"authority" means the Evergreen Environmental Technologies Corporation established as an authority in section 2. (« office ») "board" means the board of the authority. (« conseil d'administration ») "member municipality" means a member of the authority that is listed in section 3. (« municipalité participante ») Authority established 2 The "Evergreen Environmental Technologies Corporation" is hereby established as a regional waste management authority under The Regional Waste Management Authorities Act . Members 3 The members of the authority are (a) the Rural Municipality of Elton; (b) the Rural Municipality of Minto – Odanah; (c) the Municipality of North Cypress – Langford; (d) the Town of Carberry; (e) the Town of Minnedosa; and (f) the Town of Neepawa. M.R. 86/2017 Appointments to board and length of term 4(1) Each member municipality is to appoint, by resolution, one member of its council as a member of the board and one member of its council as an alternate member of the board. 4(2) Each member of the board is to be appointed for a two-year term and is eligible for re-appointment. Waste site location 5 The authority is to operate a waste site on land with the legal description as follows: N ½ 11-14-17 WPM on Certificates of Title 1961088 and 1961090. Service area 6 The authority's service area is the area of each member municipality and any other area designated by the board. Fees for each classification of waste 7 The board may establish classifications of waste. At the end of each calendar year, the board must set a fee schedule for the following year for each classification of waste. Deficit and deficit reduction payments 8(1) At the end of the calendar year, the authority must review its revenues and expenses to determine if it is in a surplus or a deficit position. 8(2) If the authority is in a deficit position the board must (a) assess a deficit reduction payment against each of the member municipalities; and (b) give written notice to each member municipality of the amount of the deficit reduction payment that it is required to pay. 8(3) In respect of a deficit reduction payment under subsection (2), (a) the amount of the payment is to be calculated on a per capita basis in respect of the total population of all member municipalities; (b) the written notice must be given on or before the following March 1; and (c) the amount of the deficit reduction payment assessed must be paid by the member municipality on or before the following April 30. 8(4) The authority may impose a penalty on a member municipality for an overdue deficit reduction payment. The penalty must not exceed 1.25% per month.
