(«  Loi  ») "angling" means fishing by means of a line and hook, or a rod line and hook; (« pêche à la ligne ») "angling licence" means a licence that authorizes the licensee to engage in recreational fishing; (« permis de pêche à la ligne ») "bait fish" means ciscoes, darters, minnows (except common carp, goldfish and carmine shiners), mudminnows, sculpins, sticklebacks, trout-perches and suckers, other than bigmouth buffalo; (« poisson-appât ») "bow fishing" means fishing by means of archery equipment; (« pêche à l'arc ») "cast netting" means fishing with the use of a cast net; (« pêche à l'épervier ») "commercial bait fish fishing" means bait fish fishing for the purpose of sale or barter or for any other commercial purpose; (« pêche commerciale de poissons-appâts ») "commercial bait fish fishing licence" means a fishing licence that authorizes the holder to harvest and sell bait fish; (« permis de pêche commerciale de poissons-appâts ») "commercial fisher licence" means a licence that authorizes the holder to engage in commercial fishing and which requires the holder to personally participate in the commercial fishing operation; (« permis de pêcheur commercial ») "commercial fishing" means fishing for the purpose of sale or barter or for any other commercial purpose; (« pêche commerciale ») "commercial fishing licence" means a licence that authorizes the licensee to engage in commercial fishing; (« permis de pêche commerciale ») "commercial leech harvesting" means leech harvesting for the purpose of sale or barter or for any other commercial purpose; (« récolte de sangsues ») "commercial leech harvesting licence" means a licence that authorizes the holder to harvest and sell leeches; (« permis de récolte commerciale de sangsues ») "commercial live bait dealer licence" means a licence that authorizes the licensee to buy live bait fish from a commercial bait fish fishing licensee and leeches from a commercial leech harvesting licensee for the purpose of resale; (« permis de vendeur de poissons-appâts vivants ») "commercial operator's licence" means a licence that authorizes the licensee to engage in commercial fishing and to employ hired persons; (« permis d'exploitation commerciale ») "competitive fishing event" means any recreational fishing competition in which 25 or more people participate; (« tournoi de pêche ») "competitive fishing event licence" means a licence that authorizes the licensee to hold a competitive fishing event; (« permis de tournoi de pêche ») "dip netting" means fishing by means of a dip net; (« pêche à l'épuisette ») "experimental licence" means a licence issued for commercial fishing on an experimental basis; (« permis d'expérimentation ») "fish farming licence" means a licence that authorizes the licensee to stock, harvest and transport fish for commercial sale; (« permis d'aquiculture ») "general fishing permit" means a permit issued under section 5.2 that authorizes the holder to fish for the purposes set out in their permit; (« permis général de pêche ») "Indian" has the same meaning as in the Indian Act (Canada); (« Indien ») "live fish handling permit" means a licence that authorizes the licensee to collect, transport, and possess fish or fish eggs for purposes set out in that licence; (« permis de manipulation de poissons vivants ») "Manitoba resident" means a person whose primary residence is in Manitoba and who has lived in Manitoba for at least six consecutive months during the 12-month period immediately before the person applies for a licence or permit under the Act; (« résident du Manitoba ») "minnow trapping" means fishing by means of a minnow trap; (« piégeage ») "recreational fishing" includes (a) angling, bow fishing or spear fishing, or (b) dip netting, cast netting, seine netting or minnow trapping; (« pêche récréative ») "retirement licence" means a licence with a limited quota for fishing on Lake Winnipeg issued to a person who was formerly a commercial fishing licensee on Lake Winnipeg, and who at the time of receipt of the licence is 55 years of age or older; (« permis de retraité ») "seine netting" means fishing by means of a seine net; (« pêche à la seine ») "spear fishing" means fishing by means of a hand-held spear or spear gun while swimming; and (« pêche au harpon ») "special angling licence" means a licence that authorizes a person who is not a Manitoba resident to engage in recreational fishing in specified waters; (« permis spécial de pêche à la ligne ») "special group angling licence" means a licence issued under section 5.1 that authorizes a group of persons identified or described in that licence to engage in recreational fishing without holding individual angling licences. (« permis spécial de groupe pour la pêche à la ligne ») M.R. 38/2001 ; 68/2004 ; 9/2023 GENERAL Application 2 This regulation applies to fish and fishing in all Manitoba waters. General licence requirement 3(1) Subject to subsection 4(2), no person shall engage in fishing, fish farming, or hold a competitive fishing event without a licence issued under this regulation unless the person holds a licence or permit that authorizes the person to engage in that activity. 