"Act" means The Residential Tenancies Act . («  Loi  ») "compensation order" means an order made under (a) clause (a) of paragraph 5 of subsection 154(1) of the Act; (b) paragraph 1 of subsection 154(1.1) of the Act; or (c) paragraph 1 of subsection 154(1.2) of the Act. (« ordre d'indemnisation ») "order of possession" means an order made under paragraph 9 of subsection 154(1) of the Act. (« ordre de reprise de possession ») M.R. 72/2010 2 Repealed. M.R. 72/2010 Costs on compensation order 3 The director may require a person against whom a compensation order has been made, other than an order arising out of an application for an order of possession, to pay costs as follows: (a) $65 less the amount of any exemption from filing fees under section 24.1 of the Residential Tenancies Regulation , Manitoba Regulation 71/2010, given to the person awarded costs; (b) the reasonable costs incurred, up to a maximum of 10% of the amount of the compensation awarded, if evidence is submitted that those costs exceeded $65. M.R. 137/2011 ; 1/2013 Costs on order of possession 4 The director may require a person against whom an order arising out of an application for an order of possession has been made to pay costs as follows: (a) $110 less the amount of any exemption from filing fees under section 24.1 of the Residential Tenancies Regulation, given to the person awarded costs; (b) the reasonable expenses incurred, up to a maximum of 10% of the amount of any compensation awarded, if evidence is submitted that those costs exceeded $110. M.R. 137/2011 ; 1/2013 Extraordinary service costs 5 Despite section 3 or 4, the director may award costs that exceed the maximum amount provided for under section 3 or 4, if (a) the director made an order requiring a specific method for giving notice of an application for an order of possession or a claim; and (b) the cost incurred in giving notice by that method causes the total costs incurred to exceed the maximum amount provided for in section 3 or 4. Coming into force 6 This regulation comes into force on October 1, 2006.
