"Act" means The Water Protection Act . («  Loi  ») "anti-fouling paint" means a paint that is treated with biocides or other products that are intended to prevent the attachment of organisms or slow the growth of organisms. (« peinture antisalissure ») "aquatic plant" means a plant that grows in water, saturated soils or seasonally saturated soils, and includes algae. (« plante aquatique ») "bait" means a live or dead organism that is placed on a hook or in a trap to lure or entice fish. (« appât ») "commercial bait dealer" means the holder of a commercial live bait dealer licence. (« vendeur d'appâts ») "commercial bait harvester" means the holder of (a) a commercial bait fish fishing licence; or (b) a commercial leech harvesting licence. (« personne qui prend des appâts ») "control zone" means a control zone established under Part 3. (« zone réglementée ») "department" means the department of government over which the minister presides. (« ministère ») 1(2) The following items are prescribed as water-related equipment: (a) anchors; (b) buoys; (c) ropes and cables used to moor watercraft and aircraft; (d) fish finders and other sonar equipment; (e) scientific equipment used to take water samples or take measurements in water; (f) towels, cloths or other items used to wipe or dry a conveyance or water related equipment; (g) any type of pump used to remove or move water from a container, float, pontoon or water body; (h) construction equipment and industrial equipment that is used in a water body. 1(3) For the purposes of this regulation, (a) a watercraft is completely dry if (i) there is no detectable water on the exterior or interior surfaces of the watercraft, and (ii) no dampness can be felt on the interior of the watercraft; and (b) water-related equipment is completely dry if there is no detectable water on the equipment and no dampness can be felt on the equipment. M.R. 52/2017 Aquatic invasive species 2(1) The species set out in Schedule A to this regulation are designated as aquatic invasive species. 2(2) A reference in this regulation to an aquatic invasive species by its common name set out in Column 2 of Schedule A is to be read as a reference to the scientific name of that species that is set out in Column 3 of Schedule A. M.R. 52/2017 PART 2 GENERAL PROVISIONS Watercraft requirements 3(1) Before placing a watercraft into a water body, a person must inspect the watercraft and (a) ensure that the watercraft is free of aquatic invasive species, aquatic plants and mud; and (b) remove any standing water from the watercraft and dispose of that water on land so that it does not drain into a water body. 3(2) When a person removes a watercraft from a water body, he or she must (a) inspect the watercraft and remove any aquatic invasive species and aquatic plants from the watercraft, unless the person has obtained a transportation authorization under section 9; (b) remove or open all drain plugs on the watercraft and all valves or other devices used to drain water from the watercraft, other than plugs used in kitchen or washroom facilities on the watercraft; (c) if the watercraft has an outboard motor or an inboard/outboard motor, drain all water from the motor; (d) if the watercraft has ballast tanks, drain all water from the ballast tanks; and (e) drain all water from live wells and other compartments that may collect water; before the watercraft is transported away from the shore of the water body. 3(3) When transporting a watercraft on land, a person must (a) ensure that the drain plug and all valves or other devices used to drain water from the watercraft are removed or left open, other than plugs used in kitchen or washroom facilities on the watercraft; and (b) ensure that the motor vehicle and any trailer transporting the watercraft are free of aquatic invasive species and aquatic plants. Exception to watercraft requirements 4(1) Subject to subsection (2), the requirements of section 3 do not apply when (a) a watercraft is removed from a water body and left on the shore, or in close proximity to the same water body from which the watercraft was removed; and (b) the watercraft is not moved from the area referred to in clause (a) before it is placed in the same water body at the same access point where it was removed from the water body. 4(2) Despite subsection (1), a person must remove any aquatic invasive species from a watercraft before placing it into a water body or removing it from a water body. Motor vehicle requirements 5 Before a motor vehicle enters a water body, the operator of the vehicle must inspect the vehicle and ensure that it is free of aquatic invasive species, aquatic plants and mud . Aircraft requirements 6(1) Immediately before taking off from a water body, the operator of an aircraft must inspect the aircraft and remove all aquatic invasive species, aquatic plants and mud from the aircraft's cables, wires, ropes and anchor, and the aircraft's floats or pontoons. 