"Act" means The Highway Traffic Act . («  Code  ») "authorized person" means a person who, within the context of clauses 77.1(3)⁠(a) and (b) of the Act, (a) under an arrangement with a traffic authority, has the authority to place or erect traffic control devices on the traffic authority's behalf for the purpose of section 77.1 of the Act; or (b) a traffic authority has given permission to erect the traffic control devices for the purpose of that section. (« personne autorisée ») APPROVAL OF TRAFFIC CONTROL DEVICES FOR IDENTIFYING A DESIGNATED CONSTRUCTION ZONE AND OTHER USES IN A ZONE Approval of traffic control devices 2(1) The traffic control devices depicted in Schedules A and B are approved for identifying the longitudinal boundaries of a designated construction zone for the purpose of subsection 77.1(2) of the Act. 2(2) The traffic control devices depicted in Schedule D are approved to be placed or erected in a designated construction zone for the purpose of subsection 77.1(4) of the Act. M.R. 181/2014 REQUIREMENTS RELATING TO IDENTIFYING A DESIGNATED CONSTRUCTION ZONE Signage and other requirements for designated construction zones 3(1) This section set out requirements that a traffic authority or an authorized person must fulfill when they identify a portion of length of highway as a designated construction zone for the purpose of subsection 77.1(2) of the Act. 3(2) The traffic authority or an authorized person is to identify (a) the beginning of a designated construction zone by placing or erecting, facing traffic entering the zone, (i) a traffic control device conforming to Drawing 1 or 3 set out in Schedule A, or (ii) a pair of traffic control devices, one conforming to Drawing 1 set out in Schedule A and the other conforming to Drawing 2 in that Schedule; and (b) the end of a designated construction zone by placing or erecting, facing traffic leaving the zone, (i) a traffic control device conforming to Drawing 1 or 3 set out in Schedule B, or (ii) a pair of traffic control devices, one conforming to Drawing 1 set out in Schedule B and the other conforming to Drawing 2 in that Schedule. 3(3) A traffic control device placed or erected to mark the beginning of a designated construction zone (a) is to be placed or erected where drivers entering the zone have an unimpeded view of the device; and (b) must (i) be square in shape and erected so that one diagonal is vertical, (ii) be at least 900 mm along each side, (iii) have an orange background colour, white tabs and black lettering and markings, and (iv) be reflectorized to show the same colour and shape by night as by day. 3(4) A traffic control device placed or erected to mark the end of a designated construction zone (a) is to be placed or erected where drivers leaving the zone have an unimpeded view of the device; (b) must (i) be square in shape and erected so that one diagonal is vertical, (ii) be at least 600 mm along each side, (iii) have an orange background colour and black lettering and markings, and (iv) be reflectorized to show the same colour and shape by night as by day. 3(5) For the purpose of this section, the beginning of a designated construction zone, for traffic proceeding in one direction on a highway, is the point on the highway at which that traffic enters the portion or length of that highway comprising the designated construction zone and (a) in the case of a designated construction zone the beginning of which is identified by single traffic control device in accordance with subclause 3(2)⁠(a)⁠(i), corresponds to a virtual line (i) drawn from one lateral boundary of the highway to the other perpendicular to the direction of the highway's traffic lanes, and (ii) passing over the point at which the traffic control device is placed or erected; or (b) in the case of a designated construction zone the beginning of which is identified by a pair traffic control devices in accordance with subclause 3(2)⁠(a)⁠(ii), corresponds to a virtual line (i) drawn from one lateral boundary of the highway to the other perpendicular to the direction of the highway's traffic lanes, and (ii) passing over the point at which the first of the pair of devices is placed or erected or, if the devices are side by side, the point at which they are placed or erected. 3(6) For the purpose of this section, the end of a designated construction zone, for traffic described in subsection (5), is the point on the highway at which that traffic leaves the portion or length of that highway comprising the designated construction zone and (a) in the case of a designated construction zone the end of which is identified by single traffic control device in accordance with subclause 3(2)⁠(b)⁠(i), corresponds to a virtual line (i) drawn from one lateral boundary of the highway to the other perpendicular to the direction of the highway's traffic lanes, and (ii) passing over the point at which the traffic control device is placed or erected; or (b) in the case of a designated construction zone the end of which is identified by a pair traffic control devices in accordance with subclause 3(2)⁠(b)⁠(ii), corresponds to a virtual line (i) drawn from one lateral boundary of the highway to the other perpendicular to the direction of the highway's traffic lanes, and (ii) passing over the point at which the first of the pair of devices is placed or erected or, if the devices are side by side, the point at which they are placed or erected. 3(7) When the beginning or end of a designated construction zone is identified by a pair of traffic control devices that are not side by side, the devices are to placed or erected within sight of one another. 3(8) When a traffic control device conforming to Drawing 1 set out in Schedule A is placed or erected on a highway and no traffic control device conforming to Drawing 2 set out in that Schedule is within sight of the Drawing 1 device, the beginning of the designated construction zone is deemed to be identified by a single traffic control device in accordance with clause 3(5)⁠(a). 