Regulated Health Professions General Regulation
This regulation defines key terms and lists when certain reserved acts are exempt from being a contravention of the Act, including acupuncture-related tissue procedures, male circumcision, transplant tissue removal, several medical technologist practices, some non-certified health care practice in approved settings, school psychologists, medical geneticists, first responders, and certain corporate practice rules.

"Act" means The Regulated Health Professions Act . («  Loi  ») "competent" , in relation to the performance of a reserved act, means that a person has the requisite knowledge, skill and judgment to perform that act. (« compétent ») 1(2) A reference to a reserved act in this regulation is a reference to the reserved act listed in section 4 of the Act. Defined terms for the Act and regulations 2 The following definitions apply for the purpose of Part 2 (Reserved Acts) of the Act and the regulations under it. "drug" means the substances and mixtures of substances (other than vaccines) listed in Schedule 1, 2 or 3 of the manual. (« médicament ») "manual" means the manual for Canada's National Drug Scheduling System, published by the National Association of Pharmacy Regulatory Authorities (NAPRA), as amended from time to time. (« manuel ») "vaccine" means (a) a vaccine listed in Schedule 1 or 2 of the manual; or (b) a vaccine or biologic used in the government's provincial immunization program. (« vaccin ») Exception — naloxone hydrochloride 2.1 Despite the definition "drug" in section 2, the following are not drugs for the purpose of Part 2 of the Act and the regulations under it: (a) naloxone hydrochloride injection, when indicated for emergency use for opioid overdose; (b) naloxone hydrochloride nasal spray, when indicated for emergency use for opioid overdose. M.R. 135/2020 EXEMPTIONS — RESERVED ACTS Acupuncture 3 The act of performing a procedure on tissue below the dermis is not a contravention of subsection 5(1) of the Act if it is done in the course of providing acupuncture. Male circumcision 4 An act done by a person in the course of performing the reserved acts necessary for male circumcision is not a contravention of subsection 5(1) of the Act if it is done in the course of a religious ceremony or tradition. Transplant surgeons 5 An act done by a person in the course of performing the reserved acts necessary for the removal of tissues and organs for transplant purposes is not a contravention of subsection 5(1) of the Act if the person meets each of the following requirements: (a) the person is a transplant surgeon who is authorized to engage in the practice of medicine in another jurisdiction in Canada or the United States; (b) the person is registered with the Winnipeg Regional Health Authority; (c) the person performs the reserved acts in a facility that is designated as a hospital under The Health Services Insurance Act or a hospital or health care facility operated by the government, the Government of Canada or a municipal government. Registered technologists in nuclear medicine 6(1) An act done by a person in the course of performing a reserved act listed in subsection (2) is not a contravention of subsection 5(1) of the Act if the person meets each of the following requirements: (a) the person is a member of the Manitoba chapter of the Canadian Association of Medical Radiation Technologists; (b) the person is certified by the Canadian Association of Medical Radiation Technologists as a registered technologist in nuclear medicine; (c) the person is ordered to perform the reserved act by a member of a regulated health profession who is authorized to perform the reserved act; (d) the person performs the reserved act (i) in a facility that is designated as a hospital under The Health Services Insurance Act , (ii) in a hospital or health care facility operated by the government, the Government of Canada or a municipal government, (iii) in a facility at which diagnostic or treatment services are performed and which is accredited by the College of Physicians and Surgeons of Manitoba, or (iv) at a fixed site where health care is customarily provided. 6(2) The following reserved acts are listed for the purpose of subsection (1): reserved act 3(a): performing a procedure on tissue below the dermis for the purpose of venipuncture and other skin punctures reserved act 4(d): inserting or removing an instrument or a device, hand or finger beyond the opening of the urethra for the purpose of administering diagnostic examinations in nuclear medicine reserved act 5(a): administering a radiopharmaceutical by injection for diagnostic, imaging and therapeutic purposes reserved act 5(b): administering a radiopharmaceutical by inhalation for diagnostic, imaging and therapeutic purposes reserved act 5(d): administering a radiopharmaceutical by irrigation for diagnostic, imaging and therapeutic purposes reserved act 9: administering a drug but only if ordered to do so by a nuclear medicine physician reserved act 10(e): applying X-rays or other ionizing