This regulation sets out how to apply for a night hunting permit, what permit holders must carry or show, what proof an aboriginal person must carry and produce when hunting at night in northern Manitoba, and a 3 km firearm discharge restriction in certain places.

W130 Regulation 97/2020 Registered October 9, 2020 bilingual version (HTML) Definitions 1 The following definitions apply in this regulation. "Act" means The Wildlife Act . («  Loi  ») "director" means the Director of the Wildlife and Fisheries Branch. (« directeur ») "night hunting permit" means a permit issued under section 12.2 of the Act. (« licence de chasse de nuit ») "northern Manitoba" means the area designated as northern Manitoba in Schedule B of the Act. (« nord du Manitoba ») "southern Manitoba" means the area designated as southern Manitoba in Schedule B of the Act. (« sud du Manitoba ») Application for a night hunting permit 2(1) An application for a night hunting permit must be made in writing to the director on a form approved by the director. 2(2) The application must contain the following information and documentation: (a) the applicant's name, address and contact (b) a copy of documentation that establishes the applicant's aboriginal status; (c) the species of wildlife that the applicant intends to hunt at night; (d) the area where the applicant seeks to hunt at night; (e) the dates when the applicant seeks to hunt at night; (f) the names of any persons that the applicant intends to hunt with at night. information; Permit requirements 3(1) The holder of a night hunting permit must (a) sign the permit; and (b) carry the permit with them when they are hunting at night in southern Manitoba under authority of the permit. 3(2) The holder of a night hunting permit must produce the permit when requested to do so by an officer. Proof of status while night hunting in northern Manitoba 4(1) An aboriginal person who is hunting at night in northern Manitoba as authorized under section 12.1 of the Act must carry written proof of their aboriginal status while hunting at night. 4(2) The person must produce the documentation required under subsection (1) when requested to do so by an officer. Safe discharge of firearms 5 An aboriginal person who is hunting at night in northern Manitoba as authorized under section 12.1 of the Act must not discharge a firearm within 3 km of (a) a building used for residential, recreational, commercial or industrial purposes; (b) a campground or other occupied area; (c) an area where livestock are kept; or (d) a provincial road or provincial trunk highway. Coming into force 6 This regulation comes into force on the same day that The Wildlife Amendment Act (Safe Hunting and Shared Management) , S.M. 2018, c. 33, comes into force.
