Defibrillator Public Access Regulation

"Act" means The Defibrillator Public Access Act . («  Loi  ») "designated premises" means the premises and classes of premises designated in Schedule A. (« lieu désigné ») "indoor designated premises" means the premises and classes of premises listed in section 3 of Schedule A. (« lieu désigné fermé ») "outdoor designated premises" means the premises and classes of premises listed in section 4 of Schedule A. (« lieu désigné ouvert ») Reference to "defibrillator" 1(2) For the purpose of the Act (other than sections 15 to 17) and this regulation, a reference to a "defibrillator" means a semi-automated external defibrillator that meets the criteria set out in section 2 of this regulation. SEMI-AUTOMATED EXTERNAL DEFIBRILLATORS Semi-automated external defibrillators 2 A semi-automated external defibrillator must meet the following criteria: (a) it must be a model approved by Health Canada; (b) it must be suitable for use on both an adult and a child; (c) it must be capable of recognizing the presence or absence in an individual of ventricular fibrillation and rapid ventricular tachycardia; (d) it must be capable of determining, without intervention by an operator, whether defibrillation is required to be performed on an individual; (e) upon determining that defibrillation is required, it must automatically charge and request delivery of an electrical impulse to an individual's heart; (f) upon action by an operator, it must deliver an appropriate electrical impulse to an individual's heart to effect defibrillation; (g) it must be equipped with an additional set of adult pads that are stored with the device, intended for use in the event that the first set of pads do not properly work; (h) it must be equipped with a blinking light, chirping sound or other indicator that activates when immediate maintenance is necessary. HOW MANY DEFIBRILLATORS MUST BE INSTALLED AT DESIGNATED PREMISES? Number of defibrillators — designated premises 3 Subject to sections 4 and 5, the owner of a designated premises must install one defibrillator at the premises in accordance with the requirements of this regulation, Additional defibrillators — "three-minute rule" 4(1) In addition to the defibrillator required under section 3, the owner of a designated premises must install one or more additional defibrillators as may be necessary to ensure that a member of the public witnessing a victim of cardiac arrest at any location on the premises is able to access a defibrillator and return to the victim in less than three minutes. Defence — number of defibrillators 4(2) The owner is not in contravention of subsection (1) if the owner reasonably believes, after having considered the area and layout of the designated premises, that the necessary number of defibrillators have been installed. Further re subsections (1) and (2) 4(3) For the purpose of subsections (1) and (2), (a) "any location on the premises" does not include (i) outdoor areas of indoor designated premises, (ii) outbuildings not ordinarily accessed by members of the public, or (iii) a parking lot or parking structure of any type located on the same property as, or adjacent to, the designated premises; (b) the layout of the designated premises includes the locations of stairways, elevators and ramps, the number of floors in buildings, accessibility by members of the public to different areas of the premises during regular operating hours and other unique design features; and (c) the owner may assume that a member of the public has a walking speed of 100 m/min. Non-application of subsection (1) 4(4) Subsection (1) does not apply to (a) a university or college campus, except for arenas, gyms and other indoor athletic facilities located on the campus; (b) a golf course; or (c) the Assiniboine Park Zoo. Golf courses — specific requirements 5(1) The owner of a golf course must install the defibrillator required under section 3 in the clubhouse of the golf course. Assiniboine Park Zoo — specific requirements 5(2) The City of Winnipeg must ensure that defibrillators are installed at the Assiniboine Park Zoo, in accordance with the requirements of this regulation, at the locations specified in Schedule B. Installation of additional defibrillators 6 Nothing in this regulation prohibits the owner of a designated premises from voluntarily installing additional defibrillators in excess of the number required by this regulation, or at locations in addition to any location that may be required. INSTALLATION OF DEFIBRILLATORS Installation — general requirements 7 The owner of a designated premises must install each defibrillator required under sections 3 to 5 at a location and in a manner that ensures easy public access, and that at a minimum meets the following criteria: (a) readily visible; (b) located on or near