"Act" means The Regulated Health Professions Act . («  Loi  ») "college" means the College of Registered Nurses of Manitoba. (« Ordre ») "competent" , in relation to the performance of a reserved act, means that a member has the requisite skill, knowledge and judgment to perform that act. (« compétent ») "council" means the council of the college. (« conseil ») "former Act" means The Registered Nurses Act . (« loi antérieure ») "member" means a member of the college. (« membre ») "Schedule" means the schedule to this regulation. (« annexe ») Designation 2 Registered nursing is designated as a regulated health profession for the purposes of the Act. Scope of practice 3 The practice of registered nursing is the application of registered nursing skill, knowledge and judgment (a) to assist individuals, families, groups, communities and populations to achieve, maintain and restore their optimal physical, emotional, mental, spiritual and social health; (b) to assess, diagnose, plan and provide treatment and interventions and evaluate their effectiveness and to make referrals; (c) to teach, counsel and advocate on behalf of their clients in order to enhance health and well-being; (d) to coordinate, supervise, monitor, deliver and evaluate the provision of health care; (e) to manage, administer and develop systems related to registered nursing and the provision of other health care; (f) to teach registered nursing theory and practice; and (g) to engage in research related to health or the practice of registered nursing. College 4 The College of Registered Nurses of Manitoba continued under the former Act is continued under clause 8(b) of the Act as the College of Registered Nurses of Manitoba for the regulated health profession of registered nursing. Practice of registered nursing 5 Subject to the Act and the regulations and any conditions on his or her certificate of registration or practice, a member may engage in the practice of registered nursing. But in doing so, the member may not act beyond the scope of practice of registered nursing. Reserved acts 6(1) In the course of engaging in the practice of registered nursing, a member is authorized, subject to the regulations made by the council and any conditions on his or her certificate of registration or practice, to perform the applicable reserved acts set out in the Schedule. 6(2) Despite subsection (1), a member may only perform a reserved act that he or she is competent to perform and that is safe and appropriate for the procedure being performed. Transition 7(1) On the day this regulation comes into force, the board of the college established under the former Act is deemed to be the council established under section 13 of The Regulated Health Professions Act. 7(2) On the day this regulation comes into force, a member of the board of the college established under the former Act is deemed to be a member of the council that is deemed to be established under section 13 of The Regulated Health Professions Act. 7(3) On the day this regulation comes into force, an officer of the college established under the former Act is deemed to be an officer of the college until his or her term of office expires or appointment is revoked. 7(4) On the day this regulation comes into force, the executive director appointed by the board under the former Act is deemed to be appointed the registrar under section 23 of The Regulated Health Professions Act . 7(5) On the day this regulation comes into force, the investigation committee established under the former Act is deemed to be the complaints investigation committee under The Regulated Health Professions Act . 7(6) On the day this regulation comes into force, the discipline committee established under the former Act is deemed to be the inquiry committee under The Regulated Health Professions Act . 7(7) On the day this regulation comes into force, each member of a committee appointed under the former Act is deemed to be appointed a member of the successor committee under The Regulated Health Professions Act for a term that is equal to the unexpired portion of the member's term under the former Act. 7(8) The college's by-laws and code of ethics made under the former Act that are in force on the coming into force of this regulation are deemed to be the college's by-laws and code of ethics made under The Regulated Health Professions Act until they are amended or repealed under The Regulated Health Professions Act . 7(9) An application for registration made under the former Act but not concluded before the coming into force of this regulation must be dealt with under the former Act. 7(10) An individual whose name is on a register under the former Act on the day before the coming into force of this regulation is deemed to be registered in the appropriate membership class under The Regulated Health Professions Act . 