"Act" means The Highway Traffic Act . («  Code  ») "bus" excludes a school bus. (« autobus ») "carrier" means a person who operates a commercial vehicle or school bus. (« transporteur ») "commercial vehicle" means (a) a vehicle, other than a bus, that has a GVWR of 4,500 kg or more and is not used solely for personal transportation; or (b) a bus used to transport passengers for compensation. (« véhicule utilitaire ») "drive-away unit" means a combination of a lead motor vehicle and one or more other vehicles that are (a) entirely carried; (b) towed in such a manner that all or the vehicles' wheels are on the highway; or (c) partly towed and partly carried; and includes the lead motor vehicle even when it is not in combination with other vehicles. (« ensemble de véhicules ») "hazardous condition" means a condition of a commercial vehicle that is identified in the standards of safety and repair as a hazardous condition for the type of vehicle. (« risque ») "inspection schedule" means Schedule A, B, C, D or E. (« grille d'inspection ») "inspector" means an inspector appointed under subsection 323(1.1) of the Act. (« inspecteur ») "major defect" , in relation to a commercial vehicle, means a major defect listed in the third column of the table set out in the inspection schedule that applies to the type of commercial vehicle. (« défectuosité majeure ») "minor defect" , in relation to a commercial vehicle, means a minor defect listed in the second column of the table set out in the inspection schedule that applies to the type of commercial vehicle. (« défectuosité mineure ») "motor coach" means a bus that is (a) of monocoque design; (b) manufactured to provide intercity, suburban, commuter or charter service; and (c) equipped with under-floor baggage storage. (« autocar ») "school bus" does not include a school bus that is designed for carrying 10 or fewer persons including its driver. (« autobus scolaire ») "standards of safety and repair" means the standards of safety and repair set out in Part B (Periodic Commercial Motor Vehicle Inspections) of National Safety Code Standard 11 , published by the Canadian Council of Motor Transport Administrators, as adopted by section 4.3 of the Vehicle Equipment, Safety and Inspection Regulation . (« normes en matière de sécurité et de réparation ») "trailer" means a trailer that has a GVWR of 4,500 kg or more. (« remorque ») M.R. 87/2015 ; 19/2019 When regulation does not apply 2(1) This regulation does not apply to the following: (a) a two-axle or three-axle commercial vehicle or any trailer attached to it while being used primarily for the transportation of primary farm, forest or aquatic products if the driver or driver's employer is the producer of the products; (b) a vehicle used solely for the purpose of snow removal by or on behalf of a traffic authority; (c) a motor vehicle of a public transportation system owned by or operated on behalf of the City of Winnipeg or City of Brandon; (d) a vehicle that is part of a drive-away unit as defined in the Act and that does not move by its own motive power, whether or not it is capable of doing so; (e) a vehicle while it is being used in relation to a fire, flood, epidemic, drought or similar event; (f) [repealed] M.R. 19/2019 ; (g) a limited-use regulated vehicle that has a registered gross weight less than 6,800 kg and is not operated outside Manitoba. 2(2) In the case of a commercial vehicle that is not a school bus, clause 4(b), sections 5, 6 and 13 and subsections 12(1) and (2) and 17(2) do not apply to the commercial vehicle or to any trailer attached it on any day that it is operated solely within 160 km of the place of business of the carrier at which the driver of the vehicle ordinarily reports for work. 2(3) In the case of a commercial vehicle that is not a school bus, clause 4(b), sections 5, 6 and 13 and subsections 12(1) and (2) and 17(2) do not apply to the commercial vehicle if (a) it is the only commercial vehicle operated by the carrier; and (b) its only driver is an individual (i) who is also the carrier, or (ii) who controls the corporation that is the carrier. M.R. 87/2015 ; 185/2015 ; 19/2019 Commercial vehicles and applicable inspection schedules 3(1) Schedule A applies to the following commercial vehicles: (a) a motor vehicle other than a bus; (b) a trailer when it is towed by a commercial vehicle described in clause (a). 3(2) Subject to subsection (3), Schedule B applies to the following commercial vehicles: (a) a motor coach or other bus; (b) a trailer when it is to be towed by a motor coach or other bus that is a commercial vehicle. 3(3) As an alternative to Schedule B, Schedules C and D apply together to a commercial vehicle that is a motor coach and is equipped with air ride suspension or air brakes, or both. 3(4) Schedule E applies to a commercial vehicle that is a school bus. M.R. 87/2015 ; 19/2019 Commercial vehicle must not be driven or towed unless inspected 4 No carrier shall permit a person to drive or tow, and no person shall drive or tow, a commercial vehicle on a highway unless (a) it is inspected as required by this regulation; and (b) the driver or other person who performs the inspection records in the inspection report any minor or major defects in the vehicle observed during the inspection or otherwise known to the driver or the other person. Carrier must provide inspection schedules 5(1) A carrier must provide the driver of any of its commercial vehicles with written or electronic copies of the inspection schedules that apply to the type of commercial vehicle that the driver is to drive or tow. 5(2) The carrier may only provide the driver with electronic copies of the inspection schedules