" Act " means The Registered Respiratory Therapists Act . («  Loi  ») " examination " means The Manitoba Association of Registered Respiratory Therapists Competency Challenge Examination or an examination approved as equivalent by the board. (« examen ») M.R. 237/2006 PART I.1 QUALIFICATIONS FOR REGISTRATION Registration: graduate of Manitoba program 1.1 Subject to the provisions of the Act, any person who furnishes evidence to the board that he or she (a) is a graduate of a respiratory therapy education program in Manitoba; (b) does not suffer from a physical or mental condition, disorder, or addiction to alcohol or drugs that makes it desirable in the public interest that he or she not practise respiratory therapy; (b.1) has not been convicted of an offence that is relevant to his or her suitability to practise; (c) has applied in writing in a form prescribed by the board; (d) has paid the registration fee prescribed by or under the by-laws of the association; (e) has successfully completed any required refresher program approved by the board; and (f) is eligible to write the examination or, if required by the board, has passed the examination; is entitled to become a member of the association and to be entered in the register and in the roster of active practising members. M.R. 237/2006 Registration: graduate of program outside of Manitoba or member of other jurisdiction 2(1) Subject to section 3, any person who furnishes evidence to the board that he or she (a) meets either of the following criteria: (i) is (A) a graduate of a respiratory therapy education program outside of Manitoba, which the board by resolution approves as substantially equivalent to programs that were accredited or approved in Manitoba at the time of the applicant's graduation, and (B) registered or eligible to be registered as a respiratory therapist within a province, territory, state or country outside of Manitoba, (ii) is a graduate of an education program in a health profession approved by the board and has passed the examination or successfully completed a competency assessment, or both, as determined by the board; (b) is not subject to any suspension or revocation of the right to practise as a registered respiratory therapist or other health care professional in any jurisdiction; (c) does not suffer from a physical or mental condition, disorder, or addiction to alcohol or drugs that makes it desirable in the public interest that he or she not practise respiratory therapy; (c.1) has not been convicted of an offence that is relevant to his or her suitability to practise; (d) has applied in writing in a form prescribed by the board; (e) has paid the registration fee prescribed by or under the by-laws of the association; and (f) has successfully completed any required refresher program approved by the board; is entitled to become a member of the association and to be entered in the register and in the roster of active practising members. M.R. 237/2006 2(2) Subject to section 3, where a person does not meet the requirements under clause 1.1(a) or clause 2(1)⁠(a) but meets the other requirements in section 1.1 or subsection 2(1), upon application and payment of the registration fee, the board may, in its discretion, enter in the register and the roster of active practising members any person who (a) furnishes evidence to the board that he or she has been registered in good standing as a registered respiratory therapist in any jurisdiction approved by the board; or (b) passes the examination. M.R. 237/2006 Refresher program requirement 3 A person applying for membership under section 1.1 or 2 who has not (a) practised as a registered respiratory therapist for a total of at least 720 hours in the four-year period immediately preceding the registration year for which registration is sought; (b) successfully completed a respiratory education program approved by the board within the four-year period immediately preceding the registration year for which registration is sought; or (c) passed the examination within the four-year period immediately prior to the application for membership; must be required to successfully complete a refresher program approved by resolution of the board before his or her name is entered in the register. M.R. 237/2006 Examination pass mark 4(1) The board must set the pass mark for the examination. M.R. 237/2006 4(2) A candidate who fails to achieve the pass mark must be advised of the failure by registered mail or other delivery service that provides the sender with acknowledgment of receipt. M.R. 237/2006 4(3) The association shall not disclose the specific examination score obtained by a candidate except to the candidate. 