Hatcheries and Hatchery Supply Flocks Regulation, M.R. 209/87 R The Livestock and Livestock Products Act , C.C.S.M. c. L170 Regulation 209/87 R Registered May 29, 1987 bilingual version (HTML) 1 In this regulation, "Act" means The Livestock and Livestock Products Act ; («  Loi  ») "hatchery" means any building equipped with an incubator capable of incubating one thousand or more eggs, and used for incubation, and includes any land or other buildings adjacent thereto, and used in connection therewith; (« couvoir ») "hatchery supply flock" means a flock of poultry intended for breeding purposes, that qualifies as a hatchery supply flock under this regulation; (« troupeau fournisseur de couvoirs ») "inspection" means an inspection of a flock of poultry and the premises on which it is kept, by an inspector. (« inspection ») M.R. 81/91; 32/2001 ; 115/2025 2(1) No person shall operate a hatchery unless he has a valid subsisting licence to do so issued by the minister. 2(2) An applicant for a hatchery licence shall apply therefor on a form supplied by the minister. 2(3) The minister, in his absolute discretion, may refuse to issue a hatchery licence to a person who has not (a) paid for all hatching eggs purchased by him prior to the making of the application; (b) filled all orders received and accepted by him in any preceding year or refunded any money that was advanced to him in respect of any orders received but not filled or made settlements satisfactory to the minister with his flock owners or customers whose orders he has accepted but been unable to fill; (c) maintained his hatchery and all premises used in connection therewith in a clean and sanitary condition; or (d) complied in all respects with the regulations under the Act and under the Livestock and Livestock Products Act (Canada). M.R. 81/91 2(4) The minister, in his absolute discretion, may cancel a hatchery licence at any time if he is satisfied that the licensee (a) has failed within a reasonable time to pay for hatching eggs; (b) has failed to fill all orders received and accepted, or to refund money advanced to him in respect of, or to make settlements satisfactory to the minister with the customers or flock owners in respect of orders that he has accepted but been unable to fill; (c) has purchased, received or set hatching eggs from a flock that is not qualified as a hatchery supply flock; (d) has failed to maintain his or her hatchery and all premises used in connection with it in a clean and sanitary condition; or (e) has failed to comply in all respects with the regulations under the Act and under the Livestock and Livestock Products Act (Canada). M.R. 81/91 2(5) The minister, for a period of one year from the date of cancellation, may refuse to entertain an application for a hatchery licence from a person whose hatchery licence has been cancelled. 2(6) Each hatchery licence shall expire on December 31, at the end of the year for which it was issued. 3(1) The following requirements shall be met for a flock to qualify as a hatchery supply flock: (a) the flock shall not contain any poultry except stock of varieties acceptable to the minister; (b) the buildings and premises on which the flock is kept shall be maintained in a clean and sanitary condition satisfactory to the inspector; (c) all rejected poultry shall be identified in a manner satisfactory to the inspector, and removed from the premises on which the flock is kept or segregated without mating in a manner satisfactory to the inspector; (d) [repealed] M.R. 32/2001 ; (e) the flock shall meet standards with respect to tests for diseases or other defects as the minister may, from time to time, prescribe. M.R. 81/91; 32/2001 3(2) Where any of the requirements set out in subsection (1) are not met in respect of a hatchery supply flock, the minister may disqualify the flock as a hatchery supply flock for a period fixed by the minister. M.R. 81/91 3(3) No person shall sell hatching eggs to a hatchery unless the eggs were produced from a qualified hatchery supply flock. M.R. 81/91 4 Where a hatchery supply flock is sold or transferred to other premises without permission from the minister, the hatchery supply flock shall cease to qualify as a hatchery supply flock under this regulation. 5 An inspector may inspect a hatchery or a hatchery supply flock at any time without notice. 6 Where a declaration or form is required to be completed under this Part, the declaration or form shall be on a form supplied by the minister. 7 and 8 [Repealed] M.R. 81/91; 32/2001