radiation for diagnostic, imaging or therapeutic purposes, including computerized axial tomography, positron emission tomography and radiation therapy 6(3) A person who is training to be certified as a registered technologist in nuclear medicine may perform the reserved acts referred to in subsection (2) without contravening subsection 5(1) of the Act only if he or she (a) meets the requirements set out in clauses (1)⁠(a), (c) and (d); and (b) performs the act under the supervision and direction of a person who meets each of the requirements set out in subsection (1). M.R. 115/2025 Registered technologists in radiological technology 7(1) An act done by a person in the course of performing a reserved act listed in subsection (2) is not a contravention of subsection 5(1) of the Act if the person meets each of the following requirements: (a) the person is a member of the Manitoba chapter of the Canadian Association of Medical Radiation Technologists; (b) the person is certified by the Canadian Association of Medical Radiation Technologists as a registered technologist in radiological technology; (c) the person is ordered to perform the reserved act by a member of a regulated health profession who is authorized to perform the reserved act; (d) the person performs the reserved act (i) in a facility that is designated as a hospital under The Health Services Insurance Act , (ii) in a hospital or health care facility operated by the government, the Government of Canada or a municipal government, (iii) in a facility at which diagnostic or treatment services are performed and which is accredited by the College of Physicians and Surgeons of Manitoba, or (iv) at a fixed site where health care is customarily provided. 7(2) The following reserved acts are listed for the purpose of subsection (1): reserved act 3(a): performing a procedure on tissue below the dermis for the purpose of venipuncture reserved act 4(d): inserting or removing an instrument or device, hand or finger beyond the opening of the urethra for the purpose of administering diagnostic examinations in medical radiography reserved act 4(f): inserting or removing an instrument or a device, hand or finger beyond the anal verge for the purpose of administering diagnostic examinations in medical radiography reserved act 4(g): inserting or removing an instrument or a device, hand or finger into an artificial opening in the body for the purpose of administering diagnostic examinations in medical radiography reserved act 5(a): administering contrast media by injection for the purpose of conducting diagnostic scans and imaging of body tissue reserved act 10(d): applying other non-ionizing radiation for the purpose of medical imagery reserved act 10(e): applying X-rays or other ionizing radiation for diagnostic, imaging or therapeutic purposes, including computerized axial tomography but not including positron emission tomography and radiation therapy 7(3) A person who is training to be certified as a registered technologist in radiological technology may perform the reserved acts referred to in subsection (2) without contravening subsection 5(1) of the Act only if he or she (a) meets the requirements set out in clauses (1)⁠(a), (c) and (d); and (b) performs the act under the supervision and direction of a person who meets each of the requirements set out in subsection (1). M.R. 115/2025 Registered technologists in magnetic resonance 8(1) An act done by a person in the course of performing a reserved act listed in subsection (2) is not a contravention of subsection 5(1) of the Act if the person meets each of the following requirements: (a) the person is a member of the Manitoba chapter of the Canadian Association of Medical Radiation Technologists; (b) the person is certified by the Canadian Association of Medical Radiation Technologists as a registered technologist in magnetic resonance; (c) the person is ordered to perform the reserved act by a member of a regulated health profession who is authorized to perform the reserved act; (d) the person performs the reserved act (i) in a facility that is designated as a hospital under The Health Services Insurance Act , (ii) in a hospital or health care facility operated by the government, the Government of Canada or a municipal government, (iii) in a facility at which diagnostic or treatment services are performed and which is accredited by the College of Physicians and Surgeons of Manitoba, or (iv) at a fixed site where health care is customarily provided. 