(« exercice ») M.R. 116/97; 69/98; 53/2014 ; 150/2020 ; 129/2023 ; 115/2025 Fees for use and occupation of land 2 A person who uses or occupies land under the authority of a permit or lease required by the Permits and Leases Regulation shall pay the fee for that use or occupation that is required by this regulation. Fees for activities 3 A person who engages in an activity for which a permit is required under the Park Activities Regulation , Manitoba Regulation 141/96, shall pay the fee for that activity that is required by this regulation. M.R. 115/2025 PART 2 LAND RENTAL AND SERVICE FEES Land rental fee for residential lots 4(1) The land rental fee for a lease or permit for a residential lot within a provincial park for the 2025-2026 year is the same as the land rental fee that was payable for that lot for the 2024-2025 year. 4(2) If a residential lot did not exist in the 2024-2025 year or that lot was not leased or permitted that year, the land rental fee payable is the same as the land rental fee for a similar lot within the same area of the provincial park in the 2024-2025 year, as determined by department staff. M.R. 116/97; 69/98; 53/2014 ; 46/2016 ; 127/2016 ; 150/2020 ; 129/2023 ; 136/2025 4.1 [Repealed] M.R. 53/2014 ; 46/2016 Land and building rental fee for commercial lots 5(1) The annual land rental fee under a lease for a commercial lot is 3.8% of the value of the lot as a commercial property, excluding any buildings or structures, as determined by the minister. 5(2) When buildings are leased in conjunction with a commercial lot, the following fees shall be paid annually: (a) for prime space 5(3) For the purpose of subsection (2), the determination of whether a building is prime space or standard space shall be made by the minister. 5(4) A lease or permit relating to a commercial lot may provide for a negotiated land rental or building fee in an amount other than that provided for in subsections (1) and (2), and in that event those subsections do not apply. M.R. 116/97; 53/2014 General provisions re service fees 6(1) In order to calculate park district service fees, the minister must determine the direct and indirect costs, including capital and administrative costs, to provide services to or for the benefit of owners and occupiers of land within a park district for the year. 6(2) If there are commercial lots in a park district or special consideration organizations operating in a park district, the minister must separately determine (a) the costs to provide services to or for the benefit of owners and occupiers of residential lots; and (b) the costs to provide services to or for the benefit of owners and occupiers of commercial lots and special consideration organizations. 6(3) If there is a capital cost incurred in connection with the provision of a service in a park district, the capital cost may be amortized with interest over a period of years and a portion of the amortized capital cost and interest is to be included in the minister's determination of the costs of providing services in the district. 6(4) The minister may charge different service fees within a park district because different services or different levels of services are provided in an area of a district or to reflect the higher cost of providing a service in an area of the district. M.R. 116/97; 69/98; 53/2014 Service fees for residential lots 6.1(1) The annual service fee payable by each owner or occupier of a residential lot in a park district is the amount determined for the year by the following formula: SF = A/B In this formula, SF is the annual service fee payable; A is the amount determined by the minister to be the cost to provide services to or for the benefit of owners and occupiers of residential lots in the park district for that year; B is the total number of residential lots in the park district. 6.1(2) Despite subsection (1), the service fee payable by the owner or occupier of a residential lot for the 2025-2026 year is the lesser of the service fee determined under subsection (1) or the 2024-2025 service fee that was payable for that lot. 6.1(3) In this section, "2024-2025 service fee" means (a) the total of all service fees that were payable in respect of that residential lot for the 2024-2025 year; or (b) if that residential lot did not exist or was not owned or occupied in the 2024-2025 year, the total of all service fees that were payable for a similar lot within the same area of the provincial park in the 2024-2025 year, as determined by department staff. 