This regulation gives the extra-provincial board authority over Manitoba milk and cream marketing, including pricing support, levies, penalties, reporting, and audit access.

F47 Regulation 96/96 Registered May 17, 1996 bilingual version (HTML) Definitions 1 In this regulation, "components of milk and cream" include butterfat, solids non-fat, protein and whey derived from milk or cream; (« composants du lait et de la crème ») "extra-provincial board" means the Canadian Dairy Commission constituted by the Canadian Dairy Commission Act ; (« conseil extra-provincial ») "milk" milk means obtained from cows, and includes cream separated from milk and all components of milk and cream; (« lait ») "milk products" includes evaporated milk, evaporated partly skimmed milk, evaporated skimmed milk, milk powder, skim milk powder, cheese and butter. (« produits laitiers ») Marketing authority 2 The Lieutenant Governor in Council hereby authorizes the extra-provincial board, to stabilize the price of milk and cream produced in Manitoba and sold by the producer of such milk and cream, (a) by purchasing or otherwise acquiring such quantity or quantities of milk products produced in Manitoba as the extra-provincial board considers advisable and selling or otherwise disposing of such quantity or quantities of milk products so purchased or otherwise acquired, (b) by packing, processing, storing, shipping and transporting milk products produced in Manitoba; and (c) by advertising, promoting and encouraging the consumption and use of milk, cream and milk products produced in Manitoba by advertising, promotional incentives, and assistance programs. Levies or charges 3 The Lieutenant-Governor-in-Council hereby vests in the extra-provincial board the power to make regulations imposing levies or charges payable to it, or on its behalf, on producers of milk and on producers of cream, and for such purpose to classify such persons into groups and fix the levies or charges payable by the members of the different groups in different amounts. Penalties 4 The Lieutenant-Governor-in-Council hereby vests in the extra-provincial board the power to make regulations controlling the quantity of milk and cream that may be marketed by imposing penalties on producers. Approval 5 Any levies, charges or penalties fixed or imposed by the extra-provincial board pursuant to sections 3 or 4 shall not become effective until approved by the Manitoba Milk Producers. Calculation and collection of levies charges and penalties 6 The extra-provincial board may make regulations providing for the calculation and collection of any levies charges or penalties fixed or imposed by the extra-provincial board and the remission thereof, as its agent, to it by any person engaged in the marketing of milk or cream, and may require Manitoba Milk Producers or any person engaged in the marketing of milk or cream to deduct from the money payable for any milk or cream any levies, charges and penalties payable to the extra-provincial board by the producer from whom it receives the milk or cream and to forward such levies, charges and penalties to the extra-provincial board or its designated agent not later than 20 days from the last day of the month following the month in which it receives milk or cream. Information 7 The extra-provincial board may make orders requiring a producer or any person engaged in the marketing of milk or cream to report to it any information respecting the marketing of milk or cream. Audit 8 The extra-provincial board shall, at any time during normal office hours, make available to such auditor as the Minister of Agriculture may designate, all books of account, records and documents relating to the receipt of levies, charges and penalties imposed under this regulation. Repeal 9 The Canadian Dairy Commission Delegation Regulation , Manitoba Regulation 133/90, is repealed.
