This by-law closes the public reserve areas listed in the Schedule.
Public Reserve Closure By-law, M.R. 134/96 The Northern Affairs Act , C.C.S.M. c. N100 Regulation 134/96 Registered July 8, 1996 bilingual version (HTML) WHEREAS The Northern Affairs Act , C.C.S.M. c. N100, provides in part as follows: 5(1) Subject to ... other provisions of the Act ... the minister has the powers, rights and privileges that a municipality has within its boundaries and the minister may exercise and perform these powers, rights and privileges. 5(5) [W]here the exercise or performance of the powers, rights, privileges or duties ... require the passing of a by-law, ... the minister may make the by-law .... for or on behalf of the residents of Northern Manitoba.... 5(6) The by-law ... may be made to apply to the whole or any part of Northern Manitoba .... AND WHEREAS The Planning Act , C.C.S.M. c. P80, provides in part as follows: 73(3) Lands designated as a public reserve, whether in the name of the municipality or the Crown in right of Manitoba, may be closed by by-law of the municipality.... 94 The minister responsible for this Part [Part IX, Northern Manitoba] and for those sections of this Act that apply in Northern Manitoba shall be the minister responsible for The Northern Affairs Act . AND WHEREAS it is considered advisable to close portions of the public reserves described in the Schedule; NOW THEREFORE the Minister of Northern Affairs enacts as follows: 1 The portions of public reserves described in the Schedule are hereby closed. SCHEDULE Setting Lake 1(1) All that portion of the public reserve shown on plan 6608, Portage la Prairie Land Titles Office (Neepawa Division) contained within the limits of lots 1 and 2 as shown on a plan of subdivision of part of unsurveyed township 70 Range 7 west of the principal meridian, prepared by John S. Kulchyki, Manitoba Land Surveyor, of the town of Dauphin, and sworn to by him on January 31, 1995 and shown in deposit plan 169/95. 1(2) All that portion of the Public Reserve shown on plan 6608, Portage la Prairie Land Titles Office (Neepawa Division) contained within the limits of lot 1 as shown on a plan of subdivision of part of lot 55 and part of the public reserve in unsurveyed township 71 range 7 west of the principal meridian, prepared by John S. Kulchyki, Manitoba Land Surveyor, of the town of Dauphin, and sworn to by him on May 9, 1995 and shown in deposit plan 462/95. 1(3) All that portion of the public reserve shown on plan 6956, Portage la Prairie Land Titles Office (Neepawa Division), lying between lots 2 and 3 block 1 as shown on deposit plan 1087/96 being part of unsurveyed township 70 range 7 west of the principal meridian. 1(4) All that portion of Public Reserve Plan 6354 PLTO (N Div) contained within Lot 1 as shown on a Plan of Subdivision of Unsurveyed Section 20-70-7 WPM, prepared by John S. Kulchycki, Manitoba Land Surveyor, of the City of Dauphin, and assigned Deposit No. 463/2004 WLTO excepting all mines, minerals and other reservations as contained in The Crown Lands Act . M.R. 5/98; 45/2005 Athapapuskow Lake 2(1) All that portion of the Public Reserve "A" shown on plan 21596, Portage la Prairie Land Titles Office (Neepawa Division) contained within the limits of lot 1 as shown on a plan of subdivision of part of lot 1 block 3 and part of the public reserve "A" in fractional south west ¼ section 3 township 65 range 28 west of the principal meridian, prepared by John S. Kulchyki, Manitoba Land Surveyor, of the town of Dauphin, and sworn to by him on May 29, 1995 and shown in deposit plan 546/95. 2(2) All that portion of the Public Reserve shown on Plan 20823, Portage la Prairie Land Titles Office (Neepawa Division) contained within the limits of lot 1 as shown on a plan of subdivision of lot 1 and part of public reserve unsurveyed township 67 range 28 west of the principal meridian, prepared by John S. Kulchyki, Manitoba Land Surveyor, of the town of Dauphin, and sworn to by him on March 24, 1995 and shown in deposit plan 334/95. 