Image Capturing Enforcement Regulation
This regulation sets rules for image capturing enforcement systems, including what devices are approved, how evidence must be displayed, and when municipalities or police services may use the systems.

(« dispositif de signalisation approuvé ») M.R. 81/2025 Types of image capturing enforcement systems 2(1) The following types of image capturing enforcement systems are prescribed: (a) induction loop intersection safety camera systems; (b) radar intersection safety camera systems; (c) trailer-mounted photo radar systems; (d) vehicle-mounted photo radar systems; (e) vehicle-mounted photo laser systems. Requirements for vehicle-mounted systems 2(2) For the purpose of this regulation, (a) a photo radar system is vehicle-mounted if (i) the system hardware is contained within the vehicle's occupant compartment or, if not all of the hardware is contained within that compartment, any hardware outside it is affixed to the vehicle, and (ii) the system's operator is in the occupant compartment while operating the system; and (b) a photo laser system is vehicle-mounted if (i) the system hardware is contained within the vehicle's occupant compartment or, if not all the hardware is contained within that compartment, any hardware outside it is handheld by the system's operator, and (ii) the system's operator is in the occupant compartment while operating the system. M.R. 46/2012 ; 156/2012 ; 81/2025 Approved induction loop intersection systems 3(1) The following induction loop intersection safety camera systems are approved: (a) Gatsometer Type RLC 36, made by Gatsometer BV; (b) Gatsometer GTC-F, made by Gatsometer BV; (c) Gatsometer GTC-GS11, also referred to as Gatso Traffic Camera GTC-GS11, made by Gatsometer BV. Approved radar intersection system 3(2) The DriveSafe Enforcement System, made by Mesa Technologies, is approved as a radar intersection safety camera system when used in conjunction with the TRUGRD (UMRR-12 Type 48) 3D/UHD+ radar-based device made by s.m.s. smart microwave sensors GmbH. Approved trailer-mounted photo radar system 3(3) The Gatso Radar Type 24 with Gatso Camera Type AUS, made by Gatsometer BV, is approved as a trailer-mounted photo radar system. Approved vehicle-mounted photo radar systems 3(4) The following vehicle-mounted photo radar systems are approved: (a) Gatso Radar Type 24 with Gatso Camera Type AUS, made by Gatsometer BV; (b) Gatso RS-GS11, also referred to as Gatsometer RS-GS11, made by Gatsometer BV; (c) the DriveSafe Enforcement System, made by Mesa Technologies, when used in conjunction with the TRUGRD (UMRR-12 Type 48) 3D/UHD+ radar-based device made by s.m.s. smart microwave sensors GmbH. Approved vehicle-mounted photo laser systems 3(5) The following vehicle-mounted photo laser systems are approved: (a) the DragonCam Portable Photo-Laser Speed Enforcement System, made by DragonEye Technology, LLC; (b) the Stalker LidarCam 2, made by Applied Concepts, Inc. M.R. 46/2012 ; 75/2013 ; 81/2025 Description of system — "model" or "type" may be omitted 4(1) If the description or name of a system approved under section 3 includes the word "model" or "type", the device may, for any purpose, be referred to with or without using that word, including when the system is referred to in a certificate under section 257.2 of the Act or another document, or in evidence in relation to an alleged contravention of subsection 88(7), 88(9) or 95(1) of the Act. Sequences and abbreviations may be used 4(2) When a system approved under section 3 is referred to for any purpose, including when the system is referred to in a certificate under section 257.2 of the Act or another document, or in evidence in relation to an alleged contravention of subsection 88(7), 88(9) or 95(1) of the Act, (a) the sequence of individual words or other discreet elements of the description or name of the system may be transposed; and (b) words and combinations of words, such as business names or product names, may be abbreviated. Capitalization, punctuation, spacing, etc. may differ 4(3) When a system approved under section 3 is referred to for any purpose, including when the system is referred to in a certificate under section 257.2 of the Act or another document, or in evidence in relation to an alleged contravention of subsection 88(7), 88(9) or 95(1) of the Act, the description or name referred to may differ as to capitalization, punctuation, spacing and use of symbols, such as dashes, bullets and slash marks, in comparison with the description or name set out in section 3. M.R. 81/2025 Authorized municipality 5(1) The City of Winnipeg is authorized to use image capturing enforcement systems. Authorized police service 