if (a) the driver or the commercial vehicle has the necessary equipment for the driver to provide an inspector with written copies of the electronic inspection schedules on demand and the equipment is working properly at the beginning of the driver's shift; or (b) the driver is able to provide an inspector with preprinted or handwritten copies of the inspection schedules on demand. Driver must carry and produce inspection schedules 6 The driver of a commercial vehicle must (a) have in his or her possession while driving the vehicle a written or electronic copy of each of the inspection schedules that apply to the vehicle and to any commercial vehicle that it is towing; and (b) produce the inspection schedules to an inspector on demand. Required daily inspections 7(1) The driver of commercial vehicle that is a motor vehicle other than a bus must inspect the vehicle or have it inspected for the minor and major defects listed in Schedule A every 24 hours that the vehicle is in service. 7(2) The driver of a commercial vehicle that is a motor vehicle, and that is towing a trailer that is also a commercial vehicle, must inspect the trailer or have it inspected for the minor and major defects listed in Schedule A every 24 hours that the trailer is in service. 7(3) Subject to section 8, the driver of a commercial vehicle that is a motor coach or other bus must inspect the vehicle or have it inspected for the minor and major defects listed in Schedule B every 24 hours that the vehicle is in service. 7(4) The driver of a commercial vehicle that is a motor coach or other bus towing a trailer, which is also a commercial vehicle, must inspect the trailer or have it inspected for the minor and major defects listed in Schedule B every 24 hours that the trailer is in service. 7(5) The driver of a school bus must inspect the vehicle or have it inspected for the minor and major defects listed in Schedule E every 24 hours that the vehicle is in service. 7(6) When any of the vehicles referred to in subsections (1) to (5) is not used or is otherwise out of service for more than 24 consecutive hours, the driver must inspect it or have it inspected in accordance with the applicable inspection schedule before driving or towing it in service. 7(7) The driver of a commercial vehicle that (a) carries a load that is not entirely contained within the commercial vehicle's body; or (b) tows a trailer that carries a load that is not entirely contained within the trailer's body; must measure and make a record of the height and width of the load. M.R. 87/2015 ; 19/2019 Inspecting air ride or air brake motor coaches 8(1) Subject to subsection (2), as an alternative to inspecting — in accordance with subsection 7(3) — a motor coach that is equipped as described in subsection 3(3), the driver of the motor coach may (a) inspect the vehicle or have it inspected for the minor and major defects listed in Schedule C every 24 hours that the vehicle is in service; and (b) have the vehicle inspected for the major defects listed in Schedule D every 12,000 km of service or every 30 days, whichever occurs first. 8(2) The driver must not perform, or have performed, an inspection of the motor coach under clause (1)⁠(a) unless (a) the motor coach has, in accordance with this regulation, been inspected in Manitoba for the major defects listed in Schedule D within the previous 12,000 km of service or the previous 30 days, whichever represents the shorter period, and the driver is in possession of the inspection report from that inspection; or (b) if the motor coach was last inspected for such major defects outside Manitoba, (i) the driver is in possession of an inspection report that shows that (A) the motor coach was inspected during the same period for major defects that are the equivalent of those set out in Schedule D, (B) the inspection was performed by a person who would have been entitled to perform the inspection under clause 10(b) if the inspection had been performed in Manitoba, and (C) any major defects observed during the inspection have been repaired, (ii) the inspection and repairs were performed in accordance with the laws of the jurisdiction where the inspection was performed, and (iii) the inspection report is signed and certified in accordance with the laws of the jurisdiction where the inspection was performed, including with respect to the completion of repairs. How inspections are to be performed 9 A person who inspects a commercial vehicle for the purposes of this regulation must (a) inspect each system or piece of equipment, or part of the vehicle or its load, listed in the first column in the table in the inspection schedule that applies to the type of vehicle; (b) perform an inspection that is adequate to determine whether the vehicle has any of the minor or major defects set out in the schedule; and (c) if the inspection is for the major defects listed in Schedule D, perform the inspection from below the motor coach while it is positioned over a pit or is raised in a manner that provides adequate access to inspect all of the systems or pieces of equipment that are required to be inspected by that section. Who may perform an inspection 10 A person who inspects a commercial vehicle for the purposes of this regulation must, (a) if the inspection is for minor and major defects listed in Schedule A, B, C or E, have sufficient knowledge and experience of commercial vehicle mechanics to recognize the defects listed in the inspection schedule that applies to the type of vehicle; or (b) if the inspection is for major defects listed in Schedule D, must (i) be a qualified mechanic as defined in subsection 1(1) of The Drivers and Vehicles Act , (ii) hold