Producers who market forage seed must pay a 0.75% fee to the association, and purchasers must deduct and forward those fees, provide specified information, and keep records.

A18 Regulation 108/96 Registered May 31, 1996 bilingual version (HTML) Definitions 1 In this regulation, "association" means Manitoba Forage Seed Association; (« Association ») "forage seed" means perennial grasses, annual ryegrass or legumes grown to produce seed, and includes both pedigreed and common seed production; (« semence fourragère ») "year" means the period beginning March 1 and ending on February 28 of the following year. (« année ») M.R. 136/98; 49/2020 Purpose 2 The purpose of this regulation is to enable the association to collect money from forage seed producers to promote and financially support initiatives in the areas of production, marketing, extension, education and research for the benefit of forage seed producers in Manitoba. M.R. 101/2016 Designation 3 Manitoba Forage Seed Association is designated as the representative organization of all producers of forage seed. Fees 4 Every producer who produces and markets forage seed shall pay a fee to the association of 0.75% of the gross value of the forage seed. M.R. 101/2016 ; 50/2026 Deduction of fees 5(1) Every purchaser who buys forage seed from a producer shall deduct, from the monies payable to the producer, the fees payable by the producer to the association. 5(2) Every purchaser shall forward to the association, (a) on or before February 28, the fees deducted in the preceding seven-month period that begins on July 1 and ends on January 31; and (b) on or before July 31, the fees deducted in the preceding five-month period that begins on February 1 and ends on June 30. 5(3) When fees are forwarded to the association under subsection (2), the purchaser shall also provide the association with the following information: (a) the name, mailing address and e-mail address of each producer from whom the fees were withheld; (b) the amount of the fees being forwarded on that producer's behalf; (c) the quantity of forage seed purchased from that producer; (d) the crop class, whether common, certified or foundation seed. M.R. 49/2020 Use of fees 6 The association is authorized to use the fees for the purpose of defraying the expenses of the organization in carrying out its purpose. Refunds 7(1) A producer may apply to the association for a refund of fees. 7(2) An application for a refund must be made in writing to the association and must contain the information that the association requests. 7(3) An application for a refund must be received by the association (a) before February 28, for fees deducted in the seven-month period beginning on the previous July 1 and ending on January 31; and (b) before July 31, for fees deducted in the five-month period beginning on the previous February 1 and ending on June 30. 7(4) If the application for a refund complies with this section, the association shall make the refund within 60 days after February 28 or July 31, whichever applies. 7(5) [Repealed] M.R. 50/2026 M.R. 101/2016 ; 49/2020 ; 50/2026 Books and records 8 Every purchaser of forage seed grown or harvested in Manitoba shall keep and maintain complete and accurate books and records respecting the purchase of forage seed and provide copies of them when requested to do so by the agency. Information 9 The association shall furnish to the agency such information and financial statements as the agency determines necessary to ensure that the fees paid to the association are properly used for the purpose of the association. Coming into force 10 This regulation comes into force on July 1, 1996.