5(2) The Winnipeg Police Service is authorized to use image capturing enforcement systems on behalf of the City of Winnipeg. M.R. 81/2025 INTERSECTION SAFETY CAMERA SYSTEMS Evidence for red light offences 6(1) For the purpose of section 257.2 of the Act (image capturing enforcement system evidence), a reproduction of a sequence of images obtained through the use of an intersection safety camera system relating to a contravention of subsection 88(7) of the Act (red light offences) must (a) display the information set out in (i) subsection (2) in the case of an induction loop intersection safety camera system, or (ii) subsection (3) in the case of a radar intersection safety camera system; and (b) have the information set out in the certificate in Schedule D, completed and signed by an enforcement officer, appended to it. Information for induction loop systems 6(2) The following information must be displayed on a reproduction under subsection (1) in respect of an induction loop intersection safety camera system: 1. The first image of the sequence must display the rear aspect of a vehicle that (a) while a red traffic control light requires it to stop, passes over two precisely spaced induction loops incorporated in the roadway before the intersection and within the system's field of view; or (b) passes over or begins passing over the induction loops at a time when and at a speed at which the system recognizes that the vehicle (i) will be signalled to stop by a red light, and (ii) will not stop; before it enters the intersection. The image must include a superimposed data bar as shown in drawing A1 in Schedule A. The data bar must contain the data display fields labelled A to C, E to H, J and K in drawing A1 and show the information set out in table A1 in Schedule A in those fields. 2. The second image of the sequence must display the rear aspect of the vehicle after it enters the intersection and include a superimposed data bar as shown in drawing A2 in Schedule A. The data bar must contain the data display fields labelled A to K in drawing A2 and show the information set out in table A2 in Schedule A in those fields. Information for radar intersection systems 6(3) The following information must be displayed on a reproduction under subsection (1) in respect of a radar intersection safety camera system: 1. The first image of the sequence must display the rear aspect of a vehicle that (a) while a red traffic control light requires it to stop, approaches the intersection and is (i) within the system's field of view, and (ii) located before the stop line, crosswalk or intersection, as the case may be; or (b) approaches the intersection at a time when and at a speed at which the system recognizes that the vehicle (i) will be signalled to stop by a red light, and (ii) will not stop; before it enters the intersection. The image must include a superimposed data bar as shown in drawing A3 in Schedule A. The data bar must contain the data display fields labelled A to H in drawing A3 and show the information set out in table A3 in Schedule A in those fields. 2. The second image of the sequence must display the rear aspect of the vehicle after it enters the intersection and include a superimposed data bar as shown in drawing A4 in Schedule A. The data bar must contain the data display fields labelled A to J in drawing A4 and show the information set out in table A4 in Schedule A in those fields. M.R. 46/2012 ; 99/2017 ; 81/2025 Evidence for speeding offences with red light violation 6.1(1) For the purpose of section 257.2 of the Act (image capturing enforcement system evidence), a reproduction of a sequence of images obtained through the use of an intersection safety camera system relating to a contravention of subsection 95(1) of the Act (speeding offences) must, if the images also show a red light violation, (a) display the information set out in (i) subsection (2) in the case of an induction loop intersection safety camera system, or (ii) subsection (3) in the case of a radar intersection safety camera system; and (b) have the information set out in the certificates in Schedules D and E, completed and signed by an enforcement officer, appended to it. Information for induction loop systems 6.1(2) The following information must be displayed on a reproduction under subsection (1) in respect of an induction loop intersection safety camera system: 1. The first image of the sequence must display the rear aspect of a vehicle that, (a) while a red traffic control light requires it to stop and while it exceeds the maximum allowable speed, passes over two precisely spaced induction loops incorporated in the roadway before the intersection and within the system's field of view; or (b) while it exceeds the maximum allowable speed, passes over or begins passing over the induction loops at a time when the system recognizes that the vehicle (i) will be signalled to stop by a red light, and (ii) will not stop; before it enters the intersection. The image must include a superimposed data bar as shown in drawing A1 in Schedule A. The data bar must contain the data display fields labelled A to C, E to H, J and K in drawing A1 and show the information set out in table A1 in Schedule A in those fields. 