2(3) All that portion of the public reserve shown on plan 7400 and plan 20823, Portage la Prairie Land Titles Office (Neepawa Division) contained within the limits of lot 1 as shown on a plan of subdivision of lot 1 block 2 plan 7400; and part of the public reserve in plan 7400 and plan 20823 in unsurveyed township 67 range 28 west of the principal meridian, prepared by John S. Kulchyki, Manitoba Land Surveyor, of the town of Dauphin, and sworn to by him on January 30, 1995 and shown on deposit plan 335/95. Schist Lake 3(1) All that portion of the public reserve in unsurveyed township 65 range 29 west of the principal meridian, contained within the limits of lot 1 as shown on a plan of subdivision of lot 1 block 1 plan 7560 Portage la Prairie Land Titles Office (Neepawa division) and part of unsurveyed township 65 range 29 west of the principal meridian, prepared by John S. Kulchyki, Manitoba Land Surveyor, of the town of Dauphin, and sworn to by him on June 1, 1995 and shown in deposit plan 544/95. 3(2) All that portion of the public reserve in unsurveyed township 65 range 29 west of the principal meridian contained within the limits of lot 1 as shown on a plan of subdivision of lot 8 plan 7277 Portage la Prairie Land Titles Office (Neepawa Division) and a portion of unsurveyed township 65 range 29 west of the principal meridian, prepared by John S. Kulchyki, Manitoba Land Surveyor, of the town of Dauphin, and sworn to by him on January 30, 1995 and shown in deposit plan 545/95. 3(3) All that portion of the Crown Reserve shown on plan 7277, Portage la Prairie Land Titles Office (Neepawa Division), lying to the west of a line drawn parallel to and perpendicularly distant 9.3 meters from the east limit of lot 4, between the easterly production of the north limit and the easterly production of the south limit of lot 4. M.R. 5/98 Benyk's Point 4(1) All that portion of fractional north ½ section 7 township 30 range 15 west of the principle meridian taken for Dauphin Drive Plan 2104 D.L.T.O. contained within the limits of Deposit Plan 168/2000 sworn to by William Lee Morris, Manitoba Land Surveyor, of the City of Dauphin on April 20, 2000; and 4(2) All that portion of fractional north ½ section 7 township 30 range 15 west of the principle meridian shown as Public Reserve in Plan 20784 D.L.T.O., contained within the limits of Deposit Plan 168/2000 sworn to by William Lee Morris, Manitoba Land Surveyor of the City of Dauphin on April 20, 2000. 4(3) All that portion shown as Public Reserve on Plan 46664 D.L.T.O. 4(4) All that portion of the public reserve shown on plan 46664, Dauphin Land Titles Office contained within the limits of Parcel A on a plan of survey of part of the N ½ section 7 township 30 range 15 west of the principle meridian, prepared by Bayne Balchen, Manitoba Land Surveyor, of the City of Dauphin, and assigned deposit no. 435/2013 WLTO. M.R. 118/2000 ; 104/2015 ; 174/2018 Duck Bay 5 All that portion of the public reserve shown on plan 1939, Dauphin Land Titles Office contained within Parcel B, as shown on the plan of survey of part of fractional south west ¼ section 17 township 37 range 19 west of the principal meridian, prepared by Bayne Bruce Balchen, Manitoba Land Surveyor, of the City of Dauphin, and shown on deposit plan 1439/2004 WLTO. M.R. 183/2014 Bissett 6 All that portion of the Gabrielle M.C. lot 5 plan 3728 WLTO taken for public reserve, as shown on the plan of subdivision 10968 WLTO, as same is shown within Parcel A on a plan of survey, deposit 1987/2012 in unsurveyed north west ¼ section 2 and south west ¼ 11-24-13 east of the principal meridian, prepared by Gordon Alfred Lund, Manitoba Land Surveyor, of the City of Winnipeg.