8(2) The following reserved acts are listed for the purpose of subsection (1): reserved act 3(a): performing a procedure on tissue below the dermis for the purpose of venipuncture reserved act 4(d): inserting or removing an instrument or a device, hand or finger beyond the opening of the urethra for the purpose of conducting diagnostic scans and imaging of body tissue reserved act 4(f): inserting or removing an instrument or a device, hand or finger beyond the anal verge for the purpose of conducting diagnostic scans and imaging of body tissue reserved act 5(a): administering contrast media by injection for the purpose of conducting diagnostic scans and imaging of body tissue reserved act 10(c): applying electromagnetism for magnetic resonance imaging 8(3) A person who is training to be certified as a registered technologist in magnetic resonance may perform the reserved acts referred to in subsection (2) without contravening subsection 5(1) of the Act only if he or she (a) meets the requirements set out in clauses (1)⁠(a), (c) and (d); and (b) performs the act under the supervision and direction of a person who meets each of the requirements set out in subsection (1). M.R. 115/2025 Registered technologists in radiation therapy 9(1) An act done by a person in the course of performing a reserved act listed in subsection (2) is not a contravention of subsection 5(1) of the Act if the person meets each of the following requirements: (a) the person is a member of the Manitoba chapter of the Canadian Association of Medical Radiation Technologists; (b) the person is certified by the Canadian Association of Medical Radiation Technologists as a registered technologist in radiation therapy; (c) the person is ordered to perform the reserved act by a member of a regulated health profession who is authorized to perform the reserved act; (d) the person performs the reserved act (i) in a facility that is designated as a hospital under The Health Services Insurance Act , (ii) in a hospital or health care facility operated by the government, the Government of Canada or a municipal government, (iii) in a facility at which diagnostic or treatment services are performed and which is accredited by the College of Physicians and Surgeons of Manitoba, or (iv) at a fixed site where health care is customarily provided. 9(2) The following reserved acts are listed for the purpose of subsection (1): reserved act 3(a): performing a procedure on tissue below the dermis for the purpose of venipuncture reserved act 4(a): inserting or removing an instrument or a device, hand or finger into the external ear canal for the purpose of radiation treatment reserved act 4(c): inserting or removing an instrument or a device, hand or finger beyond the pharynx for the purpose of radiation treatment reserved act 4(d): inserting or removing an instrument or a device, hand or finger beyond the opening of the urethra for the purpose of radiation treatment reserved act 4(e): inserting or removing an instrument or a device, hand or finger beyond the labia majora for the purpose of radiation treatment reserved act 4(f): inserting or removing an instrument or a device, hand or finger beyond the anal verge for the purpose of radiation treatment reserved act 4(g): inserting or removing an instrument or a device, hand or finger into an artificial opening in the body for the purpose of radiation treatment reserved act 5(a): administering contrast media by injection for the purpose of conducting diagnostic scans and imaging of body tissue reserved act 10(d): applying other non-ionizing radiation for the purpose of medical imagery reserved act 10(e): applying X-rays or other ionizing radiation for diagnostic, imaging or therapeutic purposes, including computerized axial tomography and radiation therapy but not including positron emission tomography 9(3) A person who is training to be certified as a registered technologist in radiation therapy may perform the reserved acts referred to in subsection (2) without contravening subsection 5(1) of the Act only if he or she (a) meets the requirements set out in clauses (1)⁠(a), (c) and (d); and (b) performs the act under the supervision and direction of a person who meets each of the requirements set out in subsection (1). M.R. 115/2025 Registered diagnostic medical sonographers 10(1) An act done by a person in the course of performing a reserved act listed in subsection (2) is not a contravention of subsection 5(1) of the Act if the person meets each of the following requirements: (a) the person is a member of the Canadian Association of Registered Diagnostic Ultrasound Professionals or the American Registry for Diagnostic Medical Sonography; (b) the person is registered as a diagnostic medical sonographer with the Canadian Association of Registered Diagnostic Ultrasound Professionals or the American Registry for Diagnostic Medical Sonography; (c) the person is ordered to perform the reserved act by a member of a regulated health profession who is authorized to perform the reserved act; (d) the person performs the reserved act (i) in a facility that is designated as a hospital under The Health Services Insurance Act , (ii) in a hospital or health care facility operated by the government, the Government of Canada or a municipal government, (iii) in a facility at which diagnostic or treatment services are performed and which is accredited by the College of Physicians and Surgeons of Manitoba, or (iv) at a fixed site where health care is customarily provided. 