This regulation sets registration, renewal, temporary practice, and continuing-competency rules for dietitians in Manitoba.

"Act" means The Registered Dietitians Act ; («  Loi  ») "examination" means the Canadian Dietetic Registration Competency Examination administered by the college, or an examination approved as equivalent by the council; (« examen ») "international candidate" means an applicant who has successfully completed a dietetic education program outside of Canada. (« candidat de l'étranger ») REGISTERS Additional registers 2 In addition to the registers of dietitians and graduate dietitians referred to in subsection 7(1) of the Act, the registrar shall maintain the following registers: (a) temporary practice register; (b) dietetic intern register. Information in registers 3(1) For the purpose of clause 7(2)⁠(e) of the Act, the following additional information is to be kept in the register of dietitians and the register of graduate dietitians for each member: (a) home address and telephone number; (b) business name; (c) date of birth; (d) registration number and date of registration; (e) an order made by a panel under section 42 of the Act. 3(2) The following information is to be kept in the temporary practice register for each member on that register: (a) name, and if the member is employed, business name, business address and business phone number; (b) home address and telephone number; (c) date of birth; (d) registration number, and the date and type of registration; (e) the conditions imposed on a certificate of registration; (f) a notation of a cancellation, suspension or non-renewal of registration; (g) the result of a disciplinary proceeding in which a panel has made a finding under section 41 of the Act; (h) an order made by a panel under section 42 of the Act. 3(3) The following information is to be kept in the register of dietetic interns for each member on that register: (a) name, home address and telephone number; (b) date of birth; (c) internship program name and address; (d) registration number, and the date and type of registration. 3(4) The information referred to in clauses (1)⁠(b), (d), and (e) and subsections (2) and (3) other than clauses (2)⁠(b), (2)⁠(c), (3)⁠(a) and (3)⁠(b), is public information for the purpose of clause 7(3)⁠(d) of the Act. REGISTRATION Eligibility for registration as a registered dietitian 4 In addition to the requirements of subsection 9(1) of the Act, the requirements for registration as a registered dietitian are as follows: (a) the applicant must have (i) received a baccalaureate degree majoring in human nutritional sciences, in a university program approved by the council, (ii) successfully completed a dietetic internship program approved by the council, or if the applicant's qualifications are beyond entry level, the board of assessors is satisfied that, based on an assessment of his or her prior learning and experience, the applicant is qualified to practise dietetics, and (iii) passed the examination; (b) the applicant does not (i) suffer from a physical or mental condition, disorder, or addiction to alcohol or drugs, or (ii) possess a record of conviction under the Criminal Code (Canada), the Controlled Drugs and Substances Act (Canada), the Food and Drugs Act (Canada) or any criminal or penal statute of a jurisdiction outside Canada, that makes it desirable in the public interest that he or she not practise dietetics; (c) if the applicant's first language is not English or French, the applicant can speak and write either English or French in accordance with the language fluency criteria established by the council. Application for registration 5 An applicant for registration as a registered dietitian must submit the following to the board of assessors: (a) a completed application form; (b) satisfactory proof of identity and current legal name; (c) evidence that he or she meets the eligibility requirements of subsection 9(1) of the Act and section 4; (d) a completed criminal record review authorization form satisfactory to the board of assessors; (e) the fee provided for in the by-laws. Eligibility for registration as a graduate dietitian 6(1) In addition to the requirements of subsection 9(2) of the Act, the requirements for registration as a graduate dietitian are as follows: (a) the applicant has received a baccalaureate degree majoring in human nutritional sciences, in a university program approved by the council; (b) the applicant has successfully completed a dietetic internship program approved by the council, unless he or she is an international candidate; (c) the applicant has applied and is waiting to write the examination, or is awaiting results; (d) the applicant does not (i) suffer from a physical or mental condition, disorder, or addiction to alcohol or drugs, or (ii) possess a record of conviction under the Criminal Code (Canada), the Controlled Drugs and Substances Act (Canada), the Food and Drugs Act (Canada) or any criminal or penal statute of a jurisdiction outside Canada, that makes it desirable in the public interest that he or she not practise dietetics; (e) if the applicant's first language is not English or French, the applicant can speak and write either English or French in accordance with the language fluency criteria established by the council; (f) if the applicant is an international candidate, he or she has provided evidence of registration or membership in good standing with a body or organization empowered in a jurisdiction outside Canada to register or receive dietitians as members, and the board of assessors is satisfied that the academic standards fixed by that body or organization for the registration or admission of members are substantially the same as those required by the council. 