Winnipeg Police Service Special Constables Additional Powers Regulation
This regulation gives Winnipeg Police Service cadets and river patrol officers certain enforcement powers and duties, but only when they are appointed as special constables and directed by the responsible police supervisor.

"cadet" means a member of the Winnipeg Police Service Auxiliary Force Cadet program. (« cadet ») "Charter" means The City of Winnipeg Charter. («  Charte  ») "river patrol officer" means a member of the Winnipeg Police Service River Patrol Unit. (« patrouilleur fluvial ») M.R. 129/2018 Cadets granted additional powers 2(1) Subject to subsection (2), cadets who have been appointed as special constables under subsection 176(2) of the Charter are authorized to enforce the enactments set out in section 3 and perform the duties and exercise the powers set out in section 4. Restrictions 2(2) A cadet may exercise the additional powers set out in subsection (1) only if the member of the Winnipeg Police Service in charge of the cadet program has specifically directed the cadet to exercise those powers and the cadet complies with any restrictions or conditions relating to the exercise of those powers imposed by that member. Additional enforcement powers 3 A cadet is authorized to enforce the following enactments: (a) sections 75, 119, 124.5, 138, 147, 213.2 and 222 and subsections 88(2), 139(2), 140(1) and (2), 141(5), 143(1) and (2), 145(1) to (4), (6) and (8), 213.1(1) and 221(1) of The Highway Traffic Act ; (b) subsection 28(1) of The Off-Road Vehicles Act ; (c) sections 60, 63, 101.17 and 101.18 and subsections 57(1), 62(1), 75(4) and (5) of The Liquor, Gaming and Cannabis Control Act ; (d) subsections 2(1) and (1.1) and section 5.2 of The Smoking and Vapour Products Control Act ; (e) subsection 1(1) of The Trespass Act . M.R. 129/2018 ; 2/2024 Additional duties and powers 4 A cadet is authorized to perform the following duties and exercise the following powers: (a) directing traffic under section 76 of The Highway Traffic Act ; (b) [repealed] M.R. 104/2025 ; (c) staying with a person taken into custody by a member of the Winnipeg Police Service for an involuntary medical examination or an involuntary psychiatric assessment at a medical facility designated under the Facilities Designation Regulation , Manitoba Regulation 135/99, until the examination or assessment is completed or the person is admitted under subsection 15(1) of The Mental Health Act ; (d) [repealed] M.R. 2/2024 . M.R. 129/2018 ; 2/2024 ; 104/2025 Restrictions 5 A cadet who exercises additional powers under this regulation is subject to the following restrictions: (a) the cadet may exercise the additional powers only within the City of Winnipeg; (b) the cadet may exercise the additional powers only when he or she is on duty; (c) the cadet must not engage in the vehicular pursuit of a person suspected of committing an offence under an enactment referred to in section 3. Additional powers of river patrol officers 6(1) Subject to subsection (2), river patrol officers who have been appointed as special constables under subsection 176(2) of the Charter are authorized to enforce the enactments set out in section 7 and perform the duties and exercise the powers set out in section 8. Restrictions 6(2) A river patrol officer may exercise the additional powers set out in subsection (1) only if the member of the Winnipeg Police Service in charge of the River Patrol Unit has directed the officer to exercise those powers and the officer complies with any restrictions or conditions relating to the exercise of those powers imposed by that member. M.R. 129/2018 Additional enforcement powers 7 A river patrol officer is authorized to enforce the following enactments: (a) subsections 173(1) and (2), 225(1) and (1.1) of The Highway Traffic Act ; (b) sections 63, 101.17 and 101.18 and subsections 57(1), 61(1), 62(1), 75(4) and (5) and 101.26(1) of The Liquor, Gaming and Cannabis Control Act ; (c) subsections 3(1) and (2) of The Minors Intoxicating Substances Control Act ; (d) all prohibitions and requirements set out in The Off-Road Vehicles Act ; (e) section 5.2 of The Smoking and Vapour Products Control Act . M.R. 129/2018 Additional duties and powers 8 A river patrol officer is authorized to perform the following duties and exercise the following powers: (a) stopping vehicles under subsection 76.1(1) of The Highway Traffic Act ; (b) requiring production of information and documentation under clauses 76.1(4)⁠(a) to (c) of The Highway Traffic Act ; (c) stopping off-road vehicles under subsections 22(5) and 30.1(2) of The Off-Road Vehicles Act ; (d) [repealed] M.R. 104/2025 . M.R. 129/2018 ; 104/2025 Restrictions 9 A river patrol officer who exercises additional powers under this regulation is subject to the following restrictions: (a) the officer may exercise the additional powers only within the City of Winnipeg; (b) the officer may exercise the additional powers only when the officer is on duty; (c) the officer must not engage in the vehicular pursuit of a person suspected of committing an offence under an enactment referred to in section 7.