4(4) The examination must include both a theory and clinical skills evaluation. M.R. 237/2006 Policies and standards for examinations 5 The policies and standards pertaining to the examination shall be consistent with those adopted by The Canadian Society of Respiratory Therapists. M.R. 237/2006 PART II RENEWAL OF REGISTRATION Qualifications for renewal of registration 6(1) In order to qualify for renewal of registration as an active practising member, a person shall (a) have met the continuing competence requirements set out in clause 6.1(2)⁠(a) or (b); and (b) not be subject to any suspension or revocation of his or her right to practice as a registered respiratory therapist in any jurisdiction. M.R. 237/2006 6(2) A person who qualifies for renewal of registration as an active practising member and who for each registration year (a) has paid the registration fee prescribed by or under the by-laws of the association; and (b) has applied in writing in a form prescribed by the board; is entitled to have his or her name maintained in the register and in the roster of active practising members. 6(3) The name of a person who fails to make the application and pay the fees referred to in subsection (2) by January 31 in any year shall be struck from the roster of active practising members effective March 1 of that year but shall be restored to the roster, subject to the provisions of subsection (1) upon satisfying the requirements of subsection (2). M.R. 185/92 6(4) If an applicant for renewal does not meet the continuing competence requirements set out in clause 6.1(2)⁠(a) or (b), the registrar may renew the registration subject to terms and conditions for up to one year. M.R. 237/2006 PART II.1 CONTINUING COMPETENCE PROGRAM Continuing competence program established 6.1(1) The board must establish a continuing competence program for the members of the association entered in the roster of active practising members and set policies in respect of it. M.R. 237/2006 6.1(2) To satisfy the requirement of continuing competence for renewal of active practising registration, (a) a member must have (i) practised as a registered respiratory therapist for a minimum of 720 hours in the four-year period immediately before the registration year for which renewal is sought, and (ii) successfully completed, in the 12-month period immediately before the registration year for which renewal is sought, a minimum of 24 hours of continuing education in respiratory therapy approved by the board; or (b) within the 12-month period immediately before the registration year for which renewal is sought, a member must have (i) successfully completed a respiratory therapy education program or a course of instruction, approved in accordance with criteria established by the board, or (ii) passed the examination. M.R. 237/2006 PART III GENERAL PROVISIONS Standards 7 The standards set out in the Schedule to this regulation are the standards prescribed for the education of registered respiratory therapists. M.R. 237/2006 8 [Repealed] M.R. 237/2006 SCHEDULE STANDARDS AND OBJECTIVES FOR THE APPROVAL OF REGISTERED RESPIRATORY THERAPISTS EDUCATION PROGRAMS Program objectives A respiratory therapy education program should ensure that students (a) acquire competence and an understanding of their roles in health care so that they may function responsibly and with empathy as members of the health care team; (b) are able to explain clearly the theory behind all the procedures outlined in the syllabus approved by the board; (c) are able to apply the theoretical knowledge to clinical practice; (d) acquire the technical ability to work accurately and effectively, especially under pressure; (e) master techniques for all procedures outlined in the syllabus approved by the board; (f) are able to use effectively all equipment related to the procedures outlined in the syllabus of the national registering body; and (g) are adequately prepared to pass the examination. M.R. 237/2006 Standard I Where applicable, respiratory therapy education programs shall contain and maintain Canadian Society of Respiratory Therapists accreditation status. M.R. 237/2006 Standard II A respiratory therapist education program shall contain (a) its objectives which must be consistent with those of the national registering body; (b) its curriculum; and (c) the methods used to evaluate the student's success in meeting the objectives. Standard III A ratio of one registered respiratory therapist to each student therapist shall be maintained in hospitals approved as training facilities for respiratory therapists. Standard IV The educational facility for respiratory therapists shall provide a statement of the ways by which students, teachers and the program are to be evaluated that describes (a) the criteria and methods by which the performance of students will be assessed, concurrently and terminally, in terms of objectives of the program; (b) the criteria and methods for progression in the program and graduation from the program; (c) the criteria and methods by which the performance of the teachers will be assessed in terms of objectives of the program and policies of the sponsoring agency; (d) the criteria and methods by which the effectiveness of the program will be assessed; (e) the methods by which results of the evaluations will be used to plan and implement modifications of the program.