3(1.1) Licences and permits may be issued to a person using the Internet. 3(1.2) Subject to subsection (1.2.1), a licence or permit is not valid until it has been signed by the holder. 3(1.2.1) An angling licence does not need to be signed by the holder. 3(1.3) Subject to subsection (1.4), if a licence or permit is issued to a person over the Internet, the person must print the licence or permit and carry it with them at all times while carrying out any activity that is authorized by the licence or permit. 3(1.4) If an angling licence is issued to a person over the Internet, the person must either (a) print the licence and carry it with them at all times while angling; or (b) carry an electronic device that contains an accessible version of the angling licence with them at all times while angling. 3(1.5) If a person is carrying an electronic device that contains their angling licence, the person must access the licence on their device and show it to an officer upon being requested to do so and permit the officer to view it for such period of time as the officer may require. 3(1.6) If a person is carrying an electronic device that contains their angling licence and is unable to access it and show it to an officer for any reason, that person is deemed to be fishing without a licence. For greater certainty, it is not a defence if the device was out of power, damaged or experienced any technical difficulties that prevented the licence from being displayed on the device when requested. 3(2) A licence issued under this regulation is valid for the period shown on the licence. M.R. 95/2020 ; 122/2020 ; 9/2023 RECREATIONAL FISHING Licence requirement 4(1) Subject to subsection (2) and section 5.1, no person may engage in recreational fishing without a valid angling licence. Exemptions 4(2) A person may engage in recreational fishing without a valid angling licence if the person is (a) a Manitoba resident under 16 years of age and is able to produce proof of age to an officer immediately upon request; (a.1) a Manitoba resident who is 65 years of age or older and is able to provide proof of age and residence to an officer immediately upon request from an officer; (a.2) a Manitoba resident who is an active or retired member of the Canadian Forces who, immediately upon request from an officer, is able to produce proof of residence and one of the following: (i) Canadian Forces Identification Card, (ii) Record of Service Card, (iii) Canadian Armed Forces Veterans' Service Card; (b) not a Manitoba resident but is under 16 years of age and is (i) able to produce proof of age to an officer immediately upon request, and (ii) accompanied by a person who holds a valid angling license or is authorized to fish without a licence by reason of any of the exemptions in this subsection; (c) an Indian and is able to produce proof of Indian status to an officer immediately upon request; (d) authorized to fish under the Fish and Wildlife Conservation Act, 1997 (Ontario) and is fishing in one of the lakes in the following Table: TABLE Item Waters 1 Artery Lake 2 Davidson Lake (Latitude 50°27'N, Longitude 95°05'W.) 3 Frances Lake (Latitude 51°44'N, Longitude 95°09'W.) 4 Garner Lake 5 High Lake 6 Mantario Lake 7 Moar Lake 8 Ryerson Lake Catch count for child non-residents 4(3) All fish caught and retained by a person referred to in clause 4(2)⁠(b) shall be counted as part of the catch of the person referred to in subclause 4(2)⁠(b)⁠(ii). M.R. 68/2004 ; 9/2023 Special angling licence requirements 5(1) In order for a person who is not a Manitoba resident to engage in recreational fishing in waters listed in the Table in subsection (3), they must be authorized to fish under section 4 and hold a special angling licence issued for those waters. Special angling licence issuer 5(2) The minister may authorize the holder of a valid and subsisting lodge or outfitter licence issued under The Resource Tourism Operators Act to issue a special angling licence authorizing recreational fishing in one or more of the bodies of water in the Table in subsection (3). M.R. 9/2023 General fishing permit 5.2 The minister may issue a general fishing permit that authorizes the holder to fish for the purposes set out in the permit in the waters specified in the permit during the period set out in the permit. M.R. 9/2023 COMMERCIAL FISHING Licence requirement 6 No person shall engage in commercial fishing except under the authority of a commercial fishing licence. M.R. 9/2023 Transfer of licence privileges 7 Where the holder of a commercial fisher licence or commercial operator's licence is, due to uncontrollable circumstances, unable to engage in fishing authorized by the licence, an officer may, on request of the licensee transfer the licence privileges to another person. M.R. 9/2023 Winter fishing restriction 8 No person shall engage in fishing under the authority of a commercial fishing licence