People generally must not use a designated provincial snowmobile trail without a valid permit and the required permit display.

"department" means the department of government over which the minister presides. (« ministère ») "designated provincial snowmobile trail" means a snowmobile trail designated under section 2 of the Provincial Snowmobile Trail Regulation , Manitoba Regulation 217/94. (« sentier provincial de motoneige désigné ») "officer" means a peace officer as defined in The Off-Road Vehicles Act . (« agent ») "Snopass number plate" means a type 5 Snopass number plate prescribed by section 1 of the Schedule to the Vehicle Registration Regulation , Manitoba Regulation 57/2006. (« plaque d'accès aux sentiers de motoneige ») "snowmobile" has the same meaning as in The Off-Road Vehicles Act . (« motoneige ») Permit required to use designated provincial snowmobile trail 2(1) A person must not operate a snowmobile on a designated provincial snowmobile trail unless they (a) have a valid and subsisting permit for the snowmobile they are operating; and (b) comply with the requirements of section 3 respecting the display of their permit. 2(2) Subsection (1) does not apply to a person using a designated provincial snowmobile trail to travel to (a) their residence from their place of work; or (b) their place of work from their residence; if the trail is the person's only reasonable means of access to their residence or place of work. 2(3) Subsection (1) does not apply to a person using a snowmobile displaying a current Saskatchewan Government Insurance registration sticker on its licence plate. 2(4) Subsection (1) does not apply to an officer or department employee who is operating a snowmobile on a designated provincial snowmobile trail while acting in the course of their duties. 2(5) Subsection (1) does not apply to an Aboriginal person who is operating a snowmobile on a designated provincial snowmobile trail while exercising their aboriginal or treaty rights. Permit display requirements 3(1) A Manitoba resident with an annual permit must display a Snopass number plate as the number plate for their snowmobile when operating it on a designated provincial snowmobile trail. 3(2) A person who resides outside Manitoba with an annual permit must have the permit affixed to their snowmobile's windshield when operating the snowmobile on a designated provincial snowmobile trail. 3(3) A person with a three-day permit or a seven-day permit must (a) carry the permit or a copy of it with them when operating a snowmobile on a designated provincial snowmobile trail and show it to an officer when requested to do so; or (b) carry an electronic device that contains their permit when operating a snowmobile on a designated provincial snowmobile trail and access the permit on their device and show the permit to an officer when requested to do so and permit the officer to view it for such period of time as the officer may require. 3(4) If a person is carrying an electronic device that contains their permit and they are unable to access it and show the permit to an officer for any reason, that person is deemed to contravene subsection 2(1). For greater certainty, it is not a defence if the device was out of power, damaged or experienced any technical difficulties that prevented the permit from being displayed on the device when requested. Permits 4(1) Applications for annual permits may be made to an agent of The Manitoba Public Insurance Corporation. 4(2) Applications for three-day permits and seven-day permits may be made using the internet at an address specified by the department. 4(3) A person must not knowingly make a false statement in an application for a permit. 4(4) A person must not alter or forge a permit. 4(5) A person must not possess, sell or attempt to sell a permit that has been altered or forged. Permit fees 5 The fees payable for permits are as follows: (a) annual permit Transitional 6 A permit that was issued under the Provincial Snowmobile Trail Regulation before the coming into force of this regulation is deemed to be a permit and it may be used by a person until it expires if they also comply with the applicable display requirements set out in section 3. Coming into force 7 This regulation comes into force on the same day that section 3 of The Off-Road Trails Safety and Maintenance Act , S.M. 2023, c. 7, comes into force.
