P210 Regulation 330/88 R Registered August 29, 1988 bilingual version (HTML) Table of Contents Section 1 Definitions 2 Repealed 3 Sources of water for food handling establishments 4-5 Sale of water for domestic purposes 6 Wells for domestic purposes 7 Defective system, unsatisfactory water or improper well 8 Disinfecting water supply 9-10 Repealed 11-12 Water for public or others to drink Definitions 1 In this regulation, "domestic purposes" means the use of water for drinking, washing dishes, or for a food handling establishment or the supply of water to drinking fountains, kitchen sinks, wash basins, baths, or showers; (« fins domestiques ») "food handling establishment" means any premises in or on which food is prepared for sale, offered for sale, sold, deposited for sale, or stored; (« établissement de manutention alimentaire ») "inspector" means a public health inspector appointed or designated under The Public Health Act , or a drinking water officer appointed under The Drinking Water Safety Act ; (« inspecteur ») "local authority" means (a) municipality, (b) local government district, or (c) in unorganized territory that is not in a local government district, the minister; (« autorité locale ») "medical officer of health" means a medical officer of health appointed or designated under The Public Health Act ; (« médecin hygiéniste ») "potable" means safe and fit for human consumption without further treatment. M.R. 37/2007 Sources of water for food handling establishments 3 No person shall, in a food handling establishment, use water from any source other than that provided and controlled by the local authority, except with the approval of the medical officer of health or the minister. Sale of water for domestic purposes 4 No person shall sell or offer to sell water or convey water for sale for domestic purposes except by written permission of the medical officer of health. 5 No water for sale for domestic purposes shall be transported or conveyed in any vehicle unless the tanks, other receptacles and equipment are maintained in sanitary condition and in good repair to the satisfaction of the medical officer of health. Wells for domestic purposes 6(1) Wells constructed for domestic purposes shall be so located, constructed, and maintained as to prevent contamination of the water. 6(2) The medical officer of health or inspector may direct the methods of construction or the materials, or both the methods and the materials, that may be used to protect a water supply. 6(3) Where a well is no longer in use or is permanently abandoned, the owner thereof shall protect the water bearing formation against possible pollution as directed by the medical officer of health. Defective system, unsatisfactory water or improper well 7(1) Where any public or private water supply system is found to be defective or the water unsatisfactory for domestic purposes, remedial measures shall be undertaken by the owner as directed by the medical officer of health. 7(2) The medical officer of health may order the reconstruction, disinfection, or closing of a well where, in his or her opinion, the water is unsafe or the well is improperly located, constructed, or protected. Disinfecting water supply 8(1) All surface water shall be considered unsafe for domestic purposes unless boiled, chlorinated, or otherwise disinfected to the satisfaction of the medical officer of health. 8(2) All private drinking water derived from shallow wells shall be disinfected to produce a microbiologically safe water, but disinfection is not required in the absence of erratic or high level coliform contamination or other contaminating factors. 9 and 10 Repealed. M.R. 37/2007 Water for public or others to drink 11(1) No person owning or controlling a public place shall provide drinking cups for common use or allow drinking cups for common use to be on the premises. 11(2) When drinking water is supplied in any place for the use of the public or for guests, patrons, visitors, or employees, the person controlling same shall provide sanitary drinking fountains or individual drinking cups. 12 Water for drinking purposes in a public place shall be stored in covered containers.
