"building code" means the most recent version of the Manitoba Building Code made under The Buildings Act . («  Code du bâtiment  ») "dwelling unit" has the same meaning as in the building code. (« logement ») "farm building" means a building to which Article 1.3.3.5. of Division A of the building code applies. (« bâtiment agricole ») "part 3 building" means a building to which Article 1.3.3.2. of Division A of the building code applies. (« bâtiment visé par la partie 3 ») "part 9 building" means a building to which Article 1.3.3.3. of Division A of the building code applies. (« bâtiment visé par la partie 9 ») "phase 1" means the period beginning on the day this regulation comes into force and ending on February 28, 2025. (« phase 1 ») "phase 2" means the period after the end of phase 1, beginning on March 1, 2025. (« phase 2 ») "Schedule" means the Schedule to this regulation. (« annexe ») Notification of complete application 2 An approving authority must notify an applicant for a building permit or occupancy permit whether the application is complete within the following time periods: (a) for an application filed during phase 1, within five business days after receipt of the application by the approving authority; (b) for an application filed during phase 2, within two business days after receipt of the application by the approving authority. Decision on application 3(1) During phase 1, an approving authority must make a decision on an application for a building permit filed for the class of building as indicated in Column 1 of the table in the Schedule within the time period after a complete application has been submitted as indicated opposite in Column 2. 3(2) During phase 2, an approving authority must make a decision on an application for a building permit filed for the class of building as indicated in Column 1 of the table in the Schedule within the time period after a complete application has been submitted as indicated opposite in Column 3. 3(3) An approving authority must make a decision on an application for an occupancy permit within 10 business days after a complete application has been submitted. Inspection 4(1) During phase 1, an approving authority must conduct an inspection within the following time periods: (a) for residential use buildings, within six business days after the date on which inspection was requested; (b) for commercial use buildings, within four business days after the date on which inspection was requested. 4(2) During phase 2, an approving authority must conduct an inspection within two business days after the date on which the inspection was requested. Exceptions 5(1) The timelines listed in sections 2 to 4 may be extended by an agreement in writing between the applicant and the approving authority. 5(2) The timelines listed in section 4 do not apply if (a) the building to which the application relates is located more than 200 km from the office of the approving authority; (b) the applicant has requested that inspections of the building occur outside of the approving authority's business hours; or (c) the applicant has requested that the inspection of the building occur at a later date. Coming into force 6 This regulation comes into force on the same day that section 19 of The Buildings and Mobile Homes Amendment Act , S.M. 2021, c. 37, Schedule B, comes into force.
