This regulation defines when a person is a qualified person for section 15 of the Act and says the regulation starts when the related amendment Act comes into force.

M110 Regulation 90/2019 Registered May 30, 2019 bilingual version (HTML) Definitions 1 The following definitions apply in this regulation. "Act" means The Mental Health Act . («  Loi  ») " regional health authority " means a regional health authority established or continued under The Regional Health Authorities Act . (« office régional de la santé ») Qualified persons 2 A person who has successfully completed the following training is a qualified person for the purposes of section 15 of the Act: (a) the Provincial Healthcare Violence Prevention Program provided by a regional health authority or Shared Health Inc., or an equivalent program approved by the minister; (b) mental health first aid training, including mental health stigma and discrimination awareness, provided by the Mental Health Commission of Canada, or an equivalent program approved by the minister; (c) crisis prevention, de-escalation and qualified person and patient safety training provided by the Royal Canadian Mounted Police, the Winnipeg Police Service, the Brandon Police Service or the Manitoba Department of Justice, or an equivalent program approved by the minister, that includes instruction in (i) the applicable duty of care and authority of a qualified person under the Act, (ii) co-operative, resistant and assaultive behaviours, (iii) effective communication, and (iv) techniques and tactical considerations to ensure the safety of the qualified person and patient. Coming into force 3 This regulation comes into force on the same day that The Mental Health Amendment Act , S.M. 2016, c. 8, comes into force.