6(2) If the applicant is an international candidate, he or she must also have successfully completed any practicum that the board of assessors may require, based on an assessment of his or her prior learning and experience. Application for graduate dietitian registration 7 An applicant for graduate dietitian registration must submit the following to the board of assessors: (a) a completed application form; (b) satisfactory proof of identity and current legal name; (c) evidence that he or she meets the eligibility requirements of subsection 9(2) of the Act and subsection 6(1); (d) a completed criminal record review authorization form satisfactory to the board of assessors; (e) the fee provided for in the by-laws. When graduate dietitian must write examination 8 A graduate dietitian (a) must write the examination at the first scheduled sitting following his or her registration; and (b) may write the examination no more than three times in the three-year period following his or her registration; unless he or she demonstrates to the registrar that compliance with this section is not practical or possible due to extenuating circumstances acceptable to the registrar in accordance with policies established by the board of assessors. Duration of graduate dietitian registration 9 A person may be registered as a graduate dietitian for a period of not more than one year, unless his or her registration is renewed on application in accordance with policies established by the council. Expiry of graduate dietitian registration 10 When a graduate dietitian passes the examination, his or her registration expires 30 days after the college receives the examination results, unless it is converted pursuant to section 15. Eligibility for registration as a dietetic intern 11 An applicant is eligible for registration on the register of dietetic interns if he or she meets the following requirements: (a) the applicant is enrolled in a baccalaureate degree program majoring in human nutritional sciences, in a university program approved by the council, or has received a degree in such a program; (b) the applicant is registered in a dietetic internship program approved by the council; (c) the applicant does not (i) suffer from a physical or mental condition, disorder, or addiction to alcohol or drugs, or (ii) possess a record of conviction under the Criminal Code (Canada), the Controlled Drugs and Substances Act (Canada), the Food and Drugs Act (Canada) or any criminal or penal statute of a jurisdiction outside Canada, that makes it desirable in the public interest that he or she not practise dietetics; (d) if the applicant's first language is not English or French, the applicant can speak and write either English or French in accordance with the language fluency criteria established by the council. Application for registration as a dietetic intern 12 An applicant for registration as a dietetic intern must submit the following to the board of assessors: (a) a completed application form; (b) satisfactory proof of identity and current legal name; (c) evidence that he or she meets the eligibility requirements of section 11; (d) a completed criminal record search satisfactory to the board of assessors; (e) the fee provided for in the by-laws. TEMPORARY PRACTICE IN MANITOBA Application for temporary practice 13(1) An applicant qualified to practise dietetics in another jurisdiction who wishes to provide dietetic service to the public in Manitoba for a specific purpose and for a limited time period may apply for registration on the temporary practice register by (a) submitting a written application to the board of assessors, stating the specific purpose and the proposed length of time that he or she wishes to practise in Manitoba; (b) providing evidence satisfactory to the board of assessors that he or she is qualified to practise dietetics in the other jurisdiction and has a level of competence appropriate to the specific purpose; and (c) providing any other information that the board of assessors may require in the form and within the time set by the council. 13(2) On receiving an application under subsection (1), if the board of assessors is satisfied that it is in the public interest to allow the applicant to practise on a temporary basis, the board may enter the applicant's name on the temporary practice register. DISCLOSURE OF INFORMATION Applicant to disclose information 14 An applicant for registration or renewal on any register must disclose to the board of assessors the following information about himself or herself and his or her practice of dietetics or of any other profession, whether in Manitoba or in another jurisdiction: (a) a finding by any professional regulatory body of professional misconduct, conduct unbecoming, incompetence, an incapacity or lack of fitness to practise, or any similar finding; (b) a current proceeding by a professional regulatory body in relation to professional misconduct, conduct unbecoming, incompetence, an incapacity or lack of fitness to practise, or any similar current proceeding; (c) a denial of registration by a professional regulatory body, including reasons for the denial; (d) a conviction for an offence under the Criminal Code (Canada), the Controlled Drugs and Substances Act (Canada), the Food and Drugs Act (Canada), or any criminal or penal statute of a jurisdiction outside Canada that is, or may be, relevant to his or her suitability to practise. CONVERTING REGISTRATION Conversion from graduate dietitian to active practice 15 A graduate dietitian is entitled to have his or her registration converted from the graduate dietitians register to the registered dietitians register if he or she (a) has passed the examination; (b) satisfies all of the other requirements for registration as a registered dietitian; (c) provides any information that the board of assessors may require, in the