common paths of travel; (c) free from blockage by equipment or stored materials; (d) protected, as much as reasonably possible, from potential environmental damage. For greater certainty, if subsection 4(1) or section 5 applies to the designated premises, all defibrillators must be installed at locations that meet the requirements of both this section and subsection 4(1) or section 5 (as the case may be). POSTING OF SIGNS Designated premises — location and number of signs 8 For the purpose of section 5 of the Act, the owner of a designated premises must post and continuously display signs about the location of the defibrillator or defibrillators (as the case may be) installed under sections 3 to 5, (a) at the main entrance, or at each of the main entrances if more than one, of each building or structure on the premises in which a defibrillator is installed; (b) adjacent to each defibrillator, perpendicular to the wall so that the sign can be seen by a person walking in either direction parallel to the wall on which the sign is posted; and (c) at each other location, if any, that the owner reasonably considers necessary to ensure that members of the public will be made aware of the location of the defibrillator or defibrillators. Form and content of signs 9(1) A sign required to be posted under section 8 (a) must include the graphic symbol set out in Schedule C, or a similar graphic symbol, (i) depicting a heart containing a lightning bolt, and (ii) containing (A) the words "Automated External Defibrillator" or the acronym "AED", (B) the French equivalent of the words or acronym referred to in paragraph (A), or (C) both English and French words or acronyms referred to in paragraphs (A) and (B); (b) must, except for a sign required under clause 8(b), contain wording, graphics or both — or be adjacent to a second sign containing wording, graphics or both — that directs a person to the location of the nearest defibrillator; and (c) must be of a size that makes it clearly discernible to persons to whom it is directed. Contrasting colours 9(2) A sign required to be posted under section 8 must utilize contrasting colours so that each element of the sign is clearly discernible to persons to whom it is directed. But if the sign is to be affixed to glass or other transparent material it may have a transparent background, so long as each element of the sign is clearly discernible. REGISTRATION, MOVING AND REMOVAL OF DEFIBRILLATORS Registration of defibrillators 10 For the purpose of subsection 6(1) of the Act, the owner of a designated premises must, when registering a defibrillator installed under sections 3 to 5, (a) provide the registrar, in writing, with all the information that the registrar reasonably requires; and (b) without limiting the generality of clause (a), provide the registrar with sufficient details as to the precise location at the premises where the defibrillator has been installed, such that a member of the public being advised of those details in a telephone conversation could reasonably be expected to locate the defibrillator without undue delay. Moving — or removal of — a defibrillator 11(1) For the purpose of subsection 6(2) of the Act, the owner of a designated premises who moves a defibrillator installed under sections 3 to 5 to another location at the premises, or removes it from the premises, must, as soon as practicable but not later than 15 days after moving or removing the defibrillator, give written notice to the registrar that (a) the defibrillator has been moved to a different location at the premises, including sufficient detail as to its new location sufficient to satisfy the requirements of clause 10(b); or (b) the defibrillator has been removed from the premises, including an explanation of the reason for the removal. Inconsequential moving of a defibrillator 11(2) Subsection (1) does not apply when a defibrillator is moved only a short distance from its earlier location at a designated premises, if the details provided under clause 10(b) for its earlier location would continue to satisfy the requirements of that clause in respect of its new location. Registrar to provide information 12 At the minister's request, the registrar must promptly provide the minister with any information about registration under the Act that is in the registrar's possession or under the registrar's control. This includes, but is not limited to, providing the names and addresses of owners of designated premises, and providing details about the locations where defibrillators are installed, the moving and removal of defibrillators, and notifications given under section 7 of the Act. NOTIFICATION OF EMERGENCY SERVICE PROVIDERS Notification of emergency service providers 13(1) The registrar must give each notification required under section 7 of the Act in accordance with