This regulation sets restitution values for listed wildlife and makes certain contraventions prescribed offences.

Prescribed offences 2(1) The contravention of a provision of the Act or a regulation set out in Schedule A is a prescribed offence. 2(2) For greater certainty, if a provision set out in Schedule A contains multiple subsections, clauses or subclauses, the contravention of any of those subsections, clauses or subclauses is a prescribed offence. Base restitution values 3 Subject to sections 4, 5 and 6, the values set out in Schedule B are prescribed for the purpose of section 86.4 of the Act. Increased value for premium antlers 4(1) The value of a moose, elk, caribou or white tailed deer as determined under Schedule B is doubled if its antlers have a score equal to or greater than the following: (a) moose — 20 points; (b) elk — 10 points; (c) caribou — 20 points; (d) white-tailed deer — 8 points. 4(2) The antler score for an animal is determined by adding the following: (a) one point for each main beam that is at least 2.5 cm long; (b) one point for each individual tine that is at least 2.5 cm long. M.R. 43/2018 Increased value for moose killed in closure area 5 If a moose is killed in an area set out in subsection 4(1) of the Moose Conservation Closure Regulation , Manitoba Regulation 122/2011, the value of the moose as determined under Schedule B and section 4 is doubled. Increased value for premium bear 6 If the skull of a black bear as measured from back to front (excluding the lower jaw) is 33 cm or more, the value of the black bear as determined under Schedule B is doubled. Coming into force 7 This regulation comes into force on the same day that The Fisheries and Wildlife Amendment Act (Restitution) , S.M. 2014, c. 19, comes into force.
