This regulation requires users and occupiers of Crown lands under permits, leases, licences, or easements to pay the fees set by the regulation.

C340 Regulation 130/91 Registered June 14, 1991 bilingual version (HTML) Table of Contents Section 1 Definitions 2 Fees for use and occupation of land 3 Repealed 4 Fees in respect of leases and permits 5 Licences of occupation 6 Oil well sites 7 Winter roads 8 Fill or black dirt borrow pit 9 Easements 10 Communication towers 11 Sign Sites 12 Payment of fees and interest 13 Repeal Definitions 1 In this regulation, "appraised value" means the appraised value of land, not including any buildings or improvements owned by a lessee or permit holder, as determined by the minister; (« valeur d'estimation ») "back tier lot" means a lot that is not contiguous to a lake, river or other body of water; (« lot non riverain ») "lakefront lot" means a lot that is contiguous to a lake, river or other body of water, or to a public or Crown reserve that is contiguous to a lake, river or other body of water; (« lot riverain ») "lot" includes an unsurveyed area of land; (« lot ») "provincial road" means a provincial road as defined in The Transportation Infrastructure Act ; (« route provinciale secondaire ») "provincial trunk highway" means a provincial trunk highway as defined in The Transportation Infrastructure Act ; (« route provinciale à grande circulation ») "recreational lot" means a lot on which a private dwelling is occupied or capable of being occupied on a seasonal or occasional basis; (« lot à usage récréatif ») "residential lot" means a lot on which a private dwelling is occupied or capable of being occupied as a principal residence; (« lot à usage résidentiel ») "temporary use" , with respect to land, means use that (a) does not involve the construction of buildings or other structures, or (b) involves the construction only of buildings or other structures that are readily moveable. (« utilisation temporaire ») M.R. 115/2025 Fees for use and occupation of land 2 A person who uses or occupies land under the authority of a permit, lease, licence or easement issued or granted by the minister under The Crown Lands Act shall pay the fee for that use or occupation that is required by this regulation. 3 [Repealed] M.R. 107/92 Fees in respect of leases and permits 4 The annual fee in respect of a lease or permit of Crown lands described in this section is 4.0% of the appraised value of the land, with a minimum fee payable as follows: (a) for recreational lots (i) that are located in a subdivision other than a subdivision referred to in subclause (ii) (A) lakefront lots accessible by road Licences of occupation 5 The fees in respect of a licence of occupation issued for, but not limited to, shell or reed gathering or studies of fire damage or water movement, are: (a) an initial fee of $10./160 acres or portion of 160 acres, payable prior to issuance of the licence; and (b) an annual fee (i) for private, government or non-profit use Oil well sites 6(1) The fees in respect of a permit or lease of an oil well site are: (a) an initial fee of $2,000. payable prior to issuance of the lease or permit; and (b) an annual fee of, (i) for sites on Class 1, 2 or 3 Agricultural soils 6(2) A reference in this section to a class of soil is a reference to a soil class described in the Canada Land Inventory System published by the Department of the Environment (Canada). Winter roads 7 The annual fee for a permit to use a winter road is $100. plus one additional dollar for every kilometre of road. Fill or black dirt borrow pit 8 The annual fee for a permit to remove fill or black dirt from a borrow pit is $100. plus 10¢ per cubic metre of fill or black dirt. Easements 9 The following fees are payable in respect of easements on Crown land: (a) for Manitoba Hydro distribution lines less than 66 kv, an initial fee of Communication towers 10 The annual fee for a permit for a communication tower site is $400. Sign Sites 11 The annual fee for a permit for a sign site adjoining the following: (a) Trans-Canada Highway Payment of fees and interest 12 Where an annual fee is payable under this regulation, (a) the fee shall be paid within 30 days of the date of issue of an invoice; and (b) every permit holder, lessee and licence holder and every person to whom an easement has been granted shall pay interest from and after 60 days from the date payment is due as shown on an invoice, and the rate of interest shall be that prescribed by the Minister of Finance under section 90 of The Financial Administration Act . M.R. 83/94 Repeal 13 Manitoba Regulation 353/88, as amended, is repealed.
