R32 Regulation 208/2009 Registered December 29, 2009 bilingual version (HTML) Definitions 1 The following definitions apply in this regulation. "Act" means The Red River Floodway Act . («  Loi ») "floodway operations report" means the floodway operations report required by section 11 of the Act. (« B.T.F.W. ») Floodway plans of survey 2 For the purposes of the definition "floodway" in section 1 of the Act, the following plans of survey are the plans that set out the lands and structures comprising the Red River Floodway: (a) Plan No. 8308 WLTO; (b) Plan No. 8552 WLTO; (c) Parcel 2, Plan No. 8919 WLTO; (d) Plan No. 9593 WLTO; (e) Plan No. 9779 WLTO; (f) Plan No. 10007 WLTO; (g) Plan No. 12965 WLTO; (h) Plan No. 12989 WLTO; (i) Plan No. 13000 WLTO; (j) Plan No. 13001 WLTO; (k) Plan No. 13003 WLTO; (l) Plan No. 13006 WLTO; (m) Plan No. 37216 WLTO; (n) Plan No. 39390 WLTO; (o) Plan No. 39397 WLTO; (p) Plan No. 45931 WLTO; (q) Plan No. 47450 WLTO; (r) Plan No. 47451 WLTO; (s) Plan No. 48506 WLTO. Floodway operations report 3(1) In addition to any other information the minister requires under subsection 11(1) of the Act, the floodway operations report must contain the following basic information: (a) a statement of the period reported on; (b) a statement that the floodway was operated during spring flooding during the period; (c) a statement as to whether artificial flooding was caused during the period; (d) a description of the causes of the spring flooding and its duration; (e) a description of all floodway structure operations and any technical issues that arose during the operation; (f) a tabulation showing all floodway gate adjustments, including the date and time of each adjustment and the resulting gate-tip elevations; (g) a tabulation showing actual and computed natural flows for the Red River for the full period of operation at (i) the floodway channel entrance, and (ii) James Avenue in The City of Winnipeg; (h) a tabulation showing actual and computed natural flows for the Assiniboine River for the full period of operation at its confluence with the Red River; (i) a tabulation showing actual and computed natural river levels for the Red River for the full period of operation at (i) the floodway channel entrance, and (ii) James Avenue in The City of Winnipeg. 3(2) If artificial flooding was caused in the period reported on, the floodway operations report must contain the following further information: (a) the date and approximate duration of artificial flooding; (b) an explanation of why the Red River exceeded its natural level; (c) a map showing the maximum extent and maximum depths of artificial flooding in the Red River valley. 3(3) For the purposes of clause 11(2)⁠(b) of the Act, the public availability of the floodway operations report must be publicized without delay after the report is publicly available by placing a notice of its availability (a) in the Winnipeg and Morden locations of the public registry maintained by the Manitoba Department of Environment and Climate Change under The Environment Act ; (b) at the Winnipeg head office of the Manitoba Department of Environment and Climate Change and the Morris regional office of the Manitoba Department of Transportation and Infrastructure; and (c) on the Internet home page of the Manitoba Department of Environment and Climate Change. 3(4) For the purposes of clause 11(2)⁠(b) of the Act, the floodway operations report must be made available to the public (a) by placing a copy — for reading only — in the public registry maintained by the Manitoba Department of Environment and Climate Change under The Environment Act ; (b) by posting a copy on the Internet accessible by an Internet link on the home page of the Manitoba Department of Environment and Climate Change; and (c) by providing copies for free pick up at (i) the Winnipeg head office of the Manitoba Department of Environment and Climate Change and the Morris regional office of the Manitoba Department of Transportation and Infrastructure, and (ii) the administration office of any municipality within whose boundaries the report indicates that artificial flooding occurred.