6(2) If water is drained from the float or pontoon of an aircraft, the water must be collected in a container and disposed on land so that it does not drain into a water body. Water-related equipment requirements 7(1) Before placing water-related equipment into a water body, a person must inspect the equipment and (a) ensure that it is free of aquatic invasive species, aquatic plants and mud; and (b) remove any standing water from the equipment and dispose of that water on land so that it does not drain into a water body. 7(2) When a person removes water-related equipment from a water body, he or she must (a) inspect the equipment and remove all aquatic invasive species and aquatic plants from the equipment, unless the person has obtained a transportation authorization under section 9; and (b) drain all water from the equipment, except as permitted under subsection (4); before the equipment is transported away from the shore of the water body. 7(3) When water-related equipment has been removed from a water body, a person must not place the equipment into another water body (a) unless the equipment is completely dry; or (b) it has been decontaminated (i) in accordance with Schedule B, in the case of a dock, boat lift or trailer for watercraft, or (ii) in accordance with Schedule C, in the case of any other water-related equipment. 7(4) Clause (2)⁠(b) does not apply when water is removed from a water body in a water tank, water-hauling equipment or water-testing equipment. Exception to requirements re water-related equipment 8(1) Subject to subsection (2), the requirements of section 7 do not apply when (a) water-related equipment is removed from a water body and left on the shore, or in close proximity to the same water body from which the equipment was removed; and (b) the equipment is not moved from the area referred to in clause (a) before it is placed in the same water body at the same access point where it was removed from the water body. 8(2) Despite subsection (1), a person must remove any aquatic invasive species from water-related equipment before placing it into a water body or removing it from a water body. Transportation authorization 9(1) A person may obtain a written authorization from the department that authorizes the person to transport a watercraft or water-related equipment that contains aquatic invasive species from a water body for decontamination at a different location. 9(2) A transportation authorization must contain the following information: (a) the location of the watercraft or water-related equipment; (b) the location where the person will transport the watercraft or water-related equipment for decontamination; (c) the deadline for the watercraft or water-related equipment to be decontaminated. 9(3) Department officials may impose such terms and conditions on a transportation authorization that they consider appropriate in order to prevent the spread of an aquatic invasive species. 9(4) A person who holds an authorization (a) must have the authorization in his or her possession at all times until the watercraft or water-related equipment has been decontaminated; (b) must comply with all terms and conditions imposed on the authorization; and (c) must not place the watercraft or water-related equipment in a water body until it has been decontaminated in accordance with this regulation or in the manner specified in the authorization. 9(5) A person who holds an authorization does not contravene the Act or a provision of this regulation if (a) he or she transports the watercraft or water-related equipment in accordance with all terms and conditions of the authorization; and (b) the watercraft or water-related equipment is decontaminated by the deadline set out in the authorization. M.R. 52/2017 Reporting requirement 10(1) Subject to subsection (2), a person who discovers an aquatic invasive species in Manitoba must notify the AIS director as soon as practicable and provide all information he or she has about it. 10(2) Except as provided in subsection (3), a person is not required to notify the AIS director if he or she discovers an aquatic invasive species in a control zone that has been established for that species. 10(3) A person must notify the AIS director if the person discovers (a) a zebra mussel or a spiny waterflea in the Saskatchewan River/Cedar Lake Control Zone; or (b) a zebra mussel in the Lake Manitoba/Fairford River/Lake St. Martin Control Zone. M.R. 52/2017 ; 49/2023 Duties of commercial bait harvester 11(1) Before leaving the shore of the water body, a commercial bait harvester who has harvested live bait must remove the bait from a container holding water from the water body in which the bait was harvested and transfer it to a separate container that contains only potable water or ground water. 11(2) A commercial bait harvester may sell bait to an individual or a commercial bait dealer only if the bait is sold in a container or receptacle that contains only potable water or ground water. M.R. 52/2017 Duties of commercial bait dealers 12 A commercial bait dealer must (a) store live bait in a container or receptacle that contains only potable water or ground water; and (b) sell live bait in a container or receptacle that contains only potable water or ground water. PART 3 CONTROL ZONES Red River/Lake Winnipeg/Nelson River Control Zone 13(1) The Red River/Lake Winnipeg/Nelson River Control Zone consists of the following: (a) the portion of the Red River from the United States border to its entry into Lake Winnipeg, as well as the Red River Floodway and all associated channels and outlets; (b) the portion of the Assiniboine River from immediately below the Portage la Prairie control structure to its confluence with the Red River; (c) Lake Winnipeg; (d) the portion of the Winnipeg River from the Pine Falls generating station to its entry into Lake Winnipeg; (e) the portion of the Saskatchewan River from the Grand Rapids generating station to its entry into Lake Winnipeg; (f) the Nelson River from Lake Winnipeg to its entry into Hudson Bay, including all lakes, rivers, channels and other water bodies through which the Nelson River passes; (g) Kiskitto Lake; (h) Kiskittogisu Lake; (i) Scatch Lake; (j) Goose Hunting Lake; (k) Cauchon Lake; (l) Prud'homme Lake; (m) Archibald Lake; (n) Bruneau Lake; (o) Bulger Lake; (p) Walker Lake; (q) Drunken Lake; (r) Hill Lake; (s) the portion of each tributary that flows into a water body set out in any of clauses (a) to (r), from the mouth of the tributary to the point upstream at which the tributary is not navigable. 