P210 Regulation 327/88 R Registered August 29, 1988 bilingual version (HTML) Table of Contents Section 1 Definitions 2 Permits 3 Requirements 4 Duties of operator 5 Food handling 6 Camp director 7 Register of campers and staff 8 Cleaning of accommodations 9 Cabins and other quarters 10 Requirements for permanent buildings 11-13 Repealed Schedule Definitions 1 In this regulation, "municipality" includes a local government district in which a recreational camp is situated; (« municipalité ») "operator" means an owner, operator, or person in charge of a recreational camp; (« exploitant ») "potable" means safe and fit for human consumption without further treatment; (« potable ») "public health inspector" means an inspector as defined in The Public Health Act ; (« inspecteur de la santé publique ») "recreational camp" means a camp operated for the purpose of recreation, providing instruction or both, and which provides sleeping and eating facilities for campers for periods exceeding 24 hours. (« camp de récréation ») M.R. 43/2024 Permits 2(1) The operator of a recreational camp shall apply annually to a public health inspector for a permit to operate the camp. 2(2) In the case of a recreational camp that is operated all the year round, the operator of the camp shall apply for a permit referred to in subsection (1) on or before December 1 of the year immediately preceding the year for which the permit is required. 2(3) In the case of a recreational camp that is not operated all the year round, the operator of the camp shall apply for a permit referred to in subsection (1) at least one month before the opening of the recreational camp. 2(4) The application for a permit referred to in subsection (1) shall be made on such form as may be prescribed by the minister. 2(5) A person must not operate a recreational camp without a permit. M.R. 43/2024 Requirements 3 A person must not establish, construct, reconstruct, add to, or relocate a recreational camp unless (a) the person obtains the approval of the municipality in which the recreational camp is located or, in the case of a relocation of the camp, the municipality in which the camp is to be relocated; (b) the site, plans and specifications of all the buildings have been approved by a public health inspector; (c) the plumbing, buildings and electrical installations in the recreational camp meet the applicable provincial and municipal rules, regulations and by-laws, as the case may be; and (d) the buildings meet all the applicable regulations relating to fire safety and fire protection. M.R. 43/2024 Duties of operator 4(1) The operator of a recreational camp shall ensure that (a) adequate medical care is provided at the camp or is conveniently available; (b) a first aid kit containing aromatic spirits of ammonia, a recognized skin antiseptic other than tincture of iodine, sterile gauze, absorbent cotton, adhesive plaster and bandages of adequate and varying width is readily available and is kept where it is easily accessible to persons making use of the facilities at the recreational camp; (c) ropes, life buoys and reaching poles are readily available and kept where they are easily accessible to persons making use of the facilities at the recreational camp; (d) where bathing facilities are available, beaches are kept in a clean condition; (e) the off-shore outer limits of bathing areas are clearly marked by adequate signs, and the attention of the public is drawn to any danger by providing a clearly marked sign painted in block letters not less than 7.6 cm (three inches) in height, or by providing appropriate devices warning the public of that danger; (f) where the surface area of the water defined as the bathing area exceeds 929 m 2 , a life boat, or paddle board, or such other substitute in place of a boat as is approved by a public health inspector, is provided; (g) a supervisor is in charge of the water-front program, and is in attendance at all times when bathing facilities are in use; (h) animals are excluded from the bathing area; (i) change rooms or other facilities are provided to appropriately accommodate the privacy needs of campers; (j) where boating facilities are available at a recreational camp, an adult supervisor is in charge of the boating program, and is in attendance at all times when the boating facilities are in use; (k) an adequate supply of potable water is at all times available at the recreational camp; (l) the area comprising the recreational camp is properly drained, and no pools of stagnant water or other offensive conditions exist at the recreational camp; (m) the sewage disposal system at the recreational camp meets the requirements of The Environment Act and The Public Health Act and the regulations made under those Acts; (n) adequate toilet and lavatory facilities are provided at the recreational camp as set out in the Schedule; (o) where laundry facilities are available at a recreational camp, they are situated at locations approved by a public health inspector and are operated in a manner satisfactory to the public health inspector; and (p) a sufficient number of covered containers are provided for the retention of garbage and refuse and adequate and proper facilities are provided for the disposal of all garbage and refuse in accordance with the regulations under the Act relating to the disposal of waste. 4(2) The supervisor referred to in clause (1)⁠(g) must (a) be at least 16 years of age; (b) hold (i) for the years 2024 to 2026, a current Lifesaving Society National Lifeguard Award, or (ii) for the year 2027 and subsequent years, a current Lifesaving Society National Lifeguard Award (Waterfront); and (c) hold current intermediate level first aid and CPR Level C certification issued by a provider approved by the minister. 4(3) Despite clause (2)⁠(a), a person who is 15 years of age may act as a supervisor if they (a) meet the other requirements of subsection (2); and (b) are supervised by the camp director or an adult member of the camp's staff in accordance with section 26.1 of the Employment Standards Regulation , Manitoba Regulation 6/2007. M.R. 43/2024 Food handling 5 The operator of a recreational camp shall comply with the Food and Food Handling Establishments Regulation , Manitoba Regulation 339/88 R. M.R. 43/2024 Camp director 6 The operator of a recreational camp shall ensure that at all times the camp is under the care and supervision of a responsible and experienced camp director. M.R. 43/2024 Register of campers and staff 7 The operator of a recreational camp shall keep, or cause to be kept, at the office of the recreational camp, a register wherein the permanent address, and the date of arrival and departure, of all campers and camp staff is recorded. M.R. 43/2024 Cleaning of accommodations 8 The operator of a recreational camp must (a) ensure each room, tent and cabin is thoroughly cleaned after each occupancy; and (b) where bedding is provided, keep the bedding in a clean and sanitary condition, and provide freshly laundered sheets and pillow cases at least once a week, and for each new occupant. M.R. 43/2024 Cabins and other quarters 9 All cabins or other structures used for living quarters in a recreational camp must (a) be of sound weatherproof construction; (b) have all floors built on rat-proof foundations, or built with a clearance of at least 30 cm (12 inches) between the ground and the underside of the floor joists; (c) have in all habitable rooms, windows or openings equal in area to one-tenth of the floor area, and which shall be capable of being readily opened; and (d) be provided with effective screens for all outside windows, openings and doors. M.R. 43/2024 Requirements for permanent buildings 10(1) In a recreational camp where sleeping quarters are provided in permanent buildings (a) there must be provided for each camper individual dry locker or shelf space for personal possessions and clothing; (b) the beds must be at least 91 cm (three feet) apart horizontally; (c) each room used for sleeping purposes must have (i) at least 3.7 m 2 of floor area for each bed or bunk, (ii) at least 7.9 m 3 of air space for each person sleeping therein, (iii) where beds or bunks are in a double tier, the building walls must be at least 2.4 m high measured from the floor, and there must be at least 91 cm of unobstructed clearance between the top bed or bunk and the ceiling, and (iv) where the beds or bunks are in a single tier, the building walls shall be at least 2.1 m high measured from the floor. 10(2) Subclause (1)⁠(c)⁠(ii) does not apply where the recreational camp is used (a) for summer activities only; or (b) for other activities not exceeding a period of 72 hours for each activity period. 10(3) Where a system of ventilation is installed that will provide a minimum of two complete air changes every hour, a public health inspector may give written permission to the operator of a recreational camp to operate the camp with rooms which do not meet the requirements of subclause (1)⁠(c)⁠(ii).
