This regulation sets rules for bicyclists, certain vehicle exemptions, recreational vehicle sales standards, insurance limits, and some parking and sidewalk exceptions.

"Act" means The Highway Traffic Act . («  Code  ») "one-way highway" means a highway on which the roadway is designated for one-way traffic under section 84 of the Act. (« route à sens unique ») M.R. 90/2015 ; 22/2019 ; 131/2024 PART 1 PROVISIONS RELATING TO OPERATING BICYCLES AND POWER-ASSISTED BICYCLES ON HIGHWAYS Operating next to curb or elsewhere 2(1) The following rules apply when a bicycle or power-assisted bicycle is driven on a highway: 1. The driver of a bicycle or power-assisted bicycle travelling on the roadway of the highway must, except as provided in rules 3 to 5 of this subsection, drive it as closely as practicable to the right-hand curb or edge of the roadway if (a) the highway is not a one-way highway and the roadway has a curb or there is no shoulder adjacent to the roadway; or (b) the highway is a one-way highway with fewer than three traffic lanes and the roadway has a curb or there is no shoulder adjacent to the roadway. 2. If the highway is a one-way highway with at least three traffic lanes and the roadway has a curb or there is no shoulder adjacent to the roadway, the driver of a bicycle or power-assisted bicycle travelling on the roadway of the highway must, except as provided in rules 3 to 6 of this subsection, drive it as closely as practicable to the right- or left-hand curb or edge of the roadway. 3. If the roadway of the highway includes a traffic lane that is set aside for the use of bicycles, the driver of a bicycle may drive it in that traffic lane. 4. If the roadway of the highway includes a traffic lane that is set aside for the use of both bicycles and power-assisted bicycles, the driver of a bicycle or power-assisted bicycle may drive it in that traffic lane. 5. If there is a shoulder adjacent to the roadway of the highway, the driver of a bicycle or power-assisted bicycle may drive it on the shoulder. 6. Despite rules 1 and 2, the driver of a bicycle or power-assisted bicycle may drive it in a manner that does not comply with those rules if the non-compliant driving is done in a safe manner and for as short a distance as is practicable and is necessary (a) to change lanes to make a right or left turn at an upcoming intersection or place on the highway where the turn is permitted; (b) to pass a parked or stopped vehicle, or another obstacle on the roadway, that is in the path of the bicycle or power-assisted bicycle; or (c) to pass a bicycle or power-assisted bicycle, whether in motion or not. 2(2) For the purpose of subsection (1), a driver is deemed to be driving as closely as practicable to the curb or edge of a roadway if (a) the distance of the bicycle or power-assisted bicycle from the curb or edge of the roadway is practicable having regard to the condition of the roadway and the presence of objects near the curb or edge that may be a danger to the driver; or (b) where vehicles are parked or stopped in the traffic lane nearest the curb or edge of the roadway ahead of the bicycle or power-assisted bicycle, the driver drives at the closest practicable distance that allows the driver to pass the traffic side of the parked or stopped vehicles (i) without weaving in and out of traffic, and (ii) with enough clearance that the driver is not at risk of colliding with an opened vehicle door. Additional circumstances when crossing solid line is permitted 3 The driver of a bicycle or power-assisted bicycle is exempt from the application of clause 110(b) of the Act if the bicycle or power-assisted bicycle crosses a solid line denoting a boundary of a traffic lane that is set aside for the use of bicycles or power-assisted bicycles, or both, in the course of entering or leaving the traffic lane. PART 2 PROVISIONS RELATING TO OPERATING VEHICLES ON HIGHWAYS Additional circumstances when crossing solid line is permitted 4 The driver of a vehicle is exempt from the application of clause 110(b) of the Act if the vehicle crosses a solid line denoting a boundary of a traffic lane that is set aside for the use of bicycles or power-assisted bicycles, or both, in the course of entering or leaving a parking spot located between that traffic lane and the curb or edge of the roadway closest to it. Additional exemption for transporting cannabis in vehicles 4.0.1 Subsection 213.1(1) of the Act does not apply if the vehicle in or on which cannabis is transported is a trailer. M.R. 149/2017 Minimum insurance policy limit for agricultural and infrastructure equipment 4.0.2 The following minimum required insurance limits are prescribed for the purpose of clause 226(1.2)⁠(c) of the Act: (a) $1,000,000 for agricultural equipment; (b) $1,000,000 for infrastructure equipment. M.R. 22/2019 PART 2.1 4.1 [Repealed] M.R. 90/2015 ; 188/2015 ; 52/2018 ; 22/2019 ; 131/2024 4.2 [Repealed] M.R. 90/2015 ; 22/2019 ; 131/2024 4.3 [Repealed] M.R. 90/2015 PART 2.2 STANDARDS FOR RECREATIONAL VEHICLES Standards for recreational vehicles 4.4(1) A recreational vehicle dealer or a manufacturer of recreational vehicles must not offer or expose for sale or lease a new recreational vehicle unless it (a) complies with one of the following standards or the version of one of the following standards that was current at the time it was manufactured: (i) CSA Z240 RV Series–14, Recreational vehicles , (ii) NFPA 1192, Standard on Recreational Vehicles , 2021 Edition, (iii) CAN/CSA-Z241 Series–18, Park model trailers ; and (b) bears an approval mark. 4.4(2) Subsection (1) does not apply in respect of a new recreational vehicle to be exported for use or sale outside of Canada. 