the following: (a) for the registration of a defibrillator installed in the City of Winnipeg, or its subsequent moving or removal, notification is to be given to the Winnipeg Fire Paramedic Service; (b) for the registration of a defibrillator installed elsewhere than in the City of Winnipeg, or its subsequent moving or removal, notification is to be given to the Medical Transportation Coordination Centre, located in the City of Brandon. Timing and form of notification 13(2) The registrar must provide a notification under subsection (1), in such form and containing such information as the minister may require, as soon as practicable but not later than 15 days after a defibrillator is registered or the registrar receives notice of its moving or removal. MAINTENANCE, INSPECTION AND RECORDKEEPING When defibrillator indicates immediate maintenance is necessary 14 When a defibrillator installed under sections 3 to 5 indicates that immediate maintenance is necessary — by means of a blinking light, chirping sound or other indicator — the owner of the designated premises must forthwith inspect the defibrillator, and do whatever maintenance or testing is necessary to ensure that the defibrillator remains in proper working condition. Monthly inspection requirements 15 In addition to the requirement in subsection 8(1) of the Act to maintain and test a defibrillator in accordance with the manufacturer's guidelines, the owner of a defibrillator installed under sections 3 to 5 must ensure that the defibrillator is inspected on a monthly basis in accordance with the requirements prescribed in Schedule D. Inspection tag 16(1) Upon completion of an inspection in accordance with Schedule D, the person who did the inspection must complete an inspection tag, attach it to the defibrillator and take reasonable steps to ensure that it remains attached to the defibrillator for at least 12 months. Information to be included on inspection tag 16(2) The following information is to be included on an inspection tag: (a) the location and serial number of the defibrillator; (b) the registration number of the defibrillator as assigned to it by the registrar; (c) the date of the inspection; (d) the name of the person who did the inspection; (e) the name of, and contact information for, the defibrillator distributor. Monthly inspection record 17(1) Upon completion of an inspection in accordance with Schedule D, the person who did the inspection must also make a monthly inspection record in a form satisfactory to the minister. Information to be included in a monthly inspection record 17(2) The following information is to be included in a monthly inspection record: (a) the location and serial number of the defibrillator; (b) the registration number of the defibrillator as assigned to it by the registrar; (c) the date of the inspection; (d) the name of the person who did the inspection; (e) confirmation that all items listed in Schedule D were inspected, and for any items that failed inspection, the corrective action that was taken; (f) the name of, and contact information for, the defibrillator distributor. Length of time to keep monthly inspection records 17(3) The owner of a defibrillator must maintain a monthly inspection record made under this section, and have it available for inspection, for a period of 12 months after the day it is made. BY WHAT DATE MUST DEFIBRILLATORS BE INSTALLED? Existing designated premises 18(1) For premises that are designated premises before December 1, 2013, the owner of the designated premises must install the defibrillator or defibrillators (as the case may be) required under sections 3 to 5 by not later than January 31, 2014. New construction and newly-designated premises or classes of designated premises 18(2) For premises that become designated premises on or after December 1, 2013, the owner of the designated premises must install the defibrillator or defibrillators (as the case may be) required under sections 3 to 5 within two months after the day that the premises become designated premises. COMING INTO FORCE Coming into force 19 This regulation comes into force on the same day that The Defibrillator Public Access Act , S.M. 2011, c. 10, comes into force. SCHEDULE A (subsection 1(1)) DESIGNATED PREMISES Definitions 1 The following definitions apply in this Schedule. "fitness club" means a gym, studio or similar facility that permits its members or other patrons to use its premises, services or equipment for exercise, fitness training, body-building or a similar purpose. (« club de santé ») "public swimming pool" means a public swimming pool as defined in the Swimming Pools and Other Water Recreational Facilities Regulation , M.R. 132/97. (« piscine publique ») Designated premises 2 The premises and classes of premises listed in sections 3 and 4 are designated as "designated premises" for the purpose of the Act. Indoor designated premises 3(1) The following classes of premises are classified as indoor designated premises: (a) a "public school" or "independent school", as those terms are defined in The Education Administration Act ; (b) a university or college campus, if an arena, gym or other indoor athletic facility is located on the campus; (c) an indoor public swimming pool; (d) an indoor arena where hockey or other ice-skating activity takes place; (e) a curling club; (f) a fitness club that has 150 or more individual members or in which at least 20 hours of indoor group physical-activity programs are held in the majority of weeks in a year; (g) a community recreational facility, not including a fitness club, in which at least 20 hours of indoor group physical-activity programs are held in the majority of weeks in a year; (h) a homeless shelter; (i) an airport passenger terminal, but only if the primary purpose of the passenger terminal is for its use as a location for passengers to gather before boarding or upon exiting an aircraft; (j) a train station, but only if the primary purpose of the premises is for its use as a location for passengers to gather before boarding or upon exiting a train, and not including any station on the Prairie Dog Central Railway or for a miniature or minimum gauge railway; (k) a bus station, but only if the primary purpose of the premises is for its use as a location for passengers to gather before boarding or upon exiting a bus, and not including an urban transit bus station; (l) a casino. 3(2) The following premises are classified as indoor designated premises: (a) MTS Centre (Winnipeg); (b) Centennial Concert Hall (Winnipeg); (c) Western Manitoba Centennial Auditorium (Brandon); (d) Manitoba Museum (Winnipeg); (e) Royal Winnipeg Ballet (380 Graham Avenue, Winnipeg); (f) Centre culturel franco-manitobain (Winnipeg); (g) Winnipeg Art Gallery; (h) Winnipeg Convention Centre; (i) Legislative Building; (j) Law Courts Building (Winnipeg); (k) Winnipeg City Hall; (l) Millennium Library (Winnipeg); (m) Brandon Court House; (n) Dauphin Court House; (o) The Pas Court House; (p) Morden Court House; (q) Minnedosa Court House; (r) Polo Park Shopping Centre (Winnipeg); (s) St. Vital Shopping Centre (Winnipeg); (t) Kildonan Place Shopping Centre (Winnipeg); (u) Portage Place (Winnipeg); (v) CityPlace (Winnipeg); (w) The Forks Market (Winnipeg); (x) Grant Park Shopping Centre (Winnipeg); (y) Garden City Shopping Centre (Winnipeg); (z) The Bay (450 Portage Avenue, Winnipeg). M.R. 115/2025 Outdoor designated premises 4 The following premises and classes of premises are classified as outdoor designated premises: Specifically-named outdoor premises (a) Investors Group Field (Winnipeg); (b) Shaw Park (Winnipeg); (c) all areas of Assiniboia Downs (including indoor areas) that are accessible to the public; (d) all areas of the Assiniboine Park Zoo (including indoor areas) that are accessible to the public; Classes of outdoor premises (e) golf courses (not including driving ranges or miniature golf courses). SCHEDULE B (subsection 5(2)) Assiniboine Park Zoo — specific requirements 1 The City of Winnipeg must ensure that defibrillators are installed at the Assiniboine Park Zoo, in accordance with the requirements of this regulation, at the following locations: (a) the main gate; (b) the International Polar Bear Conservation Centre; (c) the Asian Lion Building; (d) the Toucan Ridge Building; (e) the Tundra Grill; (f) the Kinsmen Discovery Centre. SCHEDULE C (section 9) Graphic symbol 1 For the purpose of section 9 of this regulation, the graphic symbol is as follows: SCHEDULE D (section 15) Monthly inspections 1 The owner of a defibrillator must inspect it at least once per month, with the following items, at a minimum, being part of the inspection: (a) its placement remains visible and unobstructed; (b) verify that no blinking light, chirping sound or other maintenance indicator is present; (c) the battery or batteries are properly installed, and in good working condition with clean electrodes; (d) no physical damage to the defibrillator is apparent; (e) the defibrillator is clean, with no unusual dirt or contamination apparent; (f) the following supplies are with, or adjacent to, the defibrillator: (i) two sets of defibrillator pads, that are not past their expiry date, in sealed packaging, (ii) if the particular model of defibrillator requires pediatric defibrillator pads for its effective use on a child, one set of pediatric defibrillator pads, that is not past its expiry date, in sealed packaging, (iii) pocket mask with one-way valve, (iv) medical examination gloves, (v) absorbent gauze or hand towels, (vi) scissors suitable for cutting through a patient's clothes, (vii) a razor suitable for shaving heavy chest hair.