7(11) An individual who is registered as a fully registered practising member or graduate member under the former Act is deemed to hold a certificate of practice issued under The Regulated Health Professions Act , subject to any restrictions or conditions imposed or attached to the individual's registration under the former Act, until the first renewal date after the coming into force of this regulation. 7(12) If, on the day this regulation comes into force, the investigation committee under the former Act has directed that an investigation into the conduct of a member or former member be held, the matter must be concluded under the former Act as though The Regulated Health Professions Act had not come into force. 7(13) A matter about which the investigation committee has not directed, before the coming into force of this regulation, an investigation be held must be dealt with under The Regulated Health Professions Act . 7(14) A matter that was referred to the discipline committee before the coming into force of this regulation must be concluded under the former Act as though The Regulated Health Professions Act had not come into force. 7(15) An appeal that was commenced under the former Act but not concluded before the coming into force of this regulation must be concluded under the former Act as if The Regulated Health Professions Act had not come into force. 7(16) [Repealed] M.R. 93/2020 7(17) An individual who is a registered nurse under The Regulated Health Professions Act and holds a valid certificate of practice under that Act may prescribe a drug or vaccine relating to travel health, reproductive health, sexually transmitted infections and blood borne pathogens, or diabetes health without obtaining the notation "(authorized prescriber)" on their certificate of practice (a) only if the individual was authorized to prescribe those drugs and vaccines under subsection (16) as it read on the day before it was repealed; and (b) only until the earlier of (i) May 31, 2024, and (ii) the date the individual becomes a registered nurse (authorized prescriber) under that Act. M.R. 93/2020 ; 63/2022 ; 45/2023 Coming into force 8 This regulation comes into force on the same day that subsection 251(2) of The Regulated Health Professions Act , S.M. 2009, c. 15, comes into force. SCHEDULE (Section 6) Reserved Act Description 1 Making a diagnosis and communicating it to an individual or his or her personal representative in circumstances in which it is reasonably foreseeable that the individual or representative will rely on the diagnosis to make a decision about the individual's health care. 2 Ordering or receiving reports of screening or diagnostic tests. 3 Performing a procedure on tissue (a) below the dermis; (b) below the surface of a mucous membrane; (c) on the surface of the cornea; 4 Inserting or removing an instrument or a device, hand or finger (a) into the external ear canal; (b) beyond the point in the nasal passages where they normally narrow; (c) beyond the pharynx; (d) beyond the opening of the urethra; (e) beyond the labia majora; (f) beyond the anal verge; or (g) into an artificial opening in the body. 5 Administering a substance (a) by injection; (b) by inhalation; (c) by mechanical ventilation; (d) by irrigation; (e) by enteral instillation or parenteral instillation; (f) by transfusion; or (g) using a hyperbaric chamber. 6 Prescribing a drug or vaccine. 9 Administering a drug or vaccine by any method. 10 Applying or ordering the application of (a) ultrasound for diagnostic or imaging purposes, including any application of an ultrasound to a fetus; (b) electricity for ... (ii) cardiac pacemaker therapy, (iii) cardioversion, (iv) defibrillation, (v) electrocoagulation, (vi) electroconvulsive shock therapy, (vii) electromyography, ... (ix) nerve conduction studies, or (x) transcutaneous cardiac pacing; (c) electromagnetism for magnetic resonance imaging (d) other non-ionizing radiation for the purpose of destroying tissue or medical imagery; (e) X-rays or other ionizing radiation for diagnostic, imaging or therapeutic purposes, including computerized axial tomography but not positron emission tomography or radiation therapy; 11 In relation to a therapeutic diet that is administered by enteral instillation or parenteral instillation, (a) selecting ingredients for the diet; or (b) compounding or administering the diet. 12 Setting or casting a fracture of a bone or a dislocation of a joint. 13(a) Putting into the external ear canal, up to the eardrum, a substance that is under pressure. 14 Managing labour or delivery of a baby. 20 Performing a psycho-social intervention with an expectation of modifying a substantial disorder of thought, mood, perception, orientation or memory that grossly impairs judgment, behaviour, the capacity to recognize reality, or the ability to meet the ordinary demands of life. 21 In relation to allergies, (a) performing challenge testing by any method; or (b) performing desensitizing treatment by any method.