3(9) When a traffic control device conforming to Drawing 1 set out in Schedule B is placed or erected on a highway and no traffic control device conforming to Drawing 2 set out in that Schedule is within sight of the Drawing 1 device, the end of the designated construction zone is deemed to be identified by a single traffic control device in accordance with clause 3(6)⁠(a). M.R. 181/2014 REQUIREMENTS RELATING TO ESTABLISHING A LOWER MAXIMUM PERMITTED SPEED IN A DESIGNATED CONSTRUCTION ZONE Signage and other requirements for establishing maximum permitted speed 4(1) This section set out requirements that a traffic authority or authorized person must fulfill when, as permitted by subsection 77.1(5) of the Act, they establish a maximum permitted speed in all or part of a designated construction zone that is lower than the maximum permitted speed otherwise provided for or fixed under the Act. 4(2) For the purpose of stating the maximum permitted speed in a designated construction zone or part of it in accordance with subsection 77.1(6) of the Act, the traffic authority or authorized person is to place or erect, in accordance with subsection (3), a traffic control device (as depicted in Schedule C) conforming to the requirements of sign RB-1 (Maximum Speed Sign) of the Manual of Uniform Traffic Control Devices for Canada , Fourth Edition, including requirements as to content, colour, shape, dimensions and other physical specifications. 4(3) The traffic control device stating the maximum permitted speed must be placed or erected (a) facing traffic travelling in the traffic lanes to which the stated maximum permitted speed is to apply; (b) in a location where drivers of vehicles in those traffic lanes have an unimpeded view of the device; and (c) at a point corresponding to the longitudinal point in the designated construction zone where the stated maximum permitted speed is to override the maximum permitted speed that would otherwise apply to those vehicles. 4(4) When a traffic control device is placed or erected in accordance with this section, the maximum permitted speed stated in it applies to a vehicle proceeding beyond it until the vehicle (a) passes another traffic control device stating a different maximum permitted speed; or (b) leaves the designated construction zone; whichever occurs first. OTHER TRAFFIC CONTROL DEVICE PROVISIONS Information signs about double fines 5(1) To promote worker safety and traffic safety in general, the traffic authority or authorized person is to place or erect in every designated construction zone one or more traffic control devices conforming to the either of the devices depicted in Schedule D. 5(2) At least one of the traffic control devices place or erected for the purpose of this section is to be placed or erected within the designated construction zone no farther than 150 m after the beginning of the designated construction zone, within the meaning of clause 3(5)⁠(a), facing the same traffic lanes as the traffic control device identifying the zone's beginning. 5(3) A traffic control device placed or erected for the purpose of this section is to (a) be square in shape; (b) be at least 600 mm along each side; (c) be white in colour and have black lettering and markings; and (d) be reflectorized to show the same colour and shape by night as by day. 5(4) To avoid doubt, traffic control devices placed or erected under this section are solely for the information of drivers, and the absence of a traffic control device in a designated construction zone complying with subsections (1) to (3) does not affect the application of subsection 238(2.1) of the Act to the zone and is not to be interpreted as making that subsection inapplicable to the zone. WHEN A CONSTRUCTION ZONE IS NOT REQUIRED TO BE IDENTIFIED AS DESIGNATED When non-designation of construction zone permitted 6(1) Despite subsection 77.1(2) of the Act, a traffic authority or authorized person is not, if any of clauses (a) to (d) applies, required to identify as a designated construction zone a portion or length of highway that subsection 77.1(2) of the Act would otherwise require to be so identified (a) the requirement to identify the zone does not apply if the duration of the construction, reconstruction, widening, improvement, repairs or other work being undertaken in the zone is four hours or less; (b) the requirement to identify the zone does not apply if the usual maximum permissible speed for the portion or length of highway comprising the zone is less than 80 km/h; (c) the requirement to identify the zone does not apply if the portion or length of highway comprising the zone has an unpaved roadway; or (d) the requirement to identify the zone does not apply if the construction, reconstruction, widening, improvement, repair or other work being undertaken in the zone is being undertaken entirely off the roadway. 6(2) To avoid doubt, when any of clauses (1)⁠(a) to (d) apply to a portion or length of highway as permitted by subsection (1), subsection 238(2.1) of the Act does not apply in respect of that portion or length of highway unless the designated construction zone is identified as permitted by section 7. Identification of designated construction zone despite subsection 6(1) 7 Despite subsection 6(1), a traffic authority or authorized person may, in accordance with section 3, identify as a designated construction zone a portion of length of highway to which any of clauses 6(1)⁠(a) to (d) apply, in which case sections 4 and 5 apply to the identified portion or length of highway in the same manner as any other designated construction zone. GENERAL PROVISIONS "Maximum 60 when passing workers" signs prohibited 8 A traffic authority or other person must not erect or place on a highway a traffic control device that states that the maximum permissible speed is dependent on the presence or absence of workers or equipment on the highway or the proximity of the vehicle to workers.