4.4(3) The following definitions apply in this section. "approval mark" means any of the following: (a) a certification mark of the Canadian Standards Association; (b) a third-party approval mark of a certification body accredited by the Standards Council of Canada; (c) a third-party approval mark of the Recreational Vehicle Industry Association. (« marque d'approbation ») "lease" means a lease or other agreement that gives a person exclusive use of a recreational vehicle for a period of more than 30 days. (« louer ») "new recreational vehicle" means a recreational vehicle that has not been owned by anyone other than its manufacturer or a recreational vehicle dealer. (« véhicule récréatif neuf ») "recreational vehicle" means (a) a motor vehicle primarily designed as living quarters for recreational, camping or seasonal use; (b) a vehicle primarily designed as living quarters for recreational, camping or seasonal use that is capable of being towed by a motor vehicle; or (c) a unit primarily designed as living quarters for recreational, camping or seasonal use that is mounted on or designed to be mounted on a vehicle; and, without limitation, includes a motor home, a fifth wheel travel trailer, a folding camping trailer, a travel trailer, a park model trailer and a truck camper. (« véhicule récréatif ») "recreational vehicle dealer" means a person who carries on the business as principal or agent, or who holds themselves out as carrying on the business as principal or agent of (a) buying recreational vehicles; (b) selling recreational vehicles, whether or not in combination with leasing them; or (c) buying and selling recreational vehicles, whether or not in combination with leasing them. (« commerçant de véhicules récréatifs ») M.R. 65/2023 PART 3 GENERAL PROVISIONS Determining the seating capacity or designed carrying capacity of certain motor vehicles 5(1) In determining — for any purpose of the Act or a regulation — the seating capacity, or the designed capacity for carrying persons, of a motor vehicle other than one mentioned in subsection (2), (a) a position in the motor vehicle for carrying a passenger seated in a mobility aid (motorized or otherwise) is deemed to be the equivalent of four conventional seating positions or the capacity to carry four persons seated conventionally; and (b) the motor vehicle is deemed to have been designed for carrying four persons for every position in the motor vehicle for carrying a passenger seated in a mobility aid (motorized or otherwise). 5(2) Subsection (1) does not apply to a motor vehicle designed for carrying 10 persons or fewer in conventional seating positions, including the motor vehicle's driver. M.R. 90/2015 ; 140/2015 Notice of parking restrictions 5.1 For the purposes of subsection 90(5) of the Act, a traffic authority need not indicate a parking restriction on a highway by traffic control devices if (a) the restriction is a temporary restriction declared by the traffic authority for the purpose of enabling snow to be cleared from the highway; and (b) the restriction is indicated to the public at least 24 hours before coming into effect by (i) issuing and distributing a media release, and (ii) providing notification in accordance with any additional requirements set out in a rule or by-law of the traffic authority. M.R. 22/2019 6 [Repealed] M.R. 90/2015 ; 140/2015 ; 22/2019 ; 131/2024 6.1 [Repealed] M.R. 140/2015 ; 22/2019 ; 131/2025 6.2 [Repealed] M.R. 140/2015 ; 22/2019 ; 131/2024 Certain vehicles may be driven on sidewalk 6.3(1) Subject to subsection (2), infrastructure equipment that is driven by an employee of a traffic authority or by another person on behalf of a traffic authority is exempt from the application of subsection 193(1) of the Act when it is driven (a) on a sidewalk over which the traffic authority has jurisdiction; and (b) for the purpose of sweeping, grading, scraping, ploughing or clearing snow from or otherwise maintaining the sidewalk infrastructure. 6.3(2) The exemption set out in subsection (3) applies only if (a) the driver holds a valid driver's licence of a class that authorizes him or her to drive a class 5 motor vehicle without a full-time supervising driver and carries the driver's licence while driving; and (b) the infrastructure equipment is insured as required under subsection 226(1.2) of the Act. 6.3(3) Subject to subsection (4), an off-road vehicle that is driven by an employee of a traffic authority or by another person on behalf of a traffic authority is exempt from the application of subsection 193(1) of the Act when it is driven (a) on a sidewalk over which the traffic authority has jurisdiction; and (b) for the purpose of carrying out activities to enhance or maintain the sidewalk and adjacent area, such as any of the following: (i) planting and maintaining trees and ornamental plants, (ii) installing, and maintaining refuse and recycling bins and collecting refuse and recyclables, (iii) removing graffiti, (iv) insect control, (v) cleaning, sweeping and snow and ice removal, (vi) installing and maintaining signs, (vii) installing and maintaining infrastructure located on the sidewalk, such as bus shelters and bicycle racks. 6.3(4) The exemption set out in subsection (1) applies only if (a) the driver holds a valid driver's licence of a class that authorizes him or her to drive a class 5 motor vehicle without a full-time supervising driver and carries the driver's licence while driving; and (b) the off-road vehicle is registered as an off-road vehicle under The Drivers and Vehicles Act and has the liability insurance required by subsection 77(1) of that Act. 6.3(5) In this section, "off-road vehicle" does not include a snowmobile, mini-bike, dirt-bike, trail-bike or off-road maintenance machine within the meaning of the definition "off-road vehicle" in subsection 1(1) of The Off-Road Vehicles Act . M.R. 140/2015 ; 22/2019 Exemptions respecting validation stickers 6.4(1) Owners and drivers of motor vehicles or trailers after this subsection comes into force are exempt from the application of subclause 4.2(1)⁠(a)⁠(iii) of the Act as it relates to displaying validation stickers. 6.4(2) All persons after this subsection comes into force are exempt from the application of (a) clause 171(2)⁠(b) of the Act; and (b) clauses 171(2)⁠(c) and (f) of the Act as they relate to validation stickers.
