"accredited laboratory" means a laboratory that is accredited under the Canadian Food Inspection Agency Laboratory Accreditation Program or a laboratory that the director considers the equivalent of a laboratory accredited under that program. (« laboratoire accrédité ») "Act" means The Plant Pests and Diseases Act . («  Loi  ») "bacterial ring rot" means the plant disease caused by Clavibacter michiganensis subsp. sepedonicus , also known as Corynebacterium sepedonicum . (« flétrissement bactérien ») "class" , in relation to potatoes, means a class of seed potatoes established in section 47 of the Seeds Regulations , C.R.C., c. 1400, made under the Seeds Act (Canada). (« classe ») "director" means the person appointed under The Public Service Act as the director for the purposes of this Act. (« directeur ») "non-certified potatoes" means non-certified potatoes as defined in the Seeds Regulations , C.R.C., c. 1400, made under the Seeds Act (Canada). (« pommes de terre non certifiées ») M.R. 115/2025 Designation of disease 2 Bacterial ring rot is designated as a disease for the purposes of the Act. Use of non-certified seed potatoes prohibited 3 Except with the director's written permission, no person shall (a) plant non-certified potatoes; or (b) produce or attempt to produce potatoes using non-certified potatoes as seed. Commercial crop records to be kept 4(1) A person who plants, grows or harvests potatoes for commercial use must make a written record of all potato plantings including the planting date and location, and the weight, class and certification number of potatoes planted. The person must keep the record for at least one year after the latest recorded planting date. 4(2) A person who sells potatoes for commercial use must (a) ensure that there is a written record of each sale showing the date of sale, amount of potatoes sold and identity of the buyer in a form acceptable to the director; and (b) retain a copy of the record for at least one year after the sale. 4(3) Without limiting the generality of clause (2)⁠(a), a scale ticket showing the information required by that clause is a sufficient record of a sale. Suspected bacterial ring rot must be reported 5(1) A person who discovers or suspects the presence of bacterial ring rot in potatoes in the field, in transit, in storage, at a processing plant or at a packing house must promptly notify an inspector about the discovery or suspicion. 5(2) A person mentioned in subsection (1) who owns or has control of the potatoes must submit specimens of the diseased or suspicious tubers and plants to the Crop Diagnostic Centre of the Manitoba Department of Agriculture or to an inspector. 5(3) The Crop Diagnostic Centre may analyze the specimens and report the results of the analysis to the director. The Crop Diagnostic Centre may also submit the specimens to an accredited laboratory to be analyzed, and may receive and report the results of the analysis to the director. M.R. 115/2025 Orders prohibiting or restricting movement 6(1) To prevent or control the spread of bacterial ring rot, an inspector may issue an order prohibiting or restricting the movement (a) of potatoes the inspector suspects are infected with bacterial ring rot; or (b) of any bin, storage device, equipment, implement or machinery that has been, or is suspected to have been, in contact with the potatoes; until an accredited laboratory has analyzed specimens of the potatoes for the presence of the disease. 6(2) The inspector must give the order to the person who owns or has control of the suspected potatoes. A person who is given an order issued under subsection (1) must comply with it without delay. Requirements for disinfection 7(1) Without limiting the generality of clause 3(a) of the Act, if an accredited laboratory determines that a lot of potatoes is infected by bacterial ring rot, an inspector may order any bin, storage device, storage place, equipment, implement or machinery that has been, or is suspected to have been, in contact with the diseased potatoes to be disinfected in accordance with the inspector's instructions. 7(2) The inspector must give the order to the person who owns, or a person who has control of, the bin, storage device, storage place, equipment, implement or machinery. A person who is given an order under subsection (1) must comply with it without delay. Use or movement of infected things restricted 8 Except as permitted by an order under subsection 6(1) or 7(1), no person shall use or move from any place (a) a crate, bag or other container used to contain diseased potatoes; or (b) an implement, equipment or machinery used to plant, grow, harvest, handle or process diseased potatoes; unless it is disinfected in a manner that is acceptable to an inspector. Inspector may inspect re compliance with order 9 At any reasonable time after issuing an order under section 6 or 7, an inspector may inspect any place or thing affected by the order to determine whether the order has been complied with. Costs of complying with Act, regulation or order 10 Neither the Government of Manitoba nor any employee of the government is responsible for or liable to any person for the person's costs of complying with any provision of the Act or this regulation or an order issued under the Act or this regulation. Disclosing information about bacterial ring rot 11(1) For the purpose of bacterial ring rot management or prevention, or the protection of potato health, the minister and any person acting under the minister's direction may share or disclose any information that is reported or that they discover about bacterial ring rot. The information shared or disclosed may include personal information, as defined in The Freedom of Information and Protection of Privacy Act , about persons who report occurrences or suspected occurrences of bacterial ring rot or whose potatoes are infected or are suspected of being infected by the disease. 11(2) Information described in subsection (1) may be shared with or disclosed to (a) the Government of Canada or a municipal, provincial or foreign government, or an agency of such a government or of the Government of Manitoba, or a person or body, whose duties and interests include protecting the health of the potato industry; (b) a marketing board or agency; (c) provincial potato growers' associations; (d) potato processing, packing or handling companies; (e) persons who may be exposed to (i) potatoes infected by bacterial ring rot, or (ii) things that have come in contact with diseased potatoes; and (f) any other person, if the minister considers it to be in the interest of the potato industry. Land must not be planted for two years after infection 12 For two full growing seasons after bacterial ring rot is found to be present in potatoes, no person shall plant, grow or harvest potatoes on the land where the potatoes were grown. During that time, the owner or person in control of the land must destroy any volunteer potato plants on the land.
