This regulation creates a peat smoke control zone and restricts peat land development fires there unless a permit authorizes the fire.

E125 Regulation 226/89 Registered September 14, 1989 bilingual version (HTML) Definitions 1 In this regulation, "peat land development fire" means a fire that is started for the purpose of (a) burning peat and debris resulting from the clearing of land, or (b) removing a layer of peat from land; (« feu de tourbe ») "provincial trunk highway" means a provincial trunk highway declared under The Transportation Infrastructure Act . (« route provinciale à grande circulation ») M.R. 115/2025 Peat smoke control zone 2 For the purpose of section 43 of The Environment Act , the following land is established as a sensitive area to be known as the "peat smoke control zone": That area of Manitoba between the eastern boundary of provincial trunk highway 59 and the Ontario border and north from the United States border to the southern boundary of Township 20. Restrictions on peat land development fire 3(1) Except under the authority of a permit, no person shall start a peat land development fire in the peat smoke control zone. 3(2) The director may issue a permit to start a peat land development fire to a person who applies for a permit. 3(3) A permit may be issued subject to such terms and conditions as the director considers appropriate. 3(4) A permit may be cancelled or suspended at any time by the director, and immediately upon receiving notice of cancellation or suspension, the permit holder shall extinguish any fire started under the permit. Permit under The Fires Prevention Act 4 A permit issued under subsection 21(5) of The Fires Prevention Act which specifically authorizes the starting of a peat land development fire is sufficient authority for the purpose of subsection 3(1).