10(2) The following reserved acts are listed for the purpose of subsection (1): reserved act 4(e): inserting or removing an instrument or a device, hand or finger beyond the labia majora for the purpose of conducting diagnostic scans and imaging of body tissue reserved act 4(f): inserting or removing an instrument or a device, hand or finger beyond the anal verge for the purpose of conducting diagnostic scans and imaging of body tissue reserved act 10(a): applying ultrasound for diagnostic or imaging purposes, including any application of ultrasound to a fetus 10(3) A person who is training to be certified as a diagnostic medical sonographer may perform the reserved acts referred to in subsection (2) without contravening subsection 5(1) of the Act only if he or she (a) meets the requirements set out in clauses (1)⁠(a), (c) and (d); and (b) performs the act under the supervision and direction of a person who meets each of the requirements set out in subsection (1). Non-certified health care practitioners 11(1) An act done by a person in the course of performing a reserved act listed in subsection (2) is not a contravention of subsection 5(1) of the Act if the person meets each of the following requirements: (a) the person is ordered to perform the reserved act by a member of a regulated health profession who is authorized to perform the reserved act; (b) at the time the reserved act is performed the person is participating in a continuing competency program approved by the medical director of a facility referred to in clause (c); (c) the person performs the reserved act in (i) a facility that is designated as a hospital under The Health Services Insurance Act , (ii) a hospital or health care facility operated by the government, the Government of Canada or a municipal government, or (iii) a facility at which diagnostic or treatment services are performed and which is accredited by the College of Physicians and Surgeons of Manitoba; (d) the medical director of a facility referred to in clause (c) in which the reserved act is being performed considers the person to be competent to perform the reserved act. 11(2) The following reserved acts are listed for the purpose of subsection (1): reserved act 3(a): performing a procedure on tissue below the dermis of a person who is at least 2 years of age for the purpose of venipuncture reserved act 3(a): performing a procedure on tissue below the dermis for the purpose of skin punctures other than venipuncture reserved act 10(e): applying X-rays for diagnostic purposes 11(3) For the purpose of clause (1)⁠(d), the medical director may consider the person to be competent if that person has successfully completed the appropriate education and training to perform the reserved act. Psychologists 12(1) An act done by a person in the course of performing a reserved act listed in subsection (2) is not a contravention of subsection 5(1) of the Act if the person meets both of the following requirements: (a) the person holds a valid school clinician's certificate (school psychologist) issued under clause 14(e) of the Teaching Certificates and Qualifications Regulation , Manitoba Regulation 115/2015; (b) the person is acting in the course of his or her employment. 12(2) The following reserved acts are listed for the purpose of subsection (1): reserved act 1: making a diagnosis relating to a psychological disease or disorder that is within the person's scope of clinical training and competency as a school psychologist and communicating it to an individual or his or her personal representative in circumstances in which it is reasonably foreseeable that the individual or representative will rely on the diagnosis to make a decision about the individual's health care reserved act 20: performing a psycho-social intervention with an expectation of modifying a substantial disorder of thought, mood, perception, orientation or memory that grossly impairs judgment, behaviour, the capacity to recognize reality, or the ability to meet the ordinary demands of life 12(3) An act done by a person in the course of performing a reserved act listed in subsection (4) is not a contravention of subsection 5(1) of the Act if the person meets each of the following requirements: (a) the person is employed as a psychologist by (i) the government or the Government of Canada, (ii) a university in Manitoba, (iii) a facility that is designated as a hospital under The Health Services Insurance Act , or (iv) a hospital or health care facility operated by the government, the Government of Canada or a municipal government; (b) the person is acting in the course of his or her employment; (c) the person has received a doctoral or master's degree in a program of psychology approved by The Psychological Association of Manitoba. 