This regulation designates certain Manitoba bodies as government agencies for Part XIX of The Consumer Protection Act, sets out when administrative penalties may be issued, requires the penalty notice to use Form 1, and sets commencement rules.

Bodies designated as government agencies 2 The following bodies are designated as a government agency for the purposes of Part XIX (Government Cheque Cashing Fees) of the Act: (a) The Manitoba Housing Authority; (b) The Manitoba Housing and Renewal Corporation; (c) The Manitoba Public Insurance Corporation; (d) The Workers Compensation Board; (e) Manitoba Hydro. M.R. 210/2011 Provision for which administrative penalty may be issued 3 A notice of administrative penalty may be issued under subsection 136(1) of the Act if a person fails to comply with section 166 of the Act. Administrative penalty amounts 4(1) The amount of an administrative penalty to be imposed on an individual is as follows: (a) first contravention 4(2) The amount of an administrative penalty to be imposed on a corporation is as follows: (a) first contravention Form for the notice of administrative penalty 5 A notice of administrative penalty must be in Form 1 of the Schedule. Coming into force 6(1) Subject to subsection (2), this regulation comes into force on the same day that section 165 of the Act, as enacted by section 2 of The Consumer Protection Amendment Act (Government Cheque Cashing Fees) , S.M. 2006, c. 17, comes into force, or on the day that it is registered under The Regulations Act , whichever is later. 6(2) Sections 3 to 5 come into force on the same day that section 166 of the Act, as enacted by section 2 of The Consumer Protection Amendment Act (Government Cheque Cashing Fees) , S.M. 2006, c. 17, comes into force.
