"Act" means The Wildlife Act . («  Loi  ») "department" means the department of government over which the minister presides and through which the Act is administered. (« ministère ») "director" means the Director of the Wildlife and Ecosystem Protection Branch. (« directeur ») "hunter education certificate" means (a) a hunter education certificate issued under section 4; or (b) a Manitoba Hunter and Firearm Safety Training Certificate issued under authority of the General Hunting Regulation , Manitoba Regulation 351/87. (« certificat de formation des chasseurs ») M.R. 7/2012 Hunter education program 2(1) The department is to administer a hunter education program that will provide instruction on (a) hunter ethics and responsibilities; (b) hunting laws and regulations; (c) firearm safety; and (d) any other topic that the director considers advisable to promote safe and lawful hunting in Manitoba. 2(2) The director may, by written authorization, designate an organization or agency to conduct hunter education courses on behalf of the department in Manitoba, or in specified parts of Manitoba set out in the authorization. Instructors 3(1) No person shall serve as an instructor for a hunter education course unless he or she holds a valid hunter education instructor's certificate. 3(2) In order to obtain a hunter education instructor's certificate, a person must (a) hold a valid hunter education certificate; (b) apply in writing to the director or an organization or agency designated under subsection 2(2); (c) provide the director or a designated organization or agency with all requested information and documentation; and (d) receive a passing grade on an instructor's examination that has been approved by the department. 3(3) The director, or a person designated by the director, may suspend a person's hunter education instructor's certificate if the person has failed to (a) instruct, or assist in the instruction of, at least one hunter education course each year; or (b) attend instructor training seminars when required to do so by the director or a designated organization or agency. 3(4) A person's hunter education instructor's certificate may be cancelled by the director, or a person designated by the director, if (a) the person no longer holds a valid hunter education certificate; or (b) the director or the director's designate determines that it is not appropriate for the person to serve as an instructor for the hunter education course. Who may be issued a hunter education certificate 4(1) The director or a designated organization or agency may issue a hunter education certificate to a person who (a) is 12 years of age or older; (b) has completed the hunter education course; and (c) has passed a written examination with a mark of 96% or more or has passed an oral or practical examination conducted under subsection (2). 4(2) If the instructor of a hunter education course is satisfied that special circumstances exist that prevent a person who has completed the hunter education course from taking the written examination referred to in clause (1)⁠(c), the instructor may conduct an oral or practical examination of that person instead. 4(3) [Repealed] M.R. 96/2016 4(4) A person who makes a written declaration to an officer that he or she has held a hunting licence in Manitoba or in another province, territory or country before January 1, 1975, is eligible to receive a hunter education certificate without having taken a hunter education course. M.R. 96/2016 Apprentice hunter education certificate 4.1(1) The director or a designated organization or agency may issue an apprentice hunter education certificate to a person who (a) is under 12 years of age; (b) has completed the hunter education course; and (c) has passed a written examination with a mark of 96% or more or has passed an oral or practical examination conducted under subsection 4(2). 4.1(2) When a person who holds an apprentice hunter education certificate becomes 12 years of age, the director or the designated organization or agency that issued the apprentice hunter education certificate must issue a hunter education certificate to that person. M.R. 96/2016 Requirements to obtain hunting licence 5(1) Subject to subsection 6(3), no person shall apply for or obtain a hunting licence unless the person is 12 years of age or older and holds (a) a valid hunter education certificate; or (b) an equivalent valid hunter education certificate from another province, territory, state or country. 5(2) A person who is required to hold a certificate referred to in subsection (1) in order to obtain a hunting licence must (a) when hunting under the authority of his or her hunting licence, have the certificate in his or her possession and produce the certificate upon request from an officer; and (b) at any other time, produce the certificate to an officer as soon as possible after being requested to do so by the officer. M.R. 7/2012 ; 185/2014 Cancellation of certificate 6(1) A person's hunter education certificate is cancelled if (a) the person has been convicted of an offence under the Act, the Migratory Birds Convention Act, 1994 (Canada) or regulations made under those Acts that results in a suspension of the right of that person to obtain or hold a hunting licence; or (b) the person has been convicted of three or more offences under the Act, the Migratory Birds Convention Act, 1994 (Canada) or regulations made under those Acts within a seven-year period. 6(2) A person whose certificate has been cancelled under subsection (1) must successfully complete a hunter education course before applying for or obtaining a hunting licence after the cancellation. 6(3) If a person who is not required to hold a hunter education certificate in order to obtain a hunting licence because he or she holds a valid hunter education certificate from another province, territory, state or country is convicted of the offence or offences referred to in clause (1)⁠(a) or (b), he or she must successfully complete a hunter education course conducted under authority of this regulation before applying for or obtaining a hunting licence after the conviction.