form and within the time set by the board; and (d) pays the fee provided for in the by-laws. Conversion from dietetic intern to graduate dietitian 16 A dietetic intern is entitled to have his or her registration converted from the dietetic intern register to the graduate dietitian register if he or she (a) has successfully completed a dietetic internship program approved by the council; (b) has applied and is waiting to write the examination, or is awaiting results; (c) meets all of the other requirements for registration as a graduate dietitian; (d) provides any information that the board of assessors may require, in the form and within the time set by the council; and (e) pays the fee provided for in the by-laws. RENEWAL Renewal 17 Each member must renew registration with the college at such time or times as required by the college. Renewal of registered dietitian registration 18(1) A registered dietitian is entitled to have his or her registration renewed by (a) providing any information that the board of assessors may require, in the form and within the time set by the board; (b) paying the fee provided for in the by-laws; (c) declaring that he or she has not been convicted of an offence described in subclause 4(b)⁠(ii), within the current registration period; and (d) providing evidence of continuing competency for renewal of registration in accordance with the requirements of section 23. 18(2) If an applicant for renewal does not meet the requirements of subsection (1), the board of assessors may renew the registration, subject to terms and conditions, for up to one year. 18(3) Where a member believes that he or she has satisfied any terms or conditions that have been placed on the member's registration, other than those imposed under Part 6 of the Act, and he or she wishes to have those terms or conditions varied or removed, the member may (a) provide any information that the board of assessors may require in the form and within the time set by the board; (b) pay the fee provided for in the by-laws; and (c) provide evidence in accordance with policies established by the council that he or she is fit to engage in the safe practice of dietetics with the term or condition varied or removed as requested by the applicant. If the board of assessors is satisfied that it is in the public interest to allow the applicant to practise with the term or condition varied or removed, the board shall approve the request. Changes in requirements do not affect right to renew 19 No change in the educational requirements for registration affects a person's eligibility to renew his or her registration or right to practise, if the person was registered with the college or was registered in another Canadian province or territory before the change was made. CANCELLATION FOR NON-PAYMENT OF FEES Cancellation for non-payment of fees 20(1) When a member is in default in the payment of his or her renewal fees for a period of at least 14 days, the registrar may send a letter, by ordinary mail addressed to the member at his or her address on the records of the college, notifying the member of his or her default. If the default continues for a further 15 days after the date of the letter, the registration of that member is to be automatically cancelled. 20(2) When a member's registration is cancelled under subsection (1), the registrar shall notify the member by registered mail addressed to the member at his or her address on the records of the college, and shall send a copy of the notification, by ordinary mail, to the member's employer, if any, listed on the records of the college. REINSTATEMENT Reinstatement re outstanding fees 21 An applicant who applies for reinstatement of registration under section 49 of the Act, where his or her registration has been cancelled for non-payment of fees, is entitled to have his or her registration reinstated by (a) providing any information that the council may require, in the form and within the time set by the council; and (b) paying the fee, plus any late-payment fees, provided for in the by-laws. Standards of practice 22 The standards of practice for a dietitian are as set out in Schedule A, and failure to comply with a standard may result in a proceeding against a member in accordance with the Act. CONTINUING COMPETENCY Continuing competency 23 To satisfy the requirement of continuing competence for renewal of registration on the register of registered dietitians, a member must satisfy the requirements of the continuing competency program as outlined in Schedule B. LIABILITY PROTECTION Liability protection 23.1 Every member who engages in the practice of dietetics must obtain or be covered by, and maintain liability insurance coverage to a minimum of $5,000,000. M.R. 39/2007 REGULATION REVIEW Review of regulation 24 Not later than five years after the day this regulation comes into force, the council must (a) review the effectiveness of the operation of this regulation, and in so doing, consult with such persons affected by the regulation as the council considers appropriate; and (b) if it considers it advisable, amend or repeal this regulation. REPEAL AND COMING INTO FORCE Repeal 25 The Registered Dietitians Regulation , Manitoba Regulation 310/88 R, is repealed. Coming into force 26 This regulation comes into force on the day that The Registered Dietitians Act , S.M. 2002, c. 18, comes into force. SCHEDULE A (section 22) STANDARDS OF PRACTICE STANDARD 1: PROVISION OF SERVICE TO A CLIENT The dietitian uses a client-centred approach to provide and facilitate an effective dietetic service. Indicators: To apply Standard 1, each dietitian 1.1 collaborates with the client and/or appropriate others 1.2 manages available resources effectively and efficiently in meeting the needs of the client 1.3 applies a research-based approach