6.1(4) and (5) [Repealed] M.R. 127/2016 M.R. 53/2014 ; 127/2016 ; 150/2020 ; 129/2023 ; 136/2025 6.2 [Repealed] M.R. 53/2014 ; 46/2016 ; 150/2020 Service fees for commercial operators and special consideration organizations 6.3 The annual service fee payable by an owner or occupier of a commercial lot in a park district and each special consideration organization that operates in a park district is the amount provided for in the applicable lease. M.R. 53/2014 7 [Repealed] M.R. 116/97; 53/2014 Annual service fees outside park districts 7.1(1) No service fee is payable under section 6 in respect of land that is inside a provincial park but outside a park district and for which real property taxes are payable to a municipality or local government district. 7.1(2) The annual service fee payable in respect of land that is inside a provincial park but outside a park district and for which no taxes are payable to a municipality or local government district will be an amount determined annually by the minister. M.R. 116/97 Falcon Lake Staff Trailer Camp lot rental fee 8 The annual land rental fee payable in respect of a permit to occupy a lot in the Falcon Lake Staff Trailer Camp is $450, but no person is liable to pay in any one year that portion of the fee which is in excess of $60 above the fees payable in the preceding year. Date of payment 9 Except as otherwise provided in a permit or lease, the fees referred to in sections 4, 5 to 6.3, 7.1 and 8 are payable on or before the due date specified on the invoice for those fees. M.R. 116/97; 150/2020 10(1) [Repealed] M.R. 116/97 Prorating of fees 10(2) The minister may prorate the fees referred to in sections 4 to 8 where the person required to pay the fee owns or is permitted by a permit or lease to occupy the lot for less than a year. R.M. 116/97 Interest 11 Every permit holder, lessee and owner or occupier of land that is inside or outside a park district shall pay interest on any fee owing under sections 4 to 8 from and after one day from the due date shown on an invoice, and the rate of interest shall be that prescribed by the Minister of Finance under subsection 25(1) of The Financial Administration Act . M.R. 116/97; 69/98 No default if compliance with deferral agreement 11.1 If the owner or occupier of a residential lot in a provincial park has entered into an agreement with the minister to defer the payment of a portion of the land rental fee or service fee payable in respect of the lot, the owner or occupier is not to be considered to be in default or subject to the payment of interest under section 11 if he or she is complying with all terms of that agreement. M.R. 53/2014 Waiver of fee 12 When the minister considers it appropriate to do so, the following leases and permits may be granted or issued without payment of the fee provided for in this Part: (a) a lease or permit to occupy a provincial park granted to a rural municipality or a local government district; (b) a lease or permit to occupy land in a provincial park granted or issued to a non-profit, religious, charitable or youth organization. 13 [Repealed] M.R. 116/97 Administration charges 14 The following charges are payable to the minister in respect of a Crown Land Permit for a Vacation Home, a Vacation Home Lease, a commercial operation permit or lease, or a special consideration organization permit or lease in a provincial park: (a) to make application for a lease Subdivision fees 15 The fees payable by an applicant for the approval of a subdivision under the Subdivision of Land Regulation , Manitoba Regulation 142/96, are as follows: (a) for the application PART 3 MOTOR VEHICLE AND CAMPING FEES 16(1) [Repealed] M.R. 227/2011 Motor vehicle permit fees 16(1.1) The fees, including GST, payable for motor vehicle permits are as follows: (a) for a motor vehicle other than a bus, (i) for a daily permit 16(2) [Repealed] M.R. 180/2007 16(3) The minister may authorize a person not employed by the government to issue a motor vehicle permit on such terms and conditions as the minister deems appropriate. M.R. 116/97; 212/2006 ; 180/2007 ; 101/2009 ; 43/2011 ; 227/2011 ; 23/2013 ; 18/2020 Camping fees payable to minister 17 The fees set out in sections 18 and 19 are payable for campsites operated by the minister. Nightly camping permit fee 18 The fee, including GST, payable for a permit to occupy an individual campsite within a provincial park for one night is the amount determined by the following formula: (A + B) × 1.05 In this