13(2) The Red River/Lake Winnipeg/Nelson River Control Zone is established for the purpose of controlling the spread of zebra mussels and spiny waterflea. M.R. 52/2017 ; 49/2023 Betula Lake/White Lake/Jessica Lake Control Zone 14(1) The Betula Lake/White Lake/Jessica Lake Control Zone consists of the following: (a) Betula Lake; (b) White Lake; (c) Jessica Lake; (d) the portion of the Whiteshell River from Jessica Lake downstream to the bridge crossing at emergency road 31. 14(2) The Betula Lake/White Lake/Jessica Lake Control Zone is established for the purpose of controlling the spread of black algae. M.R. 52/2017 ; 49/2023 Lake of the Woods (Buffalo Bay) Control Zone 15(1) The Lake of the Woods (Buffalo Bay) Control Zone consists of (a) the portion of Lake of the Woods that is located in Manitoba; and (b) the portion of each tributary that flows into the waters set out in clause (a), from the mouth of the tributary to the point upstream at which the tributary is not navigable. 15(2) The Lake of the Woods (Buffalo Bay) Control Zone is established for the purpose of controlling the spread of spiny waterflea. M.R. 52/2017 ; 49/2023 Winnipeg River Control Zone 16(1) The Winnipeg River Control Zone consists of (a) the portion of the Winnipeg River from the Ontario border to the Pine Falls generating station, including all lakes, rivers, channels and other water bodies through which that portion of the Winnipeg River passes; (b) the Lee River; (c) Lac du Bonnet; (d) the Pinawa Channel; (e) the portion of Bird River from its entry into Lac du Bonnet upstream to the rapids at Bird River Canyon Trail; and (f) the portion of each tributary that flows into a water body set out in any of clauses (a) to (e), from the mouth of the tributary to the point upstream at which the tributary is not navigable. 16(2) The Winnipeg River Control Zone is established for the purpose of controlling the spread of spiny waterflea. M.R. 52/2017 ; 49/2023 16.1 [Repealed] M.R. 52/2017 ; 49/2023 Saskatchewan River/Cedar Lake Control Zone 16.2(1) The Saskatchewan River/Cedar Lake Control Zone consists of the following: (a) the portion of the Saskatchewan River from the Saskatchewan border to the Grand Rapids generating station, including all lakes, rivers, channels and other water bodies through which that portion of the Saskatchewan River passes; (b) Cedar Lake; (c) South Moose Lake; (d) North Moose Lake; (e) East Moose Lake; (f) Red Earth Lake; (g) Driftwood Lake; (h) Traders Lake; (i) the portion of each tributary that flows into a water body set out in any of clauses (a) to (h), from the mouth of the tributary to the point upstream at which the tributary is not navigable. 16.2(2) The Saskatchewan River/Cedar Lake Control Zone is established for the purpose of controlling the spread of zebra mussels and spiny waterflea. M.R. 52/2017 ; 49/2023 Shoal Lake Control Zone 16.3(1) The Shoal Lake Control Zone consists of (a) any portion of Shoal Lake (which straddles the Ontario border) that is located in Manitoba; and (b) the portion of each tributary that flows into the waters set out in clause (a), from the mouth of the tributary to the point upstream at which the tributary is not navigable. 16.3(2) The Shoal Lake Control Zone is established for the purpose of controlling the spread of spiny waterflea. M.R. 49/2023 Lake Manitoba/Fairford River/Lake St. Martin Control Zone 16.4(1) The Lake Manitoba/Fairford River/Lake St. Martin Control Zone consists of the following: (a) Lake Manitoba; (b) Ebb and Flow Lake; (c) the Fairford River from Lake Manitoba to its entry into Lake St. Martin, including the Branching River and Pineimuta Lake; (d) Lake St. Martin; (e) the portion of Dauphin River from Lake St. Martin to the point at which it is no longer navigable below its confluence with Buffalo Creek; (f) the portion of each tributary that flows into the waters set out in clauses (a) to (e), from the mouth of the tributary to the point upstream at which the tributary is not navigable, excluding those portions of the Waterhen River upstream of the bridge crossing at Provincial Road 328. 16.4(2) The Lake Manitoba/Fairford River/Lake St. Martin Control Zone is established for the purpose of controlling the spread of zebra mussels. M.R. 49/2023 Watercraft decontamination in control zones 17(1) When a watercraft has been removed from a water body in a control zone, a person must not place the watercraft into a water body outside of that control zone unless (a) the watercraft has been decontaminated at a control station; (b) the watercraft has been decontaminated by a certified service provider; or (c) the watercraft has been decontaminated in accordance with Schedule B and the watercraft is completely dry immediately before it is placed into the other water body. 17(2) For greater certainty, subsection (1) does not apply when a watercraft travels directly from one water body to another water body without being removed from the water at any point. M.R. 49/2023 Water-related equipment decontamination 18 When water-related equipment has been removed from a water body in a control zone, a person must not place the equipment into a water body outside of that control zone unless (a) the equipment has been decontaminated at a control station; (b) the equipment has been decontaminated by a