2. The second image of the sequence must display the rear aspect of the vehicle after it enters the intersection and include a superimposed data bar as shown in drawing A2 in Schedule A. The data bar must contain the data display fields labelled A to K in drawing A2 and show the information set out in table A2 in Schedule A in those fields. Information for radar intersection systems 6.1(3) The following information must be displayed on reproductions under subsection (1) in respect of a radar intersection safety camera system: 1. The first image of the sequence must display the rear aspect of a vehicle that (a) while a red traffic control light requires it to stop, approaches the intersection and is (i) within the system's field of view, and (ii) located before the stop line, crosswalk or intersection, as the case may be; or (b) approaches the intersection at a time when and at a speed at which the system recognizes that the vehicle (i) will be signalled to stop by a red light, and (ii) will not stop; before it enters the intersection. The image must include a superimposed data bar as shown in drawing A3 in Schedule A. The data bar must contain the data display fields labelled A to H in drawing A3 and show the information set out in table A3 in Schedule A in those fields. 2. The second image of the sequence must display the rear aspect of the vehicle after it enters the intersection and include a superimposed data bar as shown in drawing A4 in Schedule A. The data bar must contain the data display fields labelled A to J in drawing A4 and show the information set out in table A4 in Schedule A in those fields. M.R. 46/2012 ; 81/2025 Evidence for speeding offences with no red light violation 6.2(1) For the purpose of section 257.2 of the Act (image capturing enforcement system evidence), a reproduction of a sequence of images obtained through the use of an intersection safety camera system relating to a contravention of subsection 95(1) of the Act (speeding offences) must, if the images do not also show a red light violation, (a) display the information set out in (i) subsection (2) in the case of an induction loop intersection safety camera system, or (ii) subsection (3) in the case of a radar intersection safety camera system; and (b) have the information set out in the certificate in Schedule E, completed and signed by an enforcement officer, appended to it. Information for induction loop systems 6.2(2) The following information must be displayed on a reproduction under subsection (1) in respect of an induction loop intersection safety camera system: 1. The first image of the sequence must display the rear aspect of a vehicle that exceeds the maximum allowable speed while passing over two precisely spaced induction loops incorporated in the roadway before the intersection and within the system's field of view. The image must include a superimposed data bar as shown in drawing A5 in Schedule A. The data bar must contain the data display fields labelled A to C, E, F, J and K in drawing A5 and show the information set out in table A5 in Schedule A in those fields. 2. The second image of the sequence must display the rear aspect of the vehicle after it enters the intersection and include a superimposed data bar as shown in drawing A6 in Schedule A. The data bar must contain the data display fields labelled A to F and I to K in drawing A6 and show the information set out in table A6 of Schedule A in those fields. Information for radar intersection systems 6.2(3) The following information must be displayed on a reproduction under subsection (1) in respect of a radar intersection safety camera system: 1. The first image of the sequence must display the rear aspect of a vehicle that exceeds the maximum allowable speed while it is within the system's field of view and is located before the stop line, crosswalk or intersection, as the case may be. The image must include a superimposed data bar as shown in drawing A7 in Schedule A. The data bar must contain the data display fields labelled A to F in drawing A7 and show the information set out in table A7 in Schedule A in those fields. 