formula, A is (a) for a campsite with basic service, $11, (b) for a campsite with electrical service, $17, (c) for a campsite with electrical/water service, $18, (d) for a campsite with full service, $20, plus $2 if the campsite is located in Asessippi, Birds Hill, St. Malo, Grand Beach, Falcon Beach, Falcon Lakeshore, West Hawk, Nutimik Lake, Kiche Manitou, Hecla or Winnipeg Beach campgrounds; B is the total of the amounts specified for the following facilities or services that are provided in the campground: (a) washrooms with running water, $2, (b) showers provided without additional charge, $2, (c) supply of firewood provided without additional charge, $9.52, (d) wireless Internet access, $2, less $1 if the facilities referred to in clauses (a) and (b) are provided in the same building or, in the opinion of the director, at a limited level of convenience. M.R. 80/2004 ; 212/2006 ; 180/2007 ; 4/2009 ; 20/2010 ; 227/2011 ; 23/2013 ; 135/2025 Seasonal camping permit fees 19(1) The fee, including GST, payable for a permit to occupy an individual campsite within a provincial park for one season is the amount determined by the following formula: SF = (Base fee × (30 + N)) × 1.05 In this formula, SF is the seasonal camping permit fee; N is the number of weekend nights that a campsite is available for camping outside of the May long weekend to Labour Day period. The base fee is determined by the following formula: (A + B + C) In this formula, A is (a) for a campsite with basic service, $11, (b) for a campsite with electrical service, $17, (c) for a campsite with electrical/water service, $18, (d) for a campsite with full service, $20, plus $2 if the campsite is located in St. Malo, Grand Beach, Falcon Lakeshore, Nutimik Lake, West Hawk, Hecla or Asessippi campgrounds; B is the total of the amounts specified for the following facilities or services that are provided in the campground: (a) washrooms with running water, $2, (b) showers provided without additional charge, $2, (c) supply of firewood provided without additional charge, $9.52, (d) wireless Internet access, $2, less $1 if the facilities referred to in clauses (a) and (b) are provided in the same building or, in the opinion of the director, at a limited level of convenience; C is (a) $5 if the permit for the campsite is renewable annually without a draw, (b) $2 in any other case. 19(2) Notwithstanding subsection (1), where a seasonal camping permit is issued (a) [repealed] M.R. 80/2004 ; (b) for a campsite in respect of which a previously issued seasonal camping permit is cancelled on the issuance of the new permit; the fee, including GST, for the new permit is the greater of $100 or the amount determined by the following formula: PSF = SF x A/B In this formula: PSF is the prorated seasonal fee, including GST; SF is the seasonal fee, including GST, that would be payable under subsection (1) for the entire camping season; A is the number of days remaining in the camping season, as determined by the director; and B is the number of days in the camping season, as determined by the director. 19(3) Where a person's seasonal camping permit for a campsite is cancelled before the end of the camping season and a new seasonal camping permit is issued to another person for the same site for the remainder of the season, the amount refundable to the person whose permit is cancelled is (a) the amount determined by the formula in subsection (2) if the formula was used to determine the payment; or (b) the amount determined by the following formula if the fee for the permit was $100: R = $100 x A/B In this formula, R is the refund; A is the number of days, as determined by the director, remaining in the camping season after the date of cancellation; B is the number of days, as determined by the director, remaining in the camping season after the date the permit was purchased. M.R. 116/97; 69/98; 80/2004 ; 212/2006 ; 180/2007 ; 4/2009 ; 20/2010 ; 227/2011 ; 6/2013 ; 135/2025 19.1 [Repealed] M.R. 212/2006 ; 180/2007 Camping fees for private operator campsites 20 A private contractor or lessee operating a campground within a provincial park may establish the fee payable for use of a campsite within that campground. M.R. 80/2004 21 [Repealed] M.R. 116/97 Self-registration charge 22 In addition to the fees payable under section 17, a person who occupies a campsite in a provincial park at which a self-registration system is established (a) who has failed to register; and (b) from whom the fee under section 17 is collected by an officer; shall pay a charge of $2.45, including GST. M.R. 80/2004 ; 212/2006 PART 4 FEES FOR MISCELLANEOUS ACTIVITIES 23 to 26 [Repealed] M.R. 116/97 Reservation fee 27(1) The fee to use the provincial park reservation service to reserve a campsite, family vacation cabin, group use area or other facility in a provincial park is $10, including GST, for each stay and facility reserved. 