a truck and transport mechanic certificate of qualification under The Apprenticeship and Trades Qualifications Act , or (iii) have equivalent qualifications to those referred to in subclause (i) or (ii) obtained in another province or a territory of Canada. Responsibility of carrier for inspections 11 A carrier must ensure that each of the carrier's commercial vehicles is inspected as required by sections 7 to 10. Person performing inspection must prepare report 12(1) A person who inspects a commercial vehicle for the minor and major defects listed in Schedule A, B, C or E must without delay prepare a legible written or electronic inspection report that contains (a) the following information: (i) the licence plate or unit number of the vehicle, (ii) the vehicle's odometer reading if it is equipped with an odometer, (iii) the carrier's name, (iv) the date and time of inspection, (v) the name of the urban municipality or a description of the highway location where the inspection was performed, (vi) the legible printed name of the person who performed the inspection; (b) a record of the height and width of the vehicle and load, and if subsection 7(7) applies in respect of the vehicle, of the height and width of all loads carried by the vehicle since it was last inspected for the purposes of this regulation; (c) the information about minor and major defects required by section 15 and subsection 16(1); and (d) a statement signed by the person who performed the inspection and by the vehicle's driver that the vehicle identified in the report has been inspected in accordance with this regulation. 12(2) A person who inspects a commercial vehicle under clause 8(1)⁠(b) must without delay prepare a legible written or electronic inspection report that contains (a) the following information: (i) the licence plate number, vehicle identification number or unit number of the vehicle, (ii) the carrier's name, (iii) the date and time of inspection, (iv) the name of the urban municipality or a description of the highway location where the inspection was performed, (v) the legible printed name of the person who performed the inspection; (b) the information about major defects and the vehicle required by section 15 and subsection 16(2); and (c) a statement signed by the person who performed the inspection that the vehicle identified in the report has been inspected in accordance with this regulation. 12(3) Despite subsections (1) and (2), the driver or other person must not prepare the inspection report in electronic format unless (a) the information contained in the electronic inspection report is the same as the information that would have been in a written report; (b) when requested to do so by an inspector, the driver or other person can without delay produce the inspection report by doing any or a combination of the following: (i) producing it on a digital display screen of an electronic device, (ii) producing it in legible written form, (iii) producing it in any other intelligible form; (c) the driver or other person is capable, if so requested by an inspector, of preparing a legible handwritten report from the information stored in the electronic device; (d) the electronic device automatically records when it is disconnected and reconnected or is otherwise used in preparing the inspection report, and keeps a record of the time and date of these occurrences; (e) any written copy of an inspection report that is generated from the information that is stored in the electronic device is signed on each page by the driver attesting to its accuracy; and (f) the carrier provides blank inspection report forms in the commercial vehicle for the driver's or other person's use. 12(4) A driver who discovers a minor or major defect by inspecting a commercial vehicle that he or she drives or tows must report the defect to the carrier (a) before section 7 next requires the vehicle to be inspected if the defect is a minor defect; or (b) without delay if the defect is a major defect. 12(5) A person who inspects a commercial vehicle for the purposes of this regulation and is not the vehicle's driver must without delay after preparing the inspection report give it to the driver in written format. 12(6) A driver who is given an inspection report under this regulation must sign the inspection report without delay after receiving it. The driver is deemed to be aware of any minor or major defect recorded in the report no later than the time when he or she receives it. Inspection report must be carried 13 No carrier shall permit a person to drive or tow, and no person shall drive or tow, a commercial vehicle on a highway unless (a) in the case of a vehicle — other than a motor coach referred to in clause (b) — to which Schedule A, B or E applies, the person is in possession of an inspection report for the vehicle that complies with subsection 12(1) and shows that the vehicle was inspected in accordance with section 7; or (b) in the case of a motor coach that is equipped with air ride suspension or air brakes, or both, (i) the person is in possession of an inspection report for the vehicle that complies with subsection 12(1) and shows that the vehicle was inspected in accordance with subsection 7(3), or (ii) the person is in possession of (A) an inspection report for the vehicle relating to Schedule C that complies with subsection 12(1) and shows that the vehicle was inspected in accordance with section 8; and (B) an inspection report for the vehicle relating to Schedule D that complies with subsection 12(2) and also shows that the vehicle was inspected in accordance with section 8. Driver must produce report to inspector 14(1) Subject to subsection (2), the driver of a commercial vehicle must produce to an inspector on demand the inspection reports that he or she is required to possess by clause 13(a) or, if applicable, by clause 13(b). 