2. The second image of the sequence must display the rear aspect of the vehicle after it enters the intersection and include a superimposed data bar as shown in drawing A8 in Schedule A. The data bar must contain the data display fields labelled A to H in drawing A8 and show the information set out in table A8 in Schedule A in those fields. M.R. 81/2025 Optional information 6.3 A reproduction of an image obtained through the use of an intersection safety camera system relating to a contravention of subsection 88(7) or (9) of the Act (red light offences) may, but does not have to, include a violation type field that, (a) when the system detects only a red light offence, indicates that the violation type is "red light violation"; and (b) when the system detects a red light offence and a speeding offence, indicates that the violation type is "red light and speed violation". M.R. 81/2025 VEHICLE- AND TRAILER-MOUNTED SYSTEMS Evidence for vehicle- and trailer-mounted systems 7(1) For the purpose of section 257.2 of the Act (image capturing enforcement system evidence), a reproduction of an image or images obtained through the use of a trailer-mounted photo radar system, vehicle-mounted photo radar system or vehicle-mounted photo laser system relating to a contravention of subsection 95(1) of the Act (speeding offences) must (a) display the information set out in (i) subsection (2) in the case of a trailer-mounted photo radar system or vehicle-mounted photo radar system, or (ii) subsection (3) in the case of a vehicle-mounted photo laser system; and (b) have the information set out in the certificate in Schedule F, completed and signed by an enforcement officer, appended to it. Information for photo radar system 7(2) The following information must be displayed on a reproduction under subsection (1) in respect of a trailer-mounted photo radar system or vehicle-mounted photo radar system: 1. The image must display the rear aspect of a vehicle that, as determined by radar speed measurement, exceeds the maximum allowable speed while passing over the area of roadway monitored by the system's radar antenna. 2. The image must include a superimposed data bar as shown in drawing B1 or B2 in Schedule B. The data bar shown in drawing B1 must contain the data display fields labelled A to F in drawing B1 and show the information set out in table B1 in Schedule B in those fields. The data bar shown in drawing B2 must contain the data display fields labelled A to F in drawing B2 and show the information set out in table B2 in Schedule B in those fields. Information for photo laser system 7(3) The following information must be displayed on a reproduction under subsection (1) in respect of a vehicle-mounted photo laser system: 1. The image must display the rear aspect of a vehicle that, as determined by laser speed measurement, exceeds the maximum allowable speed while passing over the area of roadway monitored by the system's laser speed measurement device. 2. The image must include a superimposed data bar as shown in drawing B3 in Schedule B. The data bar must contain the data display fields labelled A to F in drawing B3 and show the information set out in table B3 in Schedule B in those fields. M.R. 46/2012 ; 99/2017 ; 81/2025 Optional information 8 A reproduction of an image obtained through the use of a vehicle-mounted or trailer-mounted photo radar system relating to a contravention of subsection 95(1) of the Act (speeding offences) may, but does not have to, include data display fields in its data bar that show the following information: (a) that only one image of the speeding offence was captured (displayed as "Image: 1/1" or "Image 1"); (b) the radar range used to measure the target vehicle's speed; (c) the identification number, assigned by the municipality or police service using the system, of the peace officer having care of the system. M.R. 46/2012 ; 81/2025 Optional photo laser information 8.1 A reproduction of an image obtained through the use of a vehicle-mounted photo laser system relating to a contravention of subsection 95(1) of the Act (speeding offences) may, but does not have to, include data display fields in its data bar that show the following information: (a) the laser range used to measure the target vehicle's speed; (b) the photo laser system's identification number; (c) the identification number of the peace officer operating the system, assigned by the municipality or police service using the system. M.R. 46/2012 HOW AND WHERE SYSTEMS MAY BE USED Systems not to be used to capture front of vehicle 9(1) A municipality or police service must not use an image capturing enforcement system to capture the image of the front of a vehicle. Vehicle or trailer systems only