in Schedule B must be permanently numbered by the owner with a unique identifier that can be traced back to the owner of the animal. The numbering must be done using an implant, a brand, a tattoo or other means of permanent numbering approved by the director. Numbering of a wild boar may be done using a nose ring. Records 3(5) The holder of a permit to possess an animal listed in Schedule B must submit annually, a record of (a) the identification type, location and unique identifier for every animal he or she possesses; (b) information on every animal added or deleted during the period covered by the report, including the origin of a new animal and the reason for deleting an animal; and (c) if required under the Wildlife Protection Regulation , M.R. 85/2003, the date an animal was last tested for a disease set out in Schedule A to that regulation and the result of the test. M.R. 175/2001 ; 1/2006 ; 94/2010 Controlled exotic wildlife 3.1(1) Except as provided in this section, no person shall (a) import into the province; (b) possess or harbour; or (c) allow to escape or release to the wild; a live animal listed in Schedule C. Possession with permit 3.1(2) A person may import, possess or harbour a live animal listed in Schedule C if (a) the person has a permit issued by the minister under this regulation; or (b) the animal is prescribed in a regulation under The Animal Liability Act as livestock and is possessed for agricultural purposes. M.R. 1/2006 Hunting exotic wildlife running at large 4(1) For the purpose of public safety or the protection of wildlife, wildlife habitat or public or private property, an officer or a person authorized to enforce a municipal by-law may hunt, trap or capture exotic wildlife running at large. Hunting exotic wildlife on own land 4(2) A person may, for the purpose of defending or preserving his or her property, hunt, trap or capture any exotic wildlife running at large on the person's own land. M.R. 175/2001 ; 51/2004 Interference with control program 5 No person shall interfere with (a) a trap, capture device or holding facility set by an officer, an employee, agent or co-operator of the department, or a person enforcing a municipal by-law for the purpose of hunting, trapping or capturing exotic wildlife; or (b) an employee, agent or co-operator of the department, who is engaged in any activity associated with hunting, trapping or capturing exotic wildlife. M.R. 175/2001 ; 51/2004 ; 115/2025 Escape of exotic wildlife 6 The owner or keeper of exotic wildlife that has escaped confinement must (a) immediately report the escape to the nearest office of the department; (b) immediately make reasonable attempts to capture or kill the escaped animal; and (c) follow all directions given by the department to prevent future escapes. M.R. 51/2004 ; 115/2025 Exotic wildlife control areas 7(1) In order to eliminate or control exotic wildlife running at large, the director may designate an area of the province to be an exotic wildlife control area for one or more species of exotic wildlife specified by the director in the designation. Notice of exotic wildlife control areas 7(2) The director shall give notice of an exotic wildlife control area by at least one of the following methods: (a) publishing a notice in a local newspaper; (b) posting signs in or near the area. M.R. 51/2004 Hunting restricted to residents 8(1) No person shall hunt a species of exotic wildlife running at large in an exotic wildlife control area unless the person is a Manitoba resident and is hunting in an area designated as an exotic wildlife control area for that species and the person (a) resides or owns land in that exotic wildlife control area; or (b) is hunting in a municipality that (i) has issued written authorization to the person allowing him or her to hunt that species of exotic wildlife, or (ii) has published notice dispensing with the requirement for written authorization to hunt that species of exotic wildlife. Exemptions 8(2) A person hunting exotic wildlife under subsection (1) is exempted from complying with the Vehicle Use in Hunting Regulation , Manitoba Regulation 212/94, and any provisions of the Act and regulations made under the Act respecting the following matters: (a) hunting licences or permits; (b) possession or transportation permits; (c) hunting seasons; (d) restrictions that limit hunting to a specific day of the week; (e) bag limits or a possession limits; (f) restrictions that limit the capacity of a shotgun to three shells in the chamber and magazine combined; (g) hunter orange head and upper body coverings except when a big game season is open in the area where the hunting is taking place, if hunters are required to wear hunter orange in that big game season. 8(3) [Repealed] M.R. 51/2004 M.R. 51/2004 ; 1/2006 ; 94/2010 ; 13/2024 9 to 11 [Repealed] M.R. 51/2004 Repeal 12 The Importation and Possession of Animals Regulation , Manitoba Regulation 131/90, is repealed. SCHEDULE A (Section 2) PROHIBITED EXOTIC WILDLIFE 1. Nutria ( Myocastor coypus ); 2. Raccoon Dog ( Nyctereutes procyonides ); 3.
