Fatality Inquiries Regulation, M.R. 144/92 The Fatality Inquiries Act , C.C.S.M. c. F52 Regulation 144/92 Registered July 27, 1992 bilingual version (HTML) Fees and allowances 1 Subject to section 2, the fees and allowances set out in the Schedule are payable for services performed under The Fatality Inquiries Act . Exceptions 2(1) Where the prescribed fees or allowances are, in the opinion of the Deputy Minister of Justice, insufficient under the circumstances or where no fees or allowances are prescribed for the services performed, the Deputy Minister of Justice may authorize the payment of such fees or allowances as he or she considers reasonable. 2(2) The Deputy Minister of Justice may waive all or a portion of a fee payable under section 6 of the Schedule for a copy of a record requested by (a) the next-of-kin of the decedent; (b) a physician; (c) a hospital; or (d) a government department or agency. Inquiry for deaths in personal care homes 2.1 For the purpose of clause 7.1(1)⁠(n) of the Act, an inquiry must be conducted into a death that occurred in a personal care home that is licensed under The Health Services Insurance Act . M.R. 133/2017 Repeal 3 The Fatality Inquiries Fees Regulation , Manitoba Regulation 271/88, is repealed. Coming into force 4 This regulation comes into force on August 1, 1992. SCHEDULE FEES AND ALLOWANCES Medical examiners' fees 1(1) The following fees are payable to a medical examiner: (a) for making inquiries and preparing and maintaining a written report where the medical examiner does not take charge of the body under the Act: Period Fee If performed between April 1, 2021 and March 31, 2022 $29.55 If performed on or after April 1, 2022 $29.85 1(2) No fee is payable to a medical examiner under clause (1)⁠(g) or (h) if the medical examiner is entitled to any other fee under subsection (1) with respect to the same death. M.R. 125/2001 ; 23/2004 ; 30/2006 ; 58/2009 ; 118/2013 ; 117/2016 ; 4/2022 Medical examiners' allowances 2 The following allowances may be paid to a medical examiner: (a) reimbursement for actual and necessary travel at the rate allowed from time to time for privately owned vehicles as set out in the General Manual of Administration ; (b) when travelling by means other than a privately owned vehicle, reimbursement for the actual, necessary and reasonable return fare; (c) the actual, necessary and reasonable expenses, supported by receipts, incurred in conducting an investigation. Autopsies 3(1) The following fees are payable to a person who performs an autopsy: (a) complete autopsy by a registered, qualified pathologist, including microscopic examination, taking of fluids or tissue for toxicological or microscopic examination and preparation of all necessary reports: Period Fee If performed between April 1, 2021 and March 31, 2022 $756.60 If performed on or after April 1, 2022 $764.15 3(2) The fee payable for a toxicological examination or other laboratory or radiological service is the current fee set out in the Payments for Insured Medical Services Regulation under The Health Services Insurance Act . 3(3) The fee payable for dental services is the current fee specified by the Manitoba Dental Association. 3(4) A morgue attendant who is called back to work on a weekend or after normal working hours on a weekday shall be paid, per autopsy, $76. M.R. 125/2001 ; 23/2004 ; 30/2006 ; 58/2009 ; 118/2013 ; 117/2016 ; 4/2022 Use of non-hospital morgues 4 The following fees are payable for the use of non-hospital morgue facilities: (a) for a postmortem examination or external examination: Removal and transportation 5(1) The following fees are payable for the removal and transportation of a body by ambulance, hearse or other vehicle: (a) for the initial attending, shrouding and removal of a body from a scene of death other than a health care facility or residential care facility, including the first 30 km of travel 5(2) In addition to the fees payable under subsection (1), a person who transports a body that is in an infested, putrid or dismembered state may be paid $60. 5(3) In unusual circumstances, other expenses, supported by receipts, such as meals, accommodations and dry cleaning, may be paid as determined by the chief medical examiner.