to be used in certain intersections 9(2) A municipality or police service must not use a vehicle-mounted or trailer-mounted photo radar system or vehicle-mounted photo laser system to detect a speed limit violation that occurs at an intersection that is controlled by traffic control lights unless the intersection is within a construction, playground or school zone. Conditions regarding construction zones 9(3) A municipality or police service must not use a vehicle-mounted or trailer-mounted photo radar system or vehicle-mounted photo laser system to detect a speed limit violation that occurs within a construction zone, unless (a) one or more construction workers are present in the zone; or (b) the municipality (i) has, in accordance with the Act, imposed a speed limit in the zone that is lower than the maximum speed normally permitted for the portion of highway containing the zone, (ii) has placed an approved traffic control device at the beginning of the zone stating the lower speed limit and at the end of the zone indicating that traffic may proceed at the maximum speed normally permitted, and (iii) has, if the municipality considers it advisable to do so, placed approved traffic control devices at intervals within the zone stating the lower speed limit. Location of intersection safety camera systems 9(4) A municipality or police service must not use an induction loop intersection safety camera system or a radar intersection safety camera system at an intersection unless an intersection safety camera system was in use at the intersection at any time prior to July 1, 2025. M.R. 96/2009 ; 156/2012 ; 81/2025 10 [Repealed] M.R. 99/2017 ; 141/2017 ; 81/2025 10.1 [Repealed] M.R. 156/2012 ; 99/2017 ; 141/2017 Construction zones 11(1) For the purposes of subsection 257.1(2) of the Act, a construction zone is a portion or length of highway that (a) is under construction or where any reconstruction, widening, marking, repairs or other work is being done by or on behalf of the traffic authority; and (b) is identified as a construction or work zone by approved traffic control devices placed at the beginning and end of the zone facing each direction of travel in it. Work includes work done to equipment or facilities 11(2) In clause (1)⁠(a), repairs or other work done on behalf of a traffic authority includes installation of, and repairs and modifications to, the equipment or facilities of any person who the traffic authority allows to maintain equipment or facilities on or under the highway. M.R. 81/2025 Playground zones 12(1) For the purposes of subsection 257.1(2) of the Act, a playground zone is a portion or length of highway that (a) adjoins or is adjacent to an area set aside by a municipality for children's recreational activities; and (b) is identified as a playground zone by approved traffic control devices placed at the beginning of the zone facing each direction of traffic entering the zone. Start and end of playground zone 12(2) A playground zone starts at the approved traffic control device facing one or more lanes of traffic and ends at the approved traffic control device facing the oncoming travel lanes. If there are no oncoming travel lanes or no device facing them, the playground zone ends at a point past the set-aside area that is the same distance past the area as the device marking the start of the zone is ahead of the area. M.R. 81/2025 School zones 13(1) For the purposes of subsection 257.1(2) of the Act, a school zone is (a) a portion or length of highway, other than one referred to in clause (b), that (i) adjoins or is adjacent to land (A) on which a school is located, or (B) that is a schoolyard or school recreational facility, and (ii) is identified as a school zone by approved traffic control devices placed at the beginning of the zone facing each direction of traffic entering the zone; or (b) a portion of highway that is a reduced-speed school zone that is established and identified in accordance with the Reduced-Speed School Zones Regulation made under the Act. Start and end of school zone 13(2) A school zone referred to in clause (1)⁠(a) starts at the approved traffic control device facing one or more lanes of traffic and ends at the approved traffic control device facing the oncoming travel lanes. If there are no oncoming travel lanes or no device facing them, the school zone ends at a point past the school land that is the same distance past the land as the device marking the start of the zone is ahead of it. M.R. 137/2013 ; 81/2025 COMING INTO FORCE Coming into force 14 This regulation comes into force on the day The Highway Traffic Amendment and Summary Convictions Amendment Act , S.M. 2002, c. 1, comes into force.
