A18 Regulation 161/2003 Registered October 10, 2003 bilingual version (HTML) Definitions 1 In this regulation, "approved animal identification tag" means an approved tag, as defined in section 172 of the Health of Animals Regulations , C.R.C., c. 296, made under the Health of Animals Act (Canada), that is approved under that regulation to identify sheep for the purposes of Part XV (Animal Identification) of that regulation. (« étiquette d'identification des animaux approuvée ») "association" means The Manitoba Sheep Association Inc. (« Association ») "producer" means a person who produces and markets sheep in Manitoba. (« producteur ») "sheep" means adult and juvenile animals of the species Ovis aries that are bred or kept for wool, meat or milk production or for breed development. (« moutons ») "sheep products" means raw sheep's wool and unprocessed meat and milk produced from sheep. (« produits ovins ») Purpose 2 The purpose of this regulation is to enable the association to encourage, promote and assist in the development of sheep and production of sheep products in Manitoba. Designation 3 The Manitoba Sheep Association Inc. is designated as the representative organization of all producers of sheep and sheep products. Fees 4 Every producer must pay a fee of $1. to the association for each approved animal identification tag the producer buys. Payment of fees 5(1) Every producer who buys an approved animal identification tag must, in addition to the price of the tag, pay the seller $1. to be remitted to the association for the fee payable under section 4. 5(2) A person who sells approved animal identification tags to producers is authorized to provide the association, on request, with the names of producers who have bought tags at or during any particular time and with information about the quantity of tags sold to particular producers. Use of fees 6 The association is authorized to use the fees for the purpose of defraying the expenses of the organization in carrying out its purpose. Refunds 7(1) A producer may apply to the association for a refund of fees. 7(2) An application for a refund must be made in writing on a form provided by the association and must contain the information that the association requests. 7(3) An application for a refund must be received by the association (a) before August 1, for fees deducted in the six-month period beginning on the previous January 1 and ending on June 30; and (b) before February 1, for fees deducted in the six-month period beginning on the previous July 1 and ending on December 31. 7(4) If the application for a refund complies with this section, the association must make a refund (a) not later than March 31, for fees deducted in the six-month period beginning on the previous July 1 and ending on December 31; and (b) not later than September 30, for fees deducted in the six-month period beginning on the previous January 1 and ending on June 30. Books and records 8(1) Every purchaser of sheep produced or marketed in Manitoba must keep and maintain complete and accurate books and records respecting the purchase of sheep and provide copies of them when requested to do so by the agency. 8(2) Every producer must keep and maintain complete and accurate books and records respecting the sheep he or she produces and markets and must provide copies of the books and records to the agency when requested to do so by the agency. Information 9 The association must furnish to the agency such information and financial statements as the agency determines necessary to ensure that the fees paid to the association are properly used for the purpose of the association. Coming into force 10 This regulation comes into force on September 1, 2003 or the day it is registered under The Regulations Act , whichever is later.