14(2) For the purposes of subsection (1), the driver of a motor coach that is equipped with air ride suspension or air brakes, or both, must produce an inspection report that indicates that the motor coach was inspected in accordance with Schedule B, unless he or she produces inspection reports that indicate that the motor coach was inspected in accordance with both Schedules C and D. Report when no defect is detected 15 If no minor or major defect is detected in a system or piece of equipment, or a part of a vehicle or load, during an inspection, the person performing the inspection must record that fact in the inspection report. Report when defect is detected 16(1) If a minor or major defect is detected in a system or piece of equipment, or a part of vehicle or load, during an inspection under section 7, the person performing the inspection must record that fact in the inspection report. 16(2) A person who performs an inspection under clause 8(1)⁠(b) must record in the inspection report (a) the brake adjustment measurements that he or she observes; and (b) the nature of all the major defects detected during the inspection. Driver must monitor vehicle while driving 17(1) While driving or towing a commercial vehicle, the driver must monitor its condition for any of the minor and major defects listed in any inspection schedule that applies to the type of vehicle. 17(2) If the driver notices or is made aware of a minor or major defect in the vehicle at any time, the driver must, in the same manner as if it was discovered during an inspection under this regulation, record it in the inspection report required by section 7 or 8 for the type of vehicle and report it to the carrier. Vehicle must not be driven or towed with major defect 18(1) No carrier shall permit a person to drive or tow, and no person shall drive or tow, a commercial vehicle on a highway while the vehicle has a major defect. 18(2) Subsection (1) does not apply to a person who tows a commercial vehicle while driving a tow truck. 18(3) Subsection (1) does not apply if the major defect relates to the heating system for a bus's passenger compartment, and (a) an inspector has directed that the bus be driven to safely deliver passengers to a specified destination; or (b) the bus is not carrying any passengers and is being driven to a location to be repaired. M.R. 107/2024 When defects must be corrected 19(1) A carrier must ensure that each of its commercial vehicles that (a) has a minor defect is repaired to correct the defect before section 7 or clause 8(1)⁠(a) next requires the vehicle to be inspected after the defect is observed or comes to the driver's attention; and (b) has a major defect is repaired to correct the defect before the vehicle is next driven on a highway. 19(2) If a minor defect is not repaired before the time of the commercial vehicle's next scheduled inspection, no person shall drive or tow the vehicle after that time. 19(3) As an exception to subsection (2), the commercial vehicle may be driven or towed directly to the nearest repair facility to be repaired if the vehicle is safe to drive or tow. 19(4) Despite clause (1)⁠(b), a bus may be driven on a highway before a major defect relating to its passenger compartment heating system is repaired if it is driven in accordance with subsection 18(3). M.R. 107/2024 Repair of certain major defects to be recorded 20 After all the major defects recorded in the inspection report relating to Schedule D are repaired, a person referred to in subclause 10(b)⁠(i), (ii) or (iii) must, by signing and dating the inspection report containing the repair records, certify that the major defects have been repaired. Driver must give report to carrier 21 The driver of a commercial vehicle or a driver who tows a trailer that is commercial vehicle must, (a) within 20 days after preparing or receiving an inspection report in relation to Schedule A, B, C or E respecting the vehicle; or (b) within 40 days after receiving an inspection report in relation to Schedule D respecting the vehicle; give the inspection report to the carrier. Carrier must retain records 22 A carrier must retain (a) the original copy of each inspection report required by this regulation; and (b) certification that repairs of major defects referred to in section 20 have been done; for at least six months after the date that the report was prepared and must produce them to an inspector on demand. False or misleading inspection reports 23 No person shall make or permit another person to make an inspection report under this regulation, or acquiesce in the making of such an inspection report, that (a) is false or misleading with regard to the inspection of the vehicle; (b) misrepresents or fails to disclose a minor or major defect required to be recorded in an inspection report; or (c) is false or misleading with regard to when, whether or by whom the repair of a defect or major defect was completed. Mutilated, defaced or altered reports 24 No person shall mutilate, deface or alter an inspection report made under this regulation, or permit another person to mutilate, deface or alter such an inspection report, if doing so results in the inspection report being false, misleading or unreadable. Repeal 25 The Commercial Motor Vehicle and Trailer Trip Inspection Regulation , Manitoba Regulation 112/96, is repealed. Coming into force 26 This regulation comes into force on July 1, 2008, or on the day it is registered under The Regulations Act , whichever is later.
