Animal Premises Identification Regulation

"Act" means The Animal Diseases Act . («  Loi  ») "operator" means the person who is in charge of day-to-day operations at a farm or other premises. (« exploitant ») "owner" , in relation to a farm or other premises, includes a person who occupies the farm or other premises. (« propriétaire ») "personal information" means personal information as defined in The Freedom of Information and Protection of Privacy Act . (« renseignements personnels ») "premises" means (a) land whether or not (i) a building or other structure is on it, or (ii) a structure surrounds it; or (b) a building or other structure, including the land (i) on which the building or other structure is located, and (ii) associated with or surrounding the building or other structure. (« lieu ») "primary animal premises" means the part of a farm or other premises, not exceeding a contiguous area of ¼ section, at which the highest percentage of the commercial animals owned by its owner or operator is being kept at the time at which subsection 3(3) or (6) or 4(3) or (4) requires information to be provided to the director. (« lieu principal ») "producer board" means a board as defined in The Farm Products Marketing Act , but does not include Keystone Potato Producers Association, Manitoba Beekeepers' Association or Peak of the Market. (« office de producteurs ») Collection of information by the director 2(1) The director is authorized to collect from a source mentioned in any of sections 3 to 5 the types of information described in subsection 3(1) or (4). 2(2) The director may maintain the information he or she collects in a format that he or she considers necessary to allow the information to be used efficiently for one or more of the following purposes: (a) detecting, preventing, controlling, managing and eliminating disease; (b) analyzing the geographical distribution of disease and the epidemiology of disease outbreaks; (c) conducting assessments and models to prevent disease risk; (d) tracking the movement of animals from premises to premises; (e) protecting animal health and human health; (f) emergency planning; (g) eliminating disease barriers to market access; (h) checking the accuracy of information collected or provided under this regulation. Information to be provided by owners and operators 3(1) The owner or operator of a farm or other premises at which a commercial animal is kept for any purpose must provide the director with the following information: (a) the legal land description of his or her primary animal premises and, if so required by the director, the georeferenced co-ordinates of the premises; (b) the name of the individual who is in charge of day-to-day operations at the farm or other premises and his or her business address and contact phone and fax numbers, or — in the case of a premises at which a commercial animal is kept for a non-agricultural or non-commercial purpose — the name, address, and contact phone and fax numbers of an individual who can be contacted for the purposes of the Act; (c) the name, address, phone and fax numbers of the owner of the farm or other premises; (d) the business name in which the farm or other premises is operated; (e) the type of operation, if applicable; (f) the species of commercial animals kept and the maximum capacity of the farm or other premises for keeping commercial animals. 3(2) The owner or operator must provide the information in the form that the director requests. 3(3) The owner or operator must provide the information at the following times: (a) in the case of a farm or other premises at which a commercial animal is kept on the day that this regulation comes into force, (i) on or before September 1, 2010, and (ii) at any other time that the director requests it; (b) in the case of a farm or other premises at which no commercial animal is kept on the day that this regulation comes into force, (i) within 30 days after a commercial animal is kept at the farm or other premises, and (ii) at any other time that the director requests it. 3(4) Despite clause (1)⁠(a), the director may require an owner or operator to provide (a) the legal land description of any additional premises that he or she owns or operates at which commercial animals are kept for any purpose; and (b) the georeferenced co-ordinates of the additional premises. 3(5) If the director requests an owner or operator to provide information under subsection (4), the owner or operator must provide the information without delay and in the form that the director requests. 3(6) The owner or operator must inform the director within 30 days after any change in the information required by any of clauses (1)⁠(a) to (f) or subsection (4). 3(7) If the owner and the occupier, or the owner and the operator, of a farm or other premises are not the same person, the requirements of section 3 apply to them both equally. The requirements may be satisfied by either of them providing the required information or by them providing the information in combination. Information to be provided by producer boards 4(1) If an owner or operator is registered with or licensed by a producer board and the producer board is in possession of any of the information required by subsection 3(1) or (4) about (a) the owner or operator; (b) the owner's or operator's farm or other premises; and (c) commercial animals kept in or at the premises; the producer board must provide the director with the information. 4(2) The producer board must provide the information in the form that the director requests. 4(3) The producer board must provide the information on or before September 1, 2010, and at any other time that the director requests it. 4(4) If any of the information in the producer board's possession changes, including information in relation to newly registered or licensed owners or operators, the producer board must provide the director with the new information within 30 days after the new information comes into the producer board's possession. 4(5) An owner or operator whose information is provided to the director by a producer board is deemed to have complied with section 3 to the extent of the information provided. Collecting information from other sources 5(1) On request, the director may collect from a department, branch, office or agency of the Government of Manitoba any information of the types described in subsection 3(1) or (4) that is in the department's, branch's, office's or agency's possession. 5(2) A department, branch, office or agency must provide the information requested under subsection (1) in the form and by the time that the director requests it. 5(3) Subsection 2(2) applies with necessary changes to information collected or provided under this section. Disclosing information 6(1) For a purpose set out in subsection 2(2), the director and any person acting under his or her direction may share with or disclose to any or all of the following: (a) a department, branch, office or agency of the Government of Manitoba; (b) the Government of Canada or a municipal, provincial or foreign government, or an agency of such a government, or a person or body, whose duties and interests include (i) protecting the public health, (ii) monitoring or reporting on the safety of agricultural inputs, food, livestock or livestock products, or (iii) monitoring or reporting on the biological, chemical and physical integrity of agricultural inputs, food, livestock or livestock products; (c) a producer board; information collected or provided under this regulation, including personal information. 6(2) If personal information is shared or disclosed under subsection (1), it must be limited to the minimum amount necessary to carry out the purpose for which it is shared or disclosed. Coming into force 7 This regulation comes into force on July 1, 2010, or on the day it is registered under The Regulations Act , whichever is later.