certified service provider; or (c) the equipment has been decontaminated (i) in accordance with Schedule B, in the case of a dock, boat lift or trailer for watercraft, or (ii) in accordance with Schedule C, in the case of any other water-related equipment; and the equipment is completely dry immediately before it is placed into the other water body. M.R. 49/2023 Requirement to use anti-fouling paint on aircraft 19 An aircraft must not land in water in the following control zones: (a) the Red River/Lake Winnipeg/Nelson River Control Zone; (b) the Saskatchewan River/Cedar Lake Control Zone; (c) the Lake Manitoba/Fairford River/Lake St. Martin Control Zone; unless the surfaces of the aircraft that come into contact with water have been treated with anti-fouling paint that is maintained in good condition. M.R. 52/2017 ; 49/2023 Disposal of bait in control zone 20 A person who possesses bait in a control zone must discard any remaining bait on land before he or she leaves the shore of the water body. M.R. 52/2017 Restrictions on water removed from control zone 21 A person who removes water from a water body in a control zone must not discharge that water into another water body or within 30 metres of another water body. Application 22 The requirements of this Part are in addition to any other applicable requirements imposed by this regulation, including the requirements set out in sections 3, 5, 6 and 7. PART 4 MISCELLANEOUS PROVISIONS Exception for emergency service providers 23 Sections 3, 5, 6, 7, 17 and 18 do not apply to emergency service providers while responding to an emergency. Control station signs 24 A control station must be identified by a sign bearing the wording "INSPECTION STATION ALL WATERCRAFT MUST REPORT". M.R. 52/2017 Serving orders 25(1) A control order or a decontamination order may be served on a person (a) by personal service; or (b) by mail in a manner that provides the sender with an acknowledgement of receipt. 25(2) A decontamination order may be served by posting a copy of the order on the conveyance or water-related equipment that is the subject of the order. 25(3) A decontamination order served in accordance with subsection (2) is deemed to have been served three days after the day it is posted. Certified service providers 26(1) For the purpose of clause 29.16(3)⁠(a) of the Act, an applicant for certification and all of his or her employees who clean or treat watercraft or water-related equipment must have completed a training course provided by the department or a person that has been approved by the AIS director. 26(2) For the purpose of clauses 29.16(3)⁠(b) and (c) of the Act, an applicant for certification must demonstrate that (a) he or she has the equipment necessary to decontaminate watercraft and water-related equipment in accordance with Schedules B and C; and (b) appropriate measures are in place to prevent the discharge of effluent water into a water body. Exceptions to prohibitions re aquatic invasive species 27(1) A person does not contravene the Act or a provision of this regulation if (a) his or her conduct is permitted under the Aquatic Invasive Species Regulations , SOR/2015-121, made under the Fisheries Act (Canada); (b) he or she is the AIS director or an officer or inspector or is acting under their direction; (c) he or she transports an aquatic invasive species in a sealed container to the AIS director, an officer or an inspector for the purpose of identifying the species or reporting the presence of the species; (d) he or she catches a member of an aquatic invasive species in a control zone while fishing and immediately returns it to the water body from which it was caught; or (e) he or she removes an aquatic invasive species from a conveyance or water-related equipment and immediately disposes of it on land in a manner that ensures that it will not end up in a water body. 27(1.1) A person does not contravene the Act or a provision of this regulation if a member of an aquatic invasive species is found on the person's watercraft or water-related equipment in a control zone that has been established for that species (a) while the watercraft or water-related equipment is in a water body; or (b) while the watercraft or water-related equipment is on the shore of a water body after having been removed from the water body, as long as the watercraft or equipment is not transported away from the shore. 27(1.2) A person does not contravene the Act or a provision of this regulation if he or she is involved in the possession or transport of a member of an aquatic invasive species if the member is in the condition, if any, set out in Column 4 of Schedule A. 27(2) The requirements of this regulation do not apply to a person who holds a permit issued by the Government of Manitoba that authorizes the possession or handling of live fish if compliance with the requirements would result in death or injury to the fish. M.R. 52/2017 Exemptions 27.1(1) The AIS director may issue a written authorization that exempts a person from complying with one or more of the requirements of a provision of this regulation. 27.1(2) An authorization may be subject to terms, conditions and time or geographic restrictions set out in the authorization. 27.1(3) A person does not contravene a provision of this regulation set out in the authorization as long as he or she complies with all terms, conditions and restrictions set out in the authorization. M.R. 52/2017 Coming into force 28 This regulation comes into force on the same day that The Water Protection Amendment Act (Aquatic Invasive Species) , S.M. 2015, c. 7, comes into force.
