(« cage sous-marine ») 1(2) All dates and all references to areas by means of numbers in this regulation are inclusive. 1(3) The open trapping area zones, registered trapline districts, registered trapline sections, special trapping areas and special trapping districts referred to in Schedule A are those identified and described in the Trapping Areas and Zones Regulation. 1(4) The wildlife management areas referred to in Schedule A are those identified and described in the Designation of Wildlife Lands Regulation , Manitoba Regulation 171/2001. M.R. 231/94; 13/2002 ; 163/2003 ; 196/2006 ; 132/2007 ; 144/2010 ; 170/2013 ; 210/2014 ; 176/2015 ; 74/2024 Commencement and termination of trapping seasons 2 Each trapping season set out in this regulation begins at 12:00 a.m. on the date of commencement and terminates at 11:59 p.m. on the date of termination. M.R. 210/2014 ; 176/2015 Restrictions on trapping and shooting 3(1) No person shall trap or shoot any wild animal named in Schedule A except (a) under the authority of an open trapping area licence or a registered trapline permit; and (b) during the seasons and in the areas set out in Schedule A. 3(2) No person shall trap or shoot more than the number of animals set out in any quota in Schedule A. If there is no quota set out in Schedule A, a person is permitted to trap or shoot an unlimited number of the specified animal. M.R. 231/94; 25/2000 ; 163/2003 ; 140/2005 ; 132/2007 Extending trapping season 3.1(1) The minister may, by written notice, extend a trapping season set out in Schedule A. 3.1(2) The minister must give public notice of the extension of a trapping season by posting signs or giving notice on the department's Internet site. M.R. 210/2014 Mandatory training for first time trappers 4(1) A person who has never held a trapping licence or permit either in Manitoba or in another jurisdiction shall not apply for or be issued a trapping licence or permit under The Wildlife Act unless the person confirms that they hold (a) a trapper education graduate certificate issued by the minister under subsection (2); or (b) an equivalent certificate issued by a competent authority in another jurisdiction. 4(2) The minister may issue a trapper education graduate certificate to a person who applies to the minister and who (a) is 12 years of age or over; and (b) has completed a trapper education course approved by the minister that is of at least 9 hours duration. M.R. 13/2002 ; 210/2014 ; 89/2020 Licences and permits issued using Internet 4.1(1) If a person is issued a trapping licence or permit over the Internet, the person must either (a) print the licence or permit and carry it with them at all times while carrying out any activity that is authorized by the licence or permit; or (b) carry an electronic device that contains the licence or permit with them at all times while carrying out any activity that is authorized by the licence or permit. 4.1(2) If a person is carrying an electronic device that contains their licence or permit, the person must access the licence or permit on their device and show it to an officer upon being requested to do so, and permit the officer to view it for such period of time as the officer may require. 4.1(3) If a person is carrying an electronic device that contains their licence or permit and is unable to access it and show it to an officer for any reason, that person is deemed to contravene subsection 61(2) of the Act. For greater certainty, it is not a defence if the device was out of power, damaged or experienced any technical difficulties that prevented the licence or permit from being displayed on the device when requested. M.R. 89/2020 Trapping and shooting on Sunday 5 A person holding a valid and subsisting licence or permit authorizing the trapping of fur bearing animals, black bears or gray (timber) wolves may, in an area in which such a licence or permit is valid, trap or shoot fur bearing animals, black bears and gray (timber) wolves on Sunday. M.R. 13/2002 Prohibited trapping areas 6 No person shall trap or shoot (a) a fur bearing animal, black bear, or gray (timber) wolf in Birds Hill Provincial Park, Beaudry Provincial Park, those portions of Pembina Valley Provincial Park set out in Plan No. 20106 filed in the office of the Director of Surveys at Winnipeg, or in an area designated as an ecological reserve under The Ecological Reserves Act ; (a.1) a