This regulation creates the Peatland Practices Committee, sets how it is composed and run, and requires certain permit or licence holders to follow committee guidelines when the minister approves those guidelines in writing.

P31 Regulation 83/2015 Registered June 11, 2015 bilingual version (HTML) Definition of "committee" 1 In this regulation, "committee" means the Peatland Practices Committee established under section 2. Peatland Practices Committee 2 The Peatland Practices Committee is hereby established. Composition 3(1) The committee is to consist of up to nine members appointed by the minister. 3(2) At least two members of the committee must be employees of the department of government over which the minister presides. 3(3) In appointing members, the minister must seek to ensure that the sphagnum and sedge peat sectors are represented on the committee. Term of members 4(1) A member of the committee may be appointed for a term of up to three years. The term is renewable. 4(2) Of the initial appointments to the committee, as nearly as possible, (a) one-half are to be appointed for a term not exceeding two years; and (b) one-half are to be appointed for a term not exceeding three years. 4(3) A member whose term expires continues to hold office until he or she is re-appointed, the appointment is revoked or a successor is appointed. Chair 5 The minister must designate one member of the committee to be the chair of the committee, and the member designated must be an employee of the government. Functions 6(1) The functions of the committee are to (a) develop, issue and evaluate (i) guidelines for the management and recovery of Crown peatlands, and (ii) performance measures and indicators to be used in assessing the management and recovery of Crown peatlands; and (b) perform any other duty or carry out any other responsibility assigned to the committee by the minister. 6(2) The holder of a peat exploration permit or a peat harvesting licence is required to comply with a guideline issued by the committee if the guideline is approved in writing by the minister. Meetings 7 The committee is to meet regularly throughout the year at the call of the Chair, and, in any event, at least two times a year. Coming into force 8 This regulation comes into force on the same day that section 1 of The Peatlands Stewardship and Related Amendments Act , S.M. 2014, c. 27, comes into force.
