This regulation sets how public library operating grants are calculated, who can qualify, and what a library or municipality must do to be included or eligible.
Public Libraries Allocation of Grants Regulation, M.R. 134/2023 The Public Libraries Act , C.C.S.M. c. P220 Regulation 134/2023 Registered August 25, 2023 bilingual version (HTML) Definitions 1 The following definitions apply in this regulation. "Act" means The Public Libraries Act . («  Loi  ») "fiscal year" means the period beginning on April 1 of one year and ending on March 31 of the following year. (« exercice ») "library collection materials" includes material in printed, electronic or digital form that may be shared with or used by a patron of a public library. (« matériel de collection de bibliothèque ») "operating grant" means a grant made in respect of the expenses connected with the normal operations of a public library as approved by the minister, excluding capital expenditure for building, land and the purchase of vehicles. (« subvention de fonctionnement ») "participating municipality" means, subject to section 2, a municipality that has (a) established a municipal public library under section 9 of the Act; or (b) entered into an agreement respecting its participation in a regional library under section 23 or 29 of the Act. (« municipalité participante ») "public library" means a municipal public library established under section 9 of the Act or a regional library, and includes the public libraries operated by The City of Winnipeg. (« bibliothèque publique ») Application — participating municipality 2 To be included as a participating municipality in the formula in subsection 3(1) for a fiscal year, a municipality must have contributed at least $3.75 per capita of funding to its public library in the preceding calendar year. Annual operating grant 3(1) Subject to subsection (2), the operating grant payable to a public library in a fiscal year is determined in accordance with the following formula: A + (B × C) In this formula, A is the lesser of T and M where T is the total of the amounts of funding that the public library received from each participating municipality in the previous calendar year, and M is $20,000 multiplied by the number of participating municipalities; B is the greater of zero and the amount determined by the following formula: T − M C is, for the number of participating municipalities set out in the first column of the following table, the percentage set out opposite in the second column: Number of participating municipalities Percentage 1 or 2 25% 3 or 4 50% 5 to 10 65% more than 10 75% 3(2) If the operating grant amount for a public library for a fiscal year, as calculated under subsection (1), is less than the amount the public library received in the fiscal year immediately preceding the coming into force of this regulation, then the public library's operating grant for the fiscal year is the amount the public library received in the fiscal year immediately preceding the coming into force of this regulation. 3(3) Subsection (2) applies in a fiscal year only if the total municipal funding received by the public library in the previous calendar year equals or exceeds the amount of municipal funding received by the public library in the calendar year that immediately preceded the coming into force of this regulation. Grants re City of Winnipeg public libraries 4(1) Despite section 3, the operating grant payable in a fiscal year in respect of the public libraries operated by The City of Winnipeg is the amount determined in accordance with the following formula, to a maximum of $4,000,000: D + E In this formula, D is 15% of the total of all expenditures in the previous calendar year on library collection materials and salaries of employees who provided or delivered library services on-site at a city library; E is $10,000 for each full-time equivalent credentialed librarian employed in a city library. 4(2) In subsection (1), a "credentialed librarian" means a person who holds a master's degree in the field of library and information studies issued by an American Library Association-accredited institution. Eligibility 5 To be eligible to receive an operating grant under this regulation, a public library must (a) apply for the grant in the form and manner, and at the time, approved by the minister; (b) submit the library board's most recent approved estimate under clause 21(c) or 27(c) of the Act on or before July 1 of the year for which it seeks a grant; (c) submit its previous year's audited financial statements at the time specified by the minister; and (d) participate in a library resource-sharing program approved by the minister. Repeal 6 The Public Libraries Allocation of Grants Regulation , Manitoba Regulation 279/87, is repealed. Coming into force 7 This regulation comes into force on April 1, 2024.