27(2) Subject to subsections (3) and (4), a person who makes a change to a reservation shall pay an additional fee of $4, including GST. 27(3) If a person cancels an entire reservation four or more days before their scheduled arrival date, $10 is to be deducted from the refund owing to the person as a result of the cancellation. 27(4) If a person cancels an entire reservation or cancels the first night of a reservation three or less days before their scheduled arrival date, the value of their first night's camping fee, including GST, is to be deducted from the refund owing to the person as a result of the cancellation. M.R. 116/97; 69/98; 74/2001 ; 80/2004 ; 212/2006 ; 180/2007 ; 227/2011 ; 23/2013 ; 135/2025 Fees for family vacation cabins 28 The following fees are payable for each night spent at a family vacation cabin operated by the minister at Hecla/Grindstone Provincial Park and Camp Morton Provincial Park: Hecla/Grindstone Provincial Park (a) cabin type "A" (6 bed) Yurt campsite fee 28.1 The fee payable for a permit to occupy a yurt campsite within a provincial park for one night is $65. M.R. 127/2005 ; 212/2006 ; 180/2007 ; 20/2010 ; 227/2011 ; 23/2013 ; 135/2025 Group use site fees 28.2 The following fees are payable for a permit to occupy a group use site for one day: (a) Birds Hill group use sites — Area 1 Micro-cabin fee 28.3 The fee payable for a permit to occupy a micro-cabin operated by the minister within a provincial park for one night is $80. M.R. 135/2025 Grazing and hay permits 29(1) The annual fees for a permit to graze livestock in a provincial park are: (a) a fee based on productivity using the animal unit month as a unit of measure and calculated according to the formula set out in the Forage Leases Regulation , Manitoba Regulation 46/88 R, made under The Crown Lands Act ; and (b) where the land to which the permit applies is located in a municipality, local government district or school district in unorganized territory, an amount fixed by the minister under subsection 7(4) of The Crown Lands Act in lieu of real property taxes. 29(2) The annual fees for a permit to cut hay in a provincial park are: (a) a fee based on productivity using the animal unit month as a unit of measure and calculated according to the formula set out in the Forage Leases Regulation , with a minimum fee payable of $10; and (b) where the land to which the permit applies is located in a municipality, local government district or school district in unorganized territory, an amount fixed by the minister under subsection 7(4) of The Crown Lands Act in lieu of real property taxes. M.R. 115/2025 Special event fees 30 The fees to conduct a special event in a provincial park are as follows: (a) minor event Fees for miscellaneous coin-operated facilities 31(1) Fees for miscellaneous coin-operated facilities, including fees for laundromat facilities and water supply, shall be determined annually by the minister. 31(2) The fee to use a coin-operated shower in a provincial park is $1 for each three minutes of use. M.R. 116/97; 20/2010 Sewage lagoon tipping fee 31.1 The fee for a commercial sewage hauler to use wastewater facilities in a provincial park is $10 for each truckload. M.R. 20/2010 Miscellaneous permit fees 32(1) The annual fees set out in this subsection are payable for permits for the following land uses and activities: (a) land use permits (i) to use or maintain a private hunting and fishing cabin 32(2) The annual fees set out in this subsection are payable in respect of businesses: (a) to conduct or operate a business other than under the authority of a lease or permit for a commercial lot: (i) for a trade (electrical, plumbing, carpentry, etc.) 32(3) The fee to rent (a) Hecla Community Hall is $200 per day; and (b) Camp Morton Hall is $50 per day. M.R. 116/97; 80/2004 ; 180/2007 ; 227/2011 ; 135/2025 PART 5 MISCELLANEOUS PROVISIONS Complimentary permits 33 If the minister considers it appropriate to do so, permits under sections 14, 16, 18 and 19, subsection 23(1), sections 25 to 30 and section 32 may be issued without payment of the prescribed fee.
