This regulation says certain listed fishery contraventions are prescribed offences and sets restitution values for fish in Schedule B.

F90 Regulation 146/2015 Registered August 31, 2015 bilingual version (HTML) Definitions 1 The following definitions apply in this regulation. "Act" means The Fisheries Act . («  Loi  ») "conservation closure area" means an area which is subject to a conservation closure under the Manitoba Fishery Regulations, 1987 made under the Fisheries Act (Canada). (« zone faisant l'objet d'une fermeture aux fins de conservation ») Prescribed offences 2(1) The contravention of a provision of an Act or a regulation set out in Schedule A is a prescribed offence. 2(2) For greater certainty, if a provision set out in Schedule A contains multiple subsections, clauses or subclauses, the contravention of any of those subsections, clauses or subclauses is a prescribed offence. Restitution values 3(1) Subject to this section, for the purpose of subsection 25.4(1) of the Act, the value set out in Column 2 of Schedule B is prescribed for the type of fish set out opposite in Column 1. 3(2) If a fish is caught in a conservation closure area that has been established for that type of fish, the value set out in Column 3 of Schedule B is prescribed for that type of fish set out opposite in Column 1. 3(3) If a fish is equal to or greater than the size set out in Column 4 of Schedule B, the value set out in that Column is prescribed for the type of fish set out opposite in Column 1. Value for individual fish 4 The values set out in Schedule B are prescribed for each individual fish involved in a prescribed offence. Coming into force 5 This regulation comes into force on the same day that The Fisheries and Wildlife Amendment Act (Restitution) , S.M. 2014, c. 19, comes into force.
