This regulation defines “Act,” lets the board order retroactive pension-type payments, and sets rules for how reciprocal transfer amounts are calculated, credited, charged, refunded, or recovered.

Transfers under reciprocal transfer agreements 6(1) The amounts to be paid or recovered under an agreement made under subsection 41(12) or (14) of the Act must be calculated and paid or recovered in accordance with the agreement. 6(2) If the amount received in respect of a teacher under a reciprocal transfer agreement is less than the amount required by the board, service must be credited in accordance with the agreement, and the teacher may elect to pay the difference to the fund. 6(3) The following amounts must be credited to Account A: (a) ½ of each amount received by the fund under a reciprocal transfer agreement; (b) ½ of each amount received by the fund from a teacher under subsection (2); (c) each amount received by the fund under subsection 41(15) of the Act. 6(4) Half of each amount paid by the fund under a reciprocal transfer agreement must be charged to Account A. 6(5) If an amount charged to Account A as a result of a reciprocal transfer is less than the amount that would otherwise have been refundable to the teacher, the board may refund the difference to the teacher. 6(6) The following amounts must be credited to Account B: (a) ½ of each amount received by the fund under a reciprocal transfer agreement; (b) ½ of each amount received from a teacher under subsection (2). 6(7) Half of each amount paid by the fund under a reciprocal transfer agreement must be charged to Account B. But if an amount is paid by the fund under a reciprocal transfer agreement in respect of a teacher's service that accrued while they were employed by the society or the association, the board must charge that amount to the employer and may recover it by charging it to the account held by the board for the purpose of funding the employer's liability in respect of that service.