muskrat in Grant's Lake Wildlife Management Area, except under authority of a special permit issued by the minister or a person authorized by the minister to issue permits; or (b) any fur bearing animal, black bear or gray (timber) wolf within game hunting area 38 as designated by the Hunting Areas and Zones Regulation , Manitoba Regulation 220/86, except under authority of a special permit issued by the minister or a person authorized by the minister to issue permits. M.R. 13/2002 ; 186/2002 ; 163/2003 ; 176/2015 Bait prohibited near Hudson Bay coastline 6.1 No person shall place a bait, edible substance or device within 10 kilometres of the Hudson Bay coastline that might attract or provide food for a wild animal unless the person holds a permit issued by the minister that authorizes the placement or (a) the person holds a valid trapping licence; (b) the person places the bait during a time in which the trapping season is open for the species being baited; and (c) the bait placed by the person is of a type, in an amount and at a location that is consistent for the species of wild animal authorized by the licence to be trapped. M.R. 186/97; 25/2000 Leghold traps and snares prohibited near Hudson Bay coastline 6.1.1 No person shall set a leghold trap or snare on land within 10 kilometres of the Hudson Bay coastline between September 1 and November 15. M.R. 89/2020 6.2 [Repealed] M.R. 210/2014 ; 131/2016 Prohibited equipment and activities 7(1) Unless otherwise permitted under this regulation, no person shall take or attempt to take a fur bearing animal or gray (timber) wolf using (a) a trap with teeth or a serrated edge; (b) a hook; (c) a spring pole or leghold trap in a tree or on a pole; (d) a leghold trap with a jaw spread exceeding 23 cm (9.06 inches); or (e) a device other than an approved device listed in Column 1 of Schedule B for the trapping of a wild animal listed in Column 2 in the location listed in Column 3 of that Schedule. 7(1.1) Unless otherwise prohibited under this regulation, a person may use any device to trap an animal for which there is a trapping season under Schedule A if that animal is not listed in Column 2 of Schedule B. 7(1.2) Despite subsection (1.1), a person must not use any of the following devices on land to trap any animal other than a muskrat: (a) Belisle Super X 110; (b) Woodstream Oneida Victor Conibear 110; (c) Rudy 110; (d) Duke 110; (e) Bridger 110; (f) Sleepy Creek 110; (g) Belisle Classic 110; (h) Oneida Victor Conibear 110-3 Stainless Steel. 7(2) No person shall take or attempt to take a black bear (a) unless that person uses a firearm; (b) while the bear is in a den, nest or lair; and (c) in the case of a female bear, while she is accompanied by a cub. 7(3) No person shall trap or attempt to trap a beaver, mink or river otter using a leghold trap unless it is used or set in a manner that will restrain or kill the animal under water. 7(4) No person shall trap or attempt to trap a badger, red squirrel, weasel or wolverine using a leghold trap. 7(5) No person shall trap or attempt to trap a coyote, arctic fox or red fox using a leghold trap unless the trap has first been modified with one of the following adaptations: (a) the addition of pad inserts over the jaws of the trap; (b) the use of laminated jaws; or (c) the use of offset jaws with a minimum offset of five millimetres. M.R. 170/2013 Inspection of live holding devices 8(1) A person who, under the authority of a trapping licence or permit, uses a live holding device for the purpose of trapping a gray (timber) wolf or fur bearing animal shall inspect the device at least once every 72 hours. Trapped animal to be killed humanely 8(2) A person who, under the authority of a trapping licence or permit, traps, takes or captures a gray (timber) wolf or fur bearing animal with a device that does not result in the immediate death of the animal shall immediately and humanely kill the animal after discovering its trapping, taking or capture. Live trapping in defence of property 8(3) A person who, under the authority of subsection 46(1) of The Wildlife Act , uses a live holding device for the purpose of trapping a wild animal shall (a) inspect the device at least once every 24 hours; and (b) [repealed] M.R. 132/2007 ; (c) surrender a wild animal that is captured to an officer on request, or otherwise dispose of the animal as directed by an officer. Killing live-trapped animal in defence of property 8(4) No person who, under the authority of subsection 46(1) of The Wildlife Act , traps, takes or captures a wild animal using a live holding device shall kill the animal unless directed to do so by an officer. M.R. 186/97; 186/2002 ; 163/2003 ; 132/2007 ; 210/2014 Use of snares 9(1) Subject to subsection (2), no person shall take or attempt to take a fur bearing animal or a gray (timber) wolf using a snare except in a registered trapline area or the Northern Special Trapping District. 