This regulation bans using petroleum coke and later coal for space heating, with limited extensions and conversion-plan exceptions.

"conversion plan" means a plan to switch from coal or petroleum coke as the energy source for space heating purposes to an alternate energy source. (« plan de conversion ») "person" includes a partnership and an unincorporated association or organization. (« personne ») 1(2) For the purposes of this regulation, coal or petroleum coke is used as the energy source for space heating purposes if it is used to power a device, appliance or system that heats any part of an enclosed structure. Coal and petroleum coke ban for space heating 2(1) A person must not use petroleum coke as an energy source for space heating purposes after December 31, 2013. 2(2) Except as provided in this regulation, a person must not use coal as an energy source for space heating purposes after June 30, 2014. Extension for conversion plan submission 3(1) A person may use coal as an energy source for space heating purposes until June 30, 2017 if he or she has submitted a conversion plan that meets the requirements of section 4 to the director by June 30, 2014. 3(2) If there is a change in the ownership of a property, the new owner may continue to use coal as an energy source for space heating purposes until June 30, 2017 if, within three months after becoming owner, he or she (a) submits a conversion plan to the director that meets the requirements of section 4; or (b) advises the director in writing that he or she is adopting the conversion plan submitted by the previous owner. 3(3) The director may, by written notice, extend the time for a person to submit a conversion plan if he or she is satisfied that it is appropriate to do so in the circumstances. If an extension is given, the person may continue to use coal as an energy source for space heating purposes until June 30, 2017 if he or she submits a conversion plan that meets the requirements of section 4 by the deadline set out in the extension. Conversion plan requirements 4(1) A conversion plan must (a) identify the alternate energy source the person proposes to use for space heating purposes; (b) provide details on how the person will switch to the alternate energy source, such as identifying the equipment the person will purchase in order to use the alternate energy source or the modifications the person proposes to make to existing equipment in order to use the alternate energy source; (c) set out proposed timelines for converting to an alternate energy source; and (d) provide details on the amount of coal or petroleum coke used by the person for space heating purposes for the previous five years. 4(2) The person submitting a conversion plan must provide any additional information or documentation requested by the director in relation to the proposed conversion or past use of coal or petroleum coke. Extension 5(1) The director may, by written notice, authorize a person to use coal as an energy source for space heating purposes after June 30, 2017 if he or she is satisfied that (a) the person has used his or her best efforts to convert to an alternate fuel source by that deadline but, due to circumstances beyond his or her control, it was not possible to convert to an alternate fuel by that date; or (b) due to unforeseen circumstances, it is appropriate to allow the person to use coal as an energy source for space heating purposes for a limited period. 5(2) The notice of extension must specify the period when the person is authorized to use coal as an energy source for space heating purposes, and the person may use coal as an energy source for space heating purposes during that period. 5(3) The director may issue an extension on request by a person or on his or her own initiative.
