This regulation sets testing and certification rules for certain image capturing enforcement systems.

"Act" means The Highway Traffic Act . («  Code  ») "DriveSafe vehicle-mounted photo radar system" means a DriveSafe Enforcement System approved under clause 3(4)⁠(c) of the Image Capturing Enforcement Regulation , Manitoba Regulation 220/2002. (« système de radar photographique DriveSafe installé dans ou sur un véhicule ») "Gatsometer trailer- or vehicle-mounted photo radar system" means a Gatsometer photo radar system approved under subsection 3(3) (trailer-mounted system) or clause 3(4)⁠(a) or (b) (vehicle-mounted system) of the Image Capturing Enforcement Regulation . (« système de radar photographique Gatsometer installé dans ou sur un véhicule ou une remorque ») "intersection safety camera system" means an induction loop intersection safety camera system or a radar intersection safety camera system approved under subsection 3(1) or 3(2) of the Image Capturing Enforcement Regulation . (« système de caméra de sécurité installé à une intersection ») "vehicle-mounted photo laser system" means a vehicle-mounted photo laser system approved under subsection 3(5) of the Image Capturing Enforcement Regulation . (« système de laser photographique installé dans ou sur un véhicule ») M.R. 86/2025 2 [Renumbered as section  8] TESTING FOR INTERSECTION SAFETY CAMERA SYSTEMS Tests for intersection safety camera systems 3(1) For the purpose of subsection 257.2(3) of the Act, an intersection safety camera system must be tested in accordance with the manufacturer's specifications within six months before or after the date of the offence charged. Certificate 3(2) To evidence the completion of the testing required by subsection (1), the certificate set out in the Schedule to this regulation is prescribed for the purpose of subsection 257.3(2) of the Act . M.R. 86/2025 TESTING FOR MOBILE IMAGE CAPTURING SYSTEMS Tests for Gatsometer photo radar systems 4(1) For the purpose of subsection 257.2(3) of the Act, the tests that the operator of a Gatsometer trailer- or vehicle-mounted photo radar system must conduct to ascertain that the system is in proper working order are an internal circuit test and an audio doppler test. Tests for DriveSafe photo radar systems 4(2) For the purpose of subsection 257.2(3) of the Act, the tests that the operator of a DriveSafe vehicle-mounted photo radar system must conduct to ascertain that the system is in proper working order are an internal system self-test, a radar self-test validation and a successful capture of a test shot. Tests for photo laser systems 4(3) For the purpose of subsection 257.2(3) of the Act, the tests that the operator of a vehicle-mounted photo laser system must conduct to ascertain that the system is in proper working order are a zero-velocity fixed distance test, a self-test, a display test and a scope alignment test. M.R. 86/2025 Frequency of testing for mobile systems 5 For the purpose of subsection 257.2(3) of the Act, the operator of an image capturing enforcement system referred to in section 4 must perform the tests (a) within the 24-hour period before the alleged offence was committed; and (b) within the 24-hour period after the alleged offence was committed. M.R. 86/2025 Operator's certificate for mobile system testing 6 To evidence the completion of the testing required by sections 4 and 5, the certificate set out in Schedule F to the Image Capturing Enforcement Regulation is prescribed for the purpose of subsection 257.3(2) of the Act . M.R. 86/2025 Additional required testing for mobile systems 7(1) In addition to the testing required by sections 4 and 5, an image capturing enforcement system referred to in section 4 must be tested in accordance with the manufacturer's specifications within six months before or after the date of the offence charged. Certificate for additional testing 7(2) To evidence the completion of the testing required by subsection (1), the certificate set out in the Schedule to this regulation is prescribed for the purpose of subsection 257.3(2) of the Act . M.R. 86/2025 COMING INTO FORCE Coming into force 8 This regulation comes into force on the same day that The Provincial Offences Act , S.M. 2013, c. 47, Schedule A, comes into force.
