This regulation says an agreement must set out how participating ministers and the panel handle joint environmental assessment steps, public hearings, reports, and registry filings.

E125 Regulation 126/91 Registered June 7, 1991 bilingual version (HTML) Definitions 1 In this regulation, "Act" means The Environment Act ; (« Loi ») "agreement" means an agreement under section 13.1 of the Act; (« accord ») "panel" means a panel appointed under an agreement; (« comité ») "participating minister" means the minister and the minister responsible for environmental assessment in another jurisdiction that is a party to an agreement. (« ministre participant ») Additional provisions of an agreement 2 In addition to the requirements set out in subsection 13.1(2) of the Act, an agreement shall provide (a) that each participating minister shall issue or approve the terms of reference for the panel and, if the agreement establishes a joint assessment process under clause 13.1(1)⁠(a) of the Act, that each participating minister appoint or approve the appointment of the chairperson or co-chairpersons of the panel; (b) that at any time during the assessment process, the panel may request from the participating ministers a clarification or review of the terms of reference if the panel is of the opinion that clarification or a review is advisable; (c) that the panel may retain the services of legal counsel and experts to advise it; (d) that the panel shall (i) adopt procedures for public hearings and file a copy of those procedures in the public registry, (ii) [repealed] M.R. 207/2011 , (iii) review the environmental assessment report prepared by the proponent and forward the report and the panel's review to the public registry, (iv) conduct public meetings in Manitoba if the panel considers it necessary to do so, (v) conduct public hearings in other jurisdictions that may be affected by the proposed development if the panel considers it necessary to do so, and (vi) prepare a report with recommendations and forward it to the participating ministers; and (e) that the minister shall file the report of the panel in the public registry before a decision is made to issue or refuse to issue a licence under the Act.