12(4) The following reserved acts are listed for the purpose of subsection (3): reserved act 1: making a diagnosis relating to a psychological disease or disorder that is within the person's scope of clinical training and competency as a psychologist and communicating it to an individual or his or her personal representative in circumstances in which it is reasonably foreseeable that the individual or representative will rely on the diagnosis to make a decision about the individual's health care reserved act 20: performing a psycho-social intervention with an expectation of modifying a substantial disorder of thought, mood, perception, orientation or memory that grossly impairs judgment, behaviour, the capacity to recognize reality, or the ability to meet the ordinary demands of life M.R. 115/2025 Medical geneticists 13(1) An act done by a person in the course of performing the reserved act listed in subsection (2) is not a contravention of subsection 5(1) of the Act if each of the following requirements is met: (a) the person is a Fellow of the Canadian College of Medical Geneticists; (b) the person is employed by (i) a university in Manitoba, (ii) a regional health authority, (iii) a facility that is designated as a hospital under The Health Services Insurance Act , or (iv) a hospital or health care facility operated by the government, the Government of Canada or a municipal government; (c) the communication of the diagnosis is performed in accordance with the protocols or guidelines of the person's employer, if any. 13(2) The following reserved act is listed for the purpose of subsection (1): reserved act 1: making a diagnosis relating to a genetic disease or genetic disorder that is within the person's area of expertise as a Fellow of the Canadian College of Medical Geneticists and communicating it to an individual or his or her personal representative in circumstances in which it is reasonably foreseeable that the individual or representative will rely on the diagnosis to make a decision about the individual's health care First responders 13.1(1) An act done by a person in the course of performing a reserved act listed in subsection (2) is not a contravention of subsection 5(1) of the Act if the person meets each of the following requirements: (a) the person is a first responder as defined in the Land Emergency Medical Response System Regulation , Manitoba Regulation 22/2006; (b) the person performs the reserved act in the course of their employment or engagement as a first responder under that regulation. 13.1(2) The following reserved acts are listed for the purpose of subsection (1): reserved act 5(a): administering naloxone hydrochloride injection when indicated for emergency use for opioid overdose reserved act 5(c): administering oxygen by mechanical ventilation using a bag-valve mask when resuscitating an individual reserved act 5(d): administering a substance to a patient's eyes by irrigation reserved act 5(e): administering glucose by buccal, oral or sublingual routes if advised to do so by a call taker at a dispatch centre or by another qualified person appointed by the operator of the dispatch centre reserved act 9: administering acetylsalicylic acid by oral route for suspected cardiac related chest pain if advised to do so by a call taker at a dispatch centre or by another qualified person appointed by the operator of the dispatch centre reserved act 9: administering epinephrine by auto-injector if advised to do so by a call taker at a dispatch centre or by another qualified person appointed by the operator of the dispatch centre or if the patient has an existing prescription for epinephrine reserved act 9: administering salbutamol by inhaler if the patient has an existing prescription for salbutamol reserved act 10(b)⁠(iv): applying electricity for defibrillation using a semi-automated defibrillator without rhythm interpretation 13.1(3) The following definitions apply in this section: "call taker" has the same meaning as in the Land Emergency Medical Response System Regulation . (« préposé aux appels ») "dispatch centre" has the same meaning as in the Land Emergency Medical Response System Regulation . (« centre de répartition ») M.R. 1/2025 MISCELLANEOUS Corporations 14(1) Section 59 of the Act authorizes a health profession corporation to carry on the practice of a regulated health profession through one or more regulated members of that profession. In accordance with section 61 of the Act, another corporation may carry on the practice of a health profession, but only through one or more members of that profession who are authorized to practise the profession, and only in the following circumstances: (a) the corporation is authorized to do so by or under another enactment; (b) the corporation does so as the operator of a hospital, health care facility or other facility referred to in clauses 183(1)⁠(a) to (c) of the Act; (c) The Crown Corporations Governance and Accountability Act applies to the corporation; (d) the corporation is a not-for-profit corporation incorporated under The Corporations Act or the Canada Not-for-profit Corporations Act ; (e) the members are employed by the corporation to provide health care to the corporation's own employees and not to the public; (f) the corporation (i) [repealed]  M.R. 165/2018 , (ii) is a dental corporation that holds a valid permit under The Dental Association Act , (iii) is a corporation that operates a dental laboratory in accordance with section 