(« animal de ferme ») SEASONS OF USE Seasons of use 2(1) Subject to subsections (2), (3) and (4), the seasons of use of the following kinds of farm machinery or farm equipment in any year are: (a) from April 15 to June 30 for machinery or equipment designed for use in connection with spring seeding and tilling; (b) from August 15 to October 31 for machinery or equipment designed for use in connection with fall seeding and tilling; (c) from June 1 to September 15 for machinery or equipment designed for use in connection with silage and haying; (d) from August 1 to October 31 for machinery or equipment designed for use in connection with harvesting any crop or produce, including straw baling; (e) all year for machinery or equipment designed for use in connection with milking and on-farm storage and handling of milk or cream; (f) all year for machinery or equipment designed for use in connection with livestock feed processing; (g) all year for machinery or equipment designed for use in connection with the mechanical feeding of livestock. 2(2) A season of use designated in subsection (1) applies with respect to a particular piece of farm machinery or farm equipment only when that piece of machinery or equipment is in actual use for a purpose designated in relation to the season of use. 2(3) A farm tractor, when used for a purpose designated in any of clauses (1)⁠(a) to (g), has the same season of use as other farm machinery or farm equipment designed for that purpose. 2(4) Despite subsections (1) and (3), where the board is of the opinion that a season of use ought to be extended because of some unusual circumstance, the board may by order extend that season of use for the whole province or for a designated area. 2(5) Where the board makes an order under subsection (4), it (a) shall set out in the order its reasons for making the extension; (b) shall without delay endeavour to inform (i) all dealers and vendors affected by the order, and (ii) any organizations of affected farmers or producers, about the making of the order; and (c) shall make a photocopy of the order available to any person on request. M.R. 10/2023 IDENTIFICATION OF FARM MACHINERY AND FARM EQUIPMENT Prescribed farm machinery and farm equipment 3 The following kinds of farm machinery or farm equipment are required to be identified by model year as provided for in subsection 34(3) of the Act: (a) farm tractors; (b) self-propelled and pull-type combines; (c) self-propelled and pull-type swathers; (d) forage harvesters; (e) balers; (f) grinder mixers; (g) all other self-propelled farm machinery or farm equipment; (h) all other pull-type farm machinery or farm equipment. WARRANTY ON REPAIR PARTS Warranty on repair parts 4 For the purposes of section 27 of the Act, repair parts purchased by a purchaser from a dealer or a vendor shall be warranted as follows: (a) where the farm machinery or farm equipment repaired has a designated season of use, (i) for a period of 90 days from the first day of use after the repair is completed, if the repair is completed during the designated season of use, and (ii) for a period of 90 days from the first day of use in the first season of use after the repair is completed, if the repair is completed outside the designated season of use; (b) where the farm machinery or farm equipment repaired does not have a designated season of use, for a period of 90 days from the first day of use after the repair is completed. 5 to 8 [Repealed] M.R. 10/2023 FORM OF SALE CONTRACT Form of sale contract prescribed 9 The form of sale contract set out in the Schedule is prescribed as the form of sale contract to be used in relation to a sale of new farm machinery or farm equipment to which the Act applies. M.R. 10/2023 10 to 29 [Repealed] M.R. 10/2023 Repeal 30 The Farm Machinery and Equipment Regulation , Manitoba Regulation 205/87 R, the Farm Equipment Date Stamping Regulation , Manitoba Regulation 206/87 R, the Farm Machinery Dealers and Vendors Regulation , Manitoba Regulation 379/87, and the Farm Machinery and Equipment Form of Contract Regulation , Manitoba Regulation 49/88 R, are repealed. Review 31 Not later than five years after this regulation comes into force, the minister shall (a) review the effectiveness of the operation of this regulation after consulting with such persons affected by it as the minister considers appropriate; and (b) if the Minister considers it advisable, recommend to the Lieutenant Governor in Council that the regulation be amended or repealed.