9(2) Subject to any restrictions imposed under this regulation, a person may use (a) a snare for the purpose of taking a beaver under the ice in the open trapping area; (b) a power snare for the purpose of taking a fur-bearing animal or a gray (timber) wolf in any area; and (c) an approved power-assisted snare for the purpose of taking a coyote or red fox in any area. 9(2.1) A person who uses a snare on land shall ensure that the snare is equipped with a mechanical locking device that ensures that the noose is prevented from expanding. 9(3) [Repealed] M.R. 132/2007 M.R. 168/92; 231/94; 13/2002 ; 163/2003 ; 132/2007 ; 125/2008 ; 131/2016 ; 74/2024 ; 79/2025 Securing traps and snares on land 9.1(1) A person must not use a trap or snare on land unless it is connected by a metallic chain, cable or wire that is securely attached to (a) a tree; (b) a grapple; (c) a heavy object; or (d) a stake in the ground. 9.1(2) Subsection (1) does not apply to a Victor Rat Trap. M.R. 118/2018 ; 89/2020 Removal of traps, etc. 10 A person who uses a trap or snare shall remove it prior to the closure of the trapping season. M.R. 231/94; 13/2002 ; 74/2024 Retrieval of animal 10.1(1) A person who traps, shoots, takes, kills, captures or injures a gray (timber) wolf, black bear or fur bearing animal under the authority of a trapping licence or permit, shall make every reasonable effort to retrieve the animal. Waste of hide, skin or pelt 10.1(2) No person who, under the authority of a trapping licence or permit, traps, shoots, takes, kills, captures or is in possession of a gray (timber) wolf, black bear or fur bearing animal, shall allow the animal's hide, skin or pelt to be abandoned, wasted or spoiled. M.R. 186/97; 13/2002 ; 210/2014 Officer may destroy or remove improperly used traps 11 An officer may remove or destroy a trap or snare which the officer finds in use and which (a) is improperly maintained; (b) is set in such a manner that it is capable of taking a wild animal other than a fur bearing animal or gray (timber) wolf; or (c) has not been removed immediately after the closure of the fur bearing animal season. M.R. 231/94; 132/2017 ; 74/2024 Tagging of pelts 12(1) No person shall possess, buy, sell or dispose of, or attempt to buy, sell or dispose of the pelt or the unskinned carcass of a marten, fisher or river otter that has been taken, killed or captured in the Turtle Mountain Registered Trapline Section unless the pelt or unskinned carcass has affixed to it a tag or seal authorizing its sale or disposal issued by the minister. 12(2) It is not an offence under subsection (1) for a person who lawfully killed an animal referred to in subsection (1) to be in possession of the pelt or the unskinned carcass of that animal without a tag or seal authorizing its sale or disposal if he or she is not selling or attempting to sell or otherwise dispose of the pelt or the unskinned carcass of that animal. M.R. 168/92; 231/94; 170/98; 13/2002 ; 140/2005 Registered trapline permits and open trapping area licences 13(1) A person who holds a registered trapline permit in a trapping year must not subsequently hold an open trapping area licence in the same trapping year. 13(1.1) A person who holds an open trapping area licence in a trapping year must not subsequently hold a registered trapline permit in the same trapping year. 13(2) Despite subsections (1) and (1.1), the holder of a registered trapline permit who is the owner or tenant of private land may also hold an open trapping area licence that authorizes the person to trap or shoot fur bearing animals on that land. 13(3) An open trapping area licence issued under subsection (2) shall contain the legal description of the land on which the trapping or shooting is to take place. 13(4) In this section, "trapping year" means the period beginning on September 1 and ending on the following August 31.