during the period beginning on November 1 and ending on April 30 except through holes in the ice. M.R. 9/2023 Commercial bait fish fishing, leech harvesting, live bait dealer licence requirement 9 No person shall engage in (a) commercial bait fish fishing without a commercial bait fish fishing licence; (b) commercial leech harvesting without a commercial leech harvesting licence; (c) the sale of, or possess, leeches for sale or barter, or for any other commercial purpose without a commercial live bait dealer licence or a commercial leech harvesting licence; or (d) the sale of, or possess, live bait fish for sale or barter, or for any other commercial purpose without a commercial live bait dealer licence or a commercial bait fish fishing licence. M.R. 9/2023 Receipt to dealer 10(1) A commercial bait fish fishing licensee or commercial leech harvesting licensee shall, at the time of sale of live bait fish or leeches, issue a receipt to the commercial live bait dealer licensee. Conditions of dealer receipt 10(2) A commercial live bait dealer licensee shall retain the receipt issued under subsection (1) for the period in which the bait fish or leeches are in their possession. Issuance of retail receipt 10(3) A commercial live bait dealer licensee or a commercial bait fish fishing licensee shall, at the time of sale of live bait fish, issue to each purchaser a receipt in a form provided by the minister. Conditions of retail receipt 10(4) A purchaser who receives a receipt in accordance with subsection (3) shall (a) maintain possession of the receipt during the time the person possesses the live bait fish; and (b) comply with all terms and conditions on the receipt. M.R. 9/2023 Restrictions on possession and transportation of live fish or fish eggs 11(1) Subject to subsection (2), no person shall possess or transport live fish or fish eggs without (a) a live fish handling permit for a species listed in Schedule A; or (b) a fish farming licence. Exceptions 11(2) A person may possess or transport live fish without the restrictions listed in subsection (1) where they were (a) obtained under the authority of a commercial bait fish fishing licence or a commercial live bait dealer licence; or (b) purchased, and the purchaser holds a receipt issued under subsection 10(3). M.R. 9/2023 Exception for anglers 12 An angling licensee or a person described in subsection 4(2) may, subject to the Fisheries Act (Canada) and this regulation possess live fish where that person has caught the live fish in the water in which the person is fishing and the caught fish are within 25 metres of the person. Fish farming 13 No person shall stock, harvest or transport fish for sale or barter for a commercial purpose without a valid fish farming licence. GEAR IDENTIFICATION Gill net identification for non-commercial fishing 14(1) No person engaged in fishing shall use a gill net or a string of gill nets unless it is legibly marked at each end with the owners's name and treaty or permit number, and the number is clearly visible without raising the net from the water or the ice. Gill net identification for commercial fishing 14(2) No person engaged in commercial fishing shall use a gill net or string of gill nets unless (a) it is legibly marked at each end with (i) the person's licence number, or (ii) the fisher's number; (b) the number is clearly visible without raising the net from the water or the ice; and (c) a flag of not less than 20 cm by 20 cm is attached to each end of the net or string of nets at a height not less than one metre above the water or the ice. M.R. 9/2023 Identification of gear 15 No holder of a commercial bait fish fishing licence or commercial leech harvesting licence shall use any fishing or harvesting gear that is not legibly marked with that person's registration number or licence number. M.R. 9/2023 GENERAL Licence suspension or cancellation 16 The minister may suspend or cancel a licence where (a) the holder has been convicted of an offence under the Act, any regulation under the Act, the Fisheries Act (Canada) or any regulation under that Act; or (b) the minister determines that the holder has breached a term or condition of a licence. Restricted or prohibited fishing areas 16.1(1) The minister may restrict or prohibit any activity related to fishing by posting signs that (a) mark the restricted or prohibited area; and (b) state the restrictions or prohibitions. Restriction on fishing 16.1(2) No person shall engage in any restricted or prohibited activity related to fishing in an area marked under subsection (1). M.R. 209/97; 9/2023 Interpretation 17 A reference in a licence or other instrument to a species or group of species of fish by its common name as set out in Column 1 of an item of Schedule B shall be construed as a reference to the species or group of species of fish, the scientific name of which is set out in Column 2 of that item. Coming into force 18 This regulation comes into force on the day The Fisheries Amendment Act , S.M. 1996, c. 46, comes into force.
