This regulation designates certain laws and document types for Part 2 of the Act, and exempts listed electronic documents from the electronic signature requirement.

DESIGNATED LAWS Laws relating to business registrations 2 The Business Names Registration Act , The Cooperatives Act and The Corporations Act , and the regulations under those Acts, are designated as designated laws for the purpose of Part 2 of the Act insofar as they relate to (a) a document that is or may be deposited or filed with, or submitted to, (i) the Director or a Deputy Director appointed under section 19 of The Business Names Registration Act , (ii) the Registrar or a Deputy Registrar designated under subsection 7(1) of The Cooperatives Act , (iii) the Superintendent or a Deputy Superintendent designated under subsection 7.1(1) of The Cooperatives Act , or (iv) the Director or a Deputy Director appointed under section 253 of The Corporations Act ; (b) a document issued or created by or on behalf of a person referred to in any of subclauses (a)⁠(i) to (iv); (c) information contained or recorded in, or to be recorded in or removed from, a system of registration under The Business Names Registration Act , The Cooperatives Act or The Corporations Act ; or (d) search results, or a request for search results, under The Business Names Registration Act , The Cooperatives Act or The Corporations Act . Laws relating to real property and personal property registries 3 Every Act and regulation is designated as a designated law for the purpose of Part 2 of the Act insofar as it relates to (a) a document that is or may be (i) deposited or filed in a land titles or registry office, (ii) submitted for registration in a system of registration under The Condominium Act , The Personal Property Security Act , The Real Property Act or The Registry Act , (iii) issued or created by or on behalf of a district registrar or a person to whom a power or duty of a district registrar has been delegated, or (iv) issued or created by or on behalf of the Registrar under The Personal Property Security Act ; (b) information contained or recorded in, or to be recorded in or removed from, a system of registration under The Condominium Act , The Personal Property Security Act , The Real Property Act or The Registry Act ; or (c) search results, or a request for search results, under The Personal Property Security Act , The Real Property Act , or The Registry Act . Religious Societies' Lands Act 4 Subsections 6(2) and 7(2) of The Religious Societies' Lands Act are designated as designated laws for the purpose of Part 2 of the Act. Beneficiary Designation Act (Retirement, Savings and Other Plans) 4.1 Section 2, other than clause (c), and section 2.1 of The Beneficiary Designation Act (Retirement, Savings and Other Plans) are designated as designated laws for the purpose of Part 2 of the Act. M.R. 47/2023 Mortgage Brokers Act 4.2 Sections 30 and 31 of The Mortgage Brokers Act are designated as designated laws for the purpose of Part 2 of the Act. M.R. 47/2023 Laws relating to registration of deaths 4.3 The Vital Statistics Act and The Fatality Inquiries Act, and the regulations under those Acts, are designated as designated laws for the purpose of Part 2 of the Act insofar as they relate to any of the following documents: (a) medical certificate of death; (b) registration of a death. M.R. 59/2026 SIGNATURES Exemption from signature requirement 5 For the purpose of subsection 13(2) of The Electronic Commerce and Information Act , the following documents in electronic form are exempt from the electronic signature requirement of subsection 13(1) of the Act: (a) the following documents filed in electronic form for the purpose of The Business Names Registration Act : (i) registration of a business name, (ii) renewal of the registration of a business name; (b) the following documents filed in electronic form for the purpose of The Cooperatives Act : (i) articles, (ii) notice of change of directors, (iii) notice of change of registered office, (iv) annual return, (v) offering statement; (c) the following documents filed in electronic form for the purpose of The Corporations Act : (i) articles, (ii) notice of change of directors, (iii) notice of change of registered office, (iv) annual return, (v) annual business return for trust and loan companies; (d) the following documents filed in electronic form for the purpose of The Vital Statistics Act , The Fatality Inquiries Act or the regulations under those Acts: (i) medical certificate of death, (ii) registration of a death. M.R. 59/2026 Repeal 6 The Electronic Documents Under Designated Laws Regulation , Manitoba Regulation 152/2011, is repealed.