in providing a dietetic service 1.4 uses critical thinking to analyze, synthesize, and apply information to improve the quality and effectiveness of service 1.5 creates a client-centred environment conducive to achieving client outcomes. STANDARD 2: UNIQUE BODY OF KNOWLEDGE The dietitian has an in-depth scientific knowledge of food and human nutrition, and integrates this knowledge with that from other disciplines, including health and social sciences, education, communication and management. Indicators: To apply Standard 2, each dietitian 2.1 has the knowledge relevant to her/his area of practice 2.2 knows how and where to locate needed information 2.3 shares knowledge and information with appropriate others 2.4 is informed about the unique body of knowledge possessed by dietitians in a variety of roles, and the contribution of dietitians as related to other service providers 2.5 seeks to strengthen innovation and excellence in practice by supporting the development and use of new knowledge in dietetics 2.6 creates an environment that assists individuals to acquire new knowledge and skills. STANDARD 3: COMPETENT APPLICATION OF KNOWLEDGE The dietitian competently applies the unique body of knowledge of food and human nutrition, and competently integrates this knowledge with that from other disciplines, including health and social sciences, education, communication and management. Indicators: To apply Standard 3, each dietitian 3.1 uses the skills necessary to apply the knowledge relevant to her/his area of practice 3.2 collaborates with clients and/or appropriate others 3.3 identifies food and nutrition issues through the assessment of data, documentation from the literature and critical analysis of information 3.4 formulates goals and objectives, and develops an action plan designed to meet these goals and objectives 3.5 implements, monitors and modifies the action plan 3.6 evaluates the action plan through critical appraisal of the process and outcomes 3.7 establishes and maintains appropriate information and communication systems 3.8 applies knowledge gained from experience, clinical judgments and research findings to professional practice. STANDARD 4: CONTINUING COMPETENCE The dietitian is responsible for life-long learning to ensure competence in her/his area of practice. Indicators: To apply Standard 4, each dietitian 4.1 uses an organized and focused approach in: assessing her/his level of competence, determining her/his strengths and competence gaps/learning needs, and developing a plan to meet those needs 4.2 strives for excellence in the profession by participating in, supporting and promoting the use of self-assessment methods and feedback from appropriate others to review and implement changes to practice 4.3 invests the time, effort, and other resources needed to maintain and/or improve the knowledge, skills, attitudes, and judgments required for her/his practice. STANDARD 5: ETHICS The dietitian practises in accordance with the ethical guidelines of the profession. Indicators: To apply Standard 5, each dietitian 5.1 demonstrates, through example and behaviour, adherence to the code of ethics for the dietetic profession 5.2 practises within her/his level of competence 5.3 recognizes her/his knowledge or skill limitations, and when necessary seeks the help, guidance and expertise of others 5.4 reports unsafe practice or professional misconduct to the appropriate person or agency 5.5 protects a client's right to autonomy, respect, confidentiality, dignity and access to information 5.6 promotes and supports ethical behaviour in practice and in research 5.7 uses discussions with colleagues as a means to resolve or interpret ethical issues and conflicts in practice. STANDARD 6: PROFESSIONAL RESPONSIBILITY AND ACCOUNTABILITY The dietitian is accountable to the public and is responsible for ensuring that her/his practice meets legislative requirements, and Standards of Practice of the profession. Indicators: To apply Standard 6, each dietitian 6.1 assumes responsibility and accountability for her/his own professional actions 6.2 ensures that her/his practice complies with current legislation, and the Standards of Practice of the profession 6.3 follows and continually strives to make changes to pertinent legislation, guidelines, and policies and procedures to ensure consistency with the Standards of Practice 6.4 advocates for improvements in practice 6.5 acts to ensure that public safety is maintained. SCHEDULE B (section 23) CONTINUING COMPETENCY 1 Every member must participate in the Continuing Competence Program that is approved by the council. 2 Every member must prepare and maintain accurate and complete records of her/his professional self-assessment and professional growth plan, in accordance with guidelines and policies approved by the council. Areas for professional growth identified in this process should form the basis for planned learning activities in the next year. 3 Every member must prepare and maintain accurate and complete records of her/his completed professional learning activities, in accordance with guidelines and policies approved by the council. 4 Every member must submit to the college, at the time of membership renewal, confirmation of her/his activity in a professional growth plan. 5 Every member must make every record maintained in accordance with this Schedule available for inspection by the college on request. 6 Failure to submit records as required, or failure to comply with any other requirement of this Schedule, may result in the registrar imposing terms, conditions or limitations on a member's certificate of registration. The Continuing Competence Committee may direct the registrar to remove a term, condition or limitation before its expiry, if the Committee is satisfied that it is no longer necessary.