16 of The Denturists Act , or (iv) carries on the practice of a health profession regulated under any other profession-specific Act listed in Schedule 2 of the Act; (g) if the health profession is the regulated health profession of audiology or speech-language pathology (as designated in subsection 2(1) of the Practice of Audiology and Practice of Speech-Language Pathology Regulation , Manitoba Regulation 191/2013), the corporation is not controlled by (i) one or more audiologists or speech-language pathologists (as defined in the College of Audiologists and Speech-Language Pathologists of Manitoba General Regulation , Manitoba Regulation 192/2013) or their spouses, common-law partners or children, within the meaning of the Income Tax Act (Canada), (ii) one or more other corporations controlled by persons referred to in subclause (i), or (iii) a combination of persons referred to in subclause (i) and corporations referred to in subclause (ii); (h) if the health profession is the regulated health profession of registered nursing (as designated in section 2 of the Practice of Registered Nursing Regulation , Manitoba Regulation 113/2017), the corporation is not controlled by (i) one or more regulated members of the College of Registered Nurses of Manitoba or their spouses, common-law partners or children, within the meaning of the Income Tax Act (Canada), (ii) one or more other corporations controlled by persons referred to in subclause (i), or (iii) a combination of persons referred to in subclause (i) and corporations referred to in subclause (ii); (i) if the health profession is the regulated health profession of medicine (as designated in section 2 of the Practice of Medicine Regulation , Manitoba Regulation 162/2018), the corporation is not controlled by (i) one or more regulated members of the College of Physicians and Surgeons of Manitoba or their spouses, common-law partners or children, within the meaning of the Income Tax Act (Canada), (ii) one or more other corporations controlled by persons referred to in subclause (i), or (iii) a combination of persons referred to in subclause (i) and corporations referred to in subclause (ii); (j) if the health profession is the regulated health profession of paramedicine (as designated in section 2 of the Practice of Paramedicine Regulation , Manitoba Regulation 71/2018), the corporation is not controlled by (i) one or more regulated members of the College of Paramedics of Manitoba or their spouses, common-law partners or children, within the meaning of the Income Tax Act (Canada), (ii) one or more other corporations controlled by persons referred to in subclause (i), or (iii) a combination of persons referred to in subclause (i) and corporations referred to in subclause (ii); (k) if the health profession is the regulated health profession of registered psychiatric nursing (as designated in section 2 of the Practice of Registered Psychiatric Nursing Regulation , Manitoba Regulation 61/2022), the corporation is not controlled by (i) one or more regulated members of the College of Registered Psychiatric Nurses of Manitoba or their spouses, common-law partners or children, within the meaning of the Income Tax Act (Canada), (ii) one or more other corporations controlled by persons referred to in subclause (i), or (iii) a combination of persons referred to in subclause (i) and corporations referred to in subclause (ii). Corporation controlled by another person 14(2) A corporation is controlled by another person if (a) the corporation's voting shares carrying more than 50 percent of the votes for the election of directors are held — otherwise than by way of security only — by or for the benefit of the other person; and (b) those shares carry sufficient votes to elect a majority of the corporation's board of directors. M.R. 56/2018 ; 165/2018 ; 105/2020 ; 62/2022 ; 115/2025 Period of transition 15(1) During the period of transition from regulating health professions under profession-specific Acts to regulating them under the Act, the reference in clause 6(1)⁠(c), 7(1)⁠(c), 8(1)⁠(c), 9(1)⁠(c), 10(1)⁠(c) or 11(1)⁠(a) to a member of a regulated health profession who is authorized to perform the reserved act is deemed to include a person who is authorized to practise a health profession under a profession-specific Act until such time as the profession-specific Act is repealed, as long as (a) the person is practising the health profession under the authority of the applicable profession-specific Act; and (b) the person meets all the practice requirements of the health profession, including compliance with the profession-specific Act, the regulations and by-laws made under that Act, and any terms and conditions imposed on the person's registration, licence, permit, approval, or other authorization to practise. 15(2) In this section, "profession-specific Act" means an Act listed in Schedule 2 of the Act. Coming into force 16 This regulation comes into force on the same day that subsection 5(1) of The Regulated Health Professions Act , S.M. 2009, c. 15, comes into force.
