This regulation defines key terms, lists certain substances as drugs, excludes naloxone products in emergency opioid-overdose use from being treated as drugs, and restricts sales of Schedule 1 drugs by members.

"Act" means The Pharmaceutical Act ; («  Loi  ») "Manual" means the Manual for Canada's National Drug Scheduling System published by the National Association of Pharmacy Regulatory Authorities, as amended from time to time. (« manuel ») M.R. 141/2020 Prescribed drugs 2 The following are prescribed as drugs for the purpose of the definition "drug" in subsection 1(1) of the Act: (a) the substances and mixtures of substances listed in Schedules 1, 2 and 3 of the Manual; (b) a substance or mixture of substances that contains pseudoephedrine as the single active ingredient. M.R. 141/2020 ; 25/2023 Exception — naloxone hydrochloride 2.1 Despite section 2, the following are not drugs for the purpose of the definition "drug" in subsection 1(1) of the Act: (a) naloxone hydrochloride injection, when indicated for emergency use for opioid overdose; (b) naloxone hydrochloride nasal spray, when indicated for emergency use for opioid overdose. M.R. 141/2020 Designated practitioners 3(1) Subject to subsection (2), the following persons are designated as practitioners for the purpose of the definition "practitioner" in subsection 1(1) of the Act: (a) a pharmacist authorized to practise pharmacy in Manitoba or another Canadian province or territory; (b) a registered nurse authorized to practise registered nursing in Manitoba or another Canadian province or territory; (c) an optometrist authorized to practise optometry in Manitoba or another Canadian province or territory; (d) a midwife authorized to practise midwifery in Manitoba or another Canadian province or territory; (e) a registered psychiatric nurse authorized to practise registered psychiatric nursing in Manitoba or another Canadian province or territory; (f) a podiatrist authorized to practise podiatry in Manitoba or another Canadian province or territory. 3(2) A person is designated under subsection (1) only to the extent that they have authority to prescribe under the enactment that authorizes them to practise. M.R. 141/2020 ; 25/2023 Limits on sale of particular drugs 4 A member must not sell a drug listed in Schedule 1 of the Manual unless (a) the drug is sold to a practitioner; or (b) the drug is dispensed pursuant to a prescription. Coming into force 5 This regulation comes into force on the day The Pharmaceutical Act , S.M. 2006, c